@@pbase36 You would never make it as a lawyer; A) If you were to actually entertain them being racists, that would have nothing to do with anything... it doesn't become a murder if they can be proven to be racists. B) It is categorically, unequivocally not murder under law due to being SELF-DEFENSE, there is ZERO ambiguity there under law. They follow someone who broke into a house to question him, possibly put him under citizen's arrest (Also 100% within their rights), the criminal starts punching one of them in the face, the man who has been punched six times or so and is getting his gun grabbed and nearly pulled out of his hand to possibly be used against him by the violent criminal fires.... you have to be fully brain dead to not understand that that is beyond a shadow of a doubt SELF-DEFENSE.

I find it ironic that so many of the defenders of these two are pro "self defense", and inexplicably support them for unlawfully chasing this guy down as self defense. But then also say stuff like "hey, if it were me I wouldn't charged at a loaded shotgun". Baffling hypocrisy. I know it's an attempt to excuse the shooting, but again, a lot of these people are the type to say "if that were me I would have pulled out my concealed handgun and fought off the terrorists", it just makes no sense. They praise themselves in their own mind for being willing to die heroically, and in self defense, but Arbery does something taking more courage than themselves even in their own fantasies, and it's grounds for killing him justly. This was one of the cases that really woke me up. I was never on the right, or left. And I honestly don't want to get political because I know it's just a show and there is only one party. But I was still listening to Tim Pool, and trying to take in both sides, and I still do, but after hearing all them make excuses I found myself disgusted. They posted the dead body of a man they killed online, repeatedly, called him racial slurs, with a track record of doing it to others, hunted him down in a pickup truck, and one of the parties I'm supposed to respect wanted to praise the police force for just ignoring it...And then I start seeing comments everywhere about "joggers", because one person, one time, speculated 'maybe he was jogging'. And that was their big gotcha moment. Whole new line of hidden slurs used all over now because the notion of speculation, or him walking instead of jogging, were too distant an idea for their peanut brains to reach. Such an ugly time to be alive, I had no idea the country was this racist. And a part of me really thinks it wasn't this bad before. But maybe it's just rose colored glasses.

See the Feb. 11 incident at which 911 was called on Arbery, at night, at the property(purportedly). Burglaries had been happening. Travis's handgun was stolen from Travis's truck in January/new years. Arbery walked to the house, and ran fast out of the house after the neighbor across the street called out to him about with concern of his(Arbery's) activities there. The word had been shared around the neighborhood of Arbery's entry's into the property, including at night. And thus, on the final day, Arbery was disrespecting/ignoring the neighborhood watch call outs. They didn't want to harm or kill Arbery,…. all Arbery had to do was respect, cool the situation down,…. ask 'what's up',….. and the McM's would chilld down too. It's a matter of respect for reasonable neighborhood territorialism. This is not a neutered wimpy community. They're going to stand up to suspiciuos activity, suspicious behavior, and so they did. But it backfired in this case.

He ran around the truck and Travis stepped towards him pointing the gun in his direction. None of us saw what Ahmauds hands were doing while he was in front of the truck. Even Travis said he didn't remember if Ahmaud reached for the gun. That narrative came out later when they were trying to justify shooting him. If you believe Arbery was touching the gun it's because you want to belive it, not because it's supported by forensic evidence.

This is not about merely going into construction sites.

And the murderers very nearly were protected by white privilege. The police officers who came to the scene took their word for what had happened, and the prosecutor at the time didn’t press charges. There has been a lot of discussion about the racial makeup of the jury but I think another interesting aspect here in the gender makeup of the jury, it was almost all women. Now, one of the defense's main arguments seemed to have been that if some random guy pulls up next to you and says "hey I want to talk to you" then you are obligated to stop and talk to them. This arugment is absoultly ridiculous but it is especially absurd to almost every woman in the world. We know the fear of being followed, of having strange men trying to talk to us, having to plan out an escape strategy in our head, etc. This argument was never going to sit well with most women. And, I think the fact that they thought it was a reasonable argument is just more evidence of their privilage white male statues. They truely believe that if they tell someone "hey I want to talk to you!" That person has to stop and talk to them.

We couldn't detain someone unless we watched an offense (putting unpaid-for jewelry from a sales kiosk into a pocketbook, for example), then maintained contact of the subject all the way until he or she exited the store, while being certain all the while that the merchandise was not dispensed in the process. If at any time visual contact is lost--the subject stops somewhere and bends down behind a clothing rack, for instance--the apprehension must be aborted. With that knowledge, when I heard about this case, I just couldn't believe it. Without even a solid grain of visual evidence these men hunted down and violently confronted a young man, killing him in the process. They deserve all the time they'll be sentenced to, and some, because no matter how many years they waste away in jail cells, Ahmaud will still be gone, unjustly because of them.

