The Supreme Court called the tune and English had to dance to it. Though he may feel he was fiddled, he was left with a reel in his Head as he now realises the jig is up he cant waltz around it and will have to pay the piper.
Basically as a musician who spent years on the road I never felt like an employee . Free to leave at any time & often did for greater financial reward because the bigger the band the bigger the cash earned. If you didn't have a gig you didn't get paid & your fee was based on a 60/40 take on the door. Dont see what was different in the Michael English Band
its great to see employee rights being protected in courts. This contractor and sub contractor nonsense is widespread all over Ireland and was imported form the USA.
Can you please explain the Revenue Commissioners "contract for service" and their "contract of service" meanings please? the difference between both! Subtle if any, I doubt if subtle, but would love to hear your take on it.
The saying "you're only as good as you,re last gig" comes to mind . Bands won't last ten minutes if this is the outcome . Here's how it goes , the base player is hitting bum notes , playing out of time , the crowd fecks off cause the music sounds like shite all because the price on the base is having personal problems , the rest of the band suffers as a result because of one member of the band , and after verbal warnings , written warnings , final warnings the rest of the band has lost out on gigs because of one entitled asshole who thinks they are owed a nappy and a warm bottle of milk
And what about agency staff who get just a assignment and no terms no health and safety no policy on disciplinary. Get paid by an agency but are in the day to day controll of the hirer and have no contact with the agency after placement except to get a payslip.

It's funny , out in RTE , some of the big boys go the other way. They make themselves out to be a business , a company. More tax efficient they reckon.

A contract of service means it is an employment contract.
A contract for services means it is an independent contractor situation, not an employee.

What's the consequences re tax and vat paid in the past does it revert back to paye and who is liable for the paye tax
I have no idea, to be honest. Perhaps Revenue will be looking at this case, and others, to see what the implicaitons are..
