Atty. I was hired as an HR Officer Last January 31, to July 25, 2023. I was a Probationary Employee that time. I did follow the standard of evaluation including myself, I did pass the evaluation. The thing is on July 22,2023 I was called by the wife of the owner of the company and informed me that I am terminated because they wanted to lessen their employees. I was shocked knowing that the company is still hiring for employees in order to supply the demand of having clients. I was not given a Notice of Termination, there was no due process being followed and on July 25, 2023 I was informed verbally by the owner itself that it was my last day of office. Again I was shocked and my mind blew out of proportion that I wasn't able to counter everything. Now, my question is can I still file for a complaint on Dole against them? Even if it was already five months ago? Hoping to receive a solicited advice on your part. I'm an avid subscriber here. Thank you.

Atty. tanong ko lang po, yung company kasi na papasukan ko may 1year contract sila, tpos pag hindi natapos ang contract ay need mo mag bayad ng 90k. At kakit na terminate ka ng hindi pa tapos ang 1year ay need pa din mag bayad. Paano po kung wala naman kakayanan mag bayad ang empleyado? Ano po ang mangyayari? At ano po ang dapat gawin?
Generally speaking, kung hindi po acceptable sa employee yung terms ng contract, free po sya NOT to enter into the employement contract po. Kung hindi katanggap tanggap ang mga kundisyon, hindi po pwede pilitin ang employedo na pumasok sa kasunduang ito. Pero once pumirma na po sya, ang ibig sabihin tinatanggap po nya ang nilalaman ng kasunduan. Kontrata po kasi ang Employment Contract.

Hi Atty., what if a company gave you a notice to transfer, prior to be hired, however, you already turned down the idea of relocation but they still hired you. And then after 2 years of working, you are already a regular employee, they issued you a notice of transfer but you declined. And this company used it to terminate your contract. Do we have the right to complain?