      @guntguardian3771 2 года назад +14

This is wrong. First, no one is allowed to use lethal force to prevent someone escaping - unless they are deemed to be an active threat to others. The use of lethal force is not to detain someone, it is in self-defence in response to someone resisting detention.
If the McMichael's had a legal right to detain Arbery then when he seemingly lunged for the weapon of one of them they could argue - perhaps successfully - that when they shot him this was an act of self-defence, it is legal to kill someone in self-defence if the force used was deemed proportionate in the circumstances. If someone is trying to take a lethal weapon from you, then that makes the situation potentially life threatening.
As it happens with this particular case, the statute for Citizens Arrest in Georgia limits the power of Citizens Arrest, those involved need to have a felony committed in their presence. Since the McMichael's were not in the area then this rules out a lawful citizens arrest. Even if they had seen him entering the building site, they had no evidence of a crime - if he had entered the property this would have been trespass which is not even criminal until the owner tells you to leave and refuse. What this means is that because the McMichael's had no right to detain Arbery, they cannot claim self-defence.
The jury made the right decision in my view, it wasn't even close it was clearly a murder.

This issue was a major issue in the trial and was hotly contested. The state easily won that one. I seriously doubt if the defense would have withheld the information you wrote of. @@AP-fe9hm A crucial legal question was whether the three defendants were trying to make a lawful citizen’s arrest. The relevant law is only two sentences long:
A private person may arrest an offender if the offense is committed in his presence or within his immediate knowledge. If the offense is a felony and the offender is escaping or attempting to escape, a private person may arrest him upon reasonable and probable grounds of suspicion.
In an independent analysis of the case, lawyer Andrew Branca argues that the two sentences anticipate two different scenarios. The first sentence is about minor offenses, such as shoplifting; citizens may not step in unless the crime was “committed in their presence or immediate knowledge.” In the case of a felony, a citizen can act on “reasonable and probable grounds.”
Prosecutor Linda Dunikoski tried to combine the two sentences, insisting that the crime for which citizens could make an arrest had to be a felony committed “in their presence.” She noted that trespassing - the only crime of which Arbery is known to the defendants to have been committed - did not justify citizen’s arrest, claiming that detention was lawful only in “emergency situations” when a crime is happening “right then and there.”
Mr. Branca notes that when a law is ambiguous it must, under the doctrine of “lenity,” be interpreted in the favor of a defendant, which would mean the men had the right to arrest Arbery merely for trespassing. Judge Walmsley did not clear up the ambiguity, and seemed to side with Miss Dunikoski, telling the jury that anyone who is the target of an unjustified citizen’s arrest “has the right to resist the arrest with such force as is reasonably necessary.”
Miss Dunikoski followed up this advantage: “You [Travis McMichael] can’t claim self-defense if you are the unjustified aggressor,” she said. “Who started this? It wasn’t Ahmaud Arbery.” Clearly, it is absurd to say that Travis McMichael forfeited all rights to self-defense. Was he legally obliged to let Arbery beat him to death? No matter what led up to the fight over the shotgun, at some point is could be reasonable to see Arbery as the aggressor. The jurors have not explained their verdict, but if they accepted the prosecution’s argument, there was never any hope for an acquittal.
In her closing arguments, Miss Dunikoski made the outrageous claim that the defendants chased Arbery “because he was a black man running down the street.” There had been no testimony to suggest race had anything to do with the decision to give chase, and it is impossible to believe the McMichaels would have jumped into their truck if Arbery had just been “a black man running down the street.”

The old "play stupid games, win stupid prizes" comes to mind as everyone was out there illegally due to the curfew.
Judicially I think the Rittenhouse verdict was right under the law but I don't feel good about the precedence set. I don't think we don't want 17-year-olds running around with weapons short of hunting animals in the middle of nowhere. I wish the gun charge on Rittenhouse had been upheld; not to necessarily punish Rittenhouse but to serve as a precedent that . If you aren't old enough to drink, smoke or serve you should not be capable of projecting power afforded by guns.

They literally hunted him like deer... I watched the video thinking it was going to be edited, but no, it was a gruesome hunting of a man...

I could barely watch it, it was so sad. But we have to open our eyes and see this injustice, to be aware and to be able to advocate. Still, it is hard. It is depressing, and it breaks my heart.

It was so disturbing how they did that and then when he was literally laying in the street dying, NO ONE TENDED TO HIM! EVEN AFTER THE POLICE ARRIVED!
The whole thing makes me sick

I agree Dr G it's a frightening thing to get out of ones mind and the total disregard for human life...lts a good thing they took them off the street bc it makes me wonder about other things they might have done, if not...rip Ahmad Arbery ❤️💜

Oh my heart. I totally agree with you. 😪 How sad this is. A beautiful young man killed at the hands of these awful men. Im glad they got life sentences. How tragic & painful.
