    I don’t know any college student who would want to maintain a friendship with someone who sexually assaults a 7 year old. Most people would be disgusted by that. The fact that Jeremy didn’t even seem to try and cover up the fact that he was assaulting her when David saw them makes me question their friendship and dynamic.

I think you are definately correct in assuming that, because most pedos would feel some sort of shame and fear of prosecution if someone witnessed their action. the fact that he didn't at all feel the need to hide makes me think that tbh they were in this together. I honestly think that david cash is a sociopath, most people would at least pretend like they felt guilty about not doing anything.

      The problem is if he had stayed in the bathroom for long he probably would have been accused of taking part in what was going on and been falsely convicted. He made the smart move legally in getting out of there ASAP. I do think he probably should have contacted the police and an attorney though. Holding people accountable for not stopping crimes committed by other people is a slippery slope. I get that his actions can come off as morally wrong, but I don't believe what he did should be considered legally wrong. Such laws are next to impossible to enforce.

      @@DottieMinerva I apologise if I offended anyone. I think most bad behaviour can be potentially diagnosed as a mental disorder or personality disorder, particularly if it’s persistent. He reminded me of a family member on the autism spectrum and that’s why I left my comment. Keep in mind the spectrum is very broad and fits a lot of completely contrasting behaviours, not all people are the same in this “category”.

    Mothers look the other way when their child is being sexually abused by a family member; family members will look the other way when a child is being abused by the parent; whole families will let children rot in foster care cause the parents couldn’t keep taking care of them. They’ll go on about their lives like nothing in the world is wrong.
    People are selfish and broken. It’s a mad world.

      The truth is what caused outrage was his lack of pretending and letting his real thoughts come to the surface.
      The guy turned the mirror to society. This is why I respect more people who do "the right thing" because it is so rare,

      I'm telling you right now if any of my 5 nieces or nephews go to foster care.. Thats where they stay I dont have kids dont want them. my sister opened her legs and had them I'm not stopping or ruining my life cause of her bad decision.. Innocent kids yes.. But not my burden.       @jim Child abuse is not low. Child abuse in some form is actually high. Most of the time the victims keep sexual abuse secret out of fear of destroying family calm or friendships or threats of violence. Up until recent times beating kids with belts until they bled was not considered abuse unless any child was hit with the belt buckle. I recall 3 of several murders by parents that were reported just last week.

      Psychopaths seem able to compartmentalize parts of their lives so that events are discrete and do not impact upon them. Most people could never have walked away thinking that that baby girl might be being sexually assaulted never mind murdered!

      I was wondering the same thing. He was so irresponsible to leave his children in a casino, where they shouldn't have been in the first place. And the fact that he would rather gamble than take his children to a hotel showed he was too selfish to be a father.

    I remember when this happened. Hearing the details is God awful and I wish the girls father and the killers friend would have been sentenced. That poor little girl had pure trust and everyone let her down.

      I just think it is so sad that we even need a written law, so people cant just leave someone for dead.

      Nothing is ever enough, when it is illegal to do nothing! Illogical bullshit becomes law in places full of illogical people. Maybe, if everyone is housed in prison for the potential to be a non-active bystander, we will achieve the perfect, crime-free state. Invest in prison systems now. They are the future. (However, any profits can only be spent on what is allowed into your cell. Everyone loses when no one is allowed their own agency.)

    You would have to render me unconscious or kill me to keep me from protecting a child in a situation like that. It wouldn't matter if I knew them or not. Children always deserve protecting and your relationship or not having one for that matter doesn't change that fact. I just can't fathom the reasoning. If you're not capable of committing the crime how are you capable of being complicit in it? How folks can make that moral distinction is beyond me. I mean the dude could've just told a security guard or even an employee and there's a 99% chance that girl would still be here. You can be indifferent, you can be a coward but you can't argue you don't know right from wrong when you obviously do. The whole situation is sad and disgusting. That poor baby was failed by everyone involved including her father.

      Same here. That Jeremy was "caught" yet continued implies at the very least he knew David wouldn't do anything. I figure this had happened multiple times before, but this time it only received attention because he killed the girl. (If that's the case, that would be a sick irony: that previous victims aren't known BECAUSE he left them alive, and they didn't tell anyone what happened for all the reasons child sexual assault victims often don't come forward.)

      In general, it isn't a crime to witness something and not report it. If someone wants to overlook reporting a crime, that's their personal decision and should be respected.

    I don't know if Cash himself has ever committed a violent crime, but I believe he has the personality that would definitely do so if he knew he could get away with it and it would benefit him in some way. He seems pretty intelligent so hopefully fear of getting caught would stop him, but that total lack of empathy is frightening.

      @@cht2162 yes, and even if he was afraid of being blamed, he knew what was going on in that bathroom and could have called 911 and told them that something bad was happening in that bathroom right at that very minute, and someone needs to get in there IMMEDIATELY. he could use a pay phone if he didn't want the call traced to his phone. and he could have left the offenders name as the perpetrator. or not, if he was still afraid.

    I saw a grown man hitting a young girl violently in the face. I yelled at him to stop. The guy got out of the van and came after me, screaming in my face. The men all walked by in the parking lot and pretended not to see. Men won’t cross each other to defend a girl or woman. It is rare for a man to help, despite the cheap sentimental twaddle.

      Its socially acceptable for a guy to punch another guy in the face, the same cant be said for a women. A man stepping in has to be ready for physical repercussions, a street fight can easily be deadly, so maybe you shouldnt draw such broad conclusions from one incident and a narrow view

      Was it a domestic violence thing? I know guys who absolutely will not step in to help because domestic violence is insane.
      There have been instances where someone attempts to stop domestic abuse just to be attacked by both the victim and abuser.
      A lot of men don’t think it’s worth it to get into the scuffle.

      I hate it when people say "a young girl" when they probably mean "a young woman". It makes things ambiguous.
      A girl is a female below 14 years old. A "young girl" is all (actual) girls.
      The use of "young" actually makes me thing it was a young WOMAN - because nobody would use "young" for a Girl...maybe "little" for especially young ones. But it's impossible to know whether it was a woman or an actual child (in the biological sense [

    Wow! The typical “it is not affecting me, not my problem” mindset. Awful! You would think that if David even “cared” about his friend, he would have done all possible to stop him from committing this crime. Idk, yell, scream… do something at that moment… David obviously did not care about a little girl being murdered by his so called “friend”… and as you said Dr. Grande, it seems his feelings were genuine, he truly did not care…
    It scares me to realize there are more people like David in society.

      I did not know at the time, and do not know to this day, why the Nevada authorities did not charge David cash as an accessory to the murder. He knew the assault was going on, and then after his friend admitted the murder, he helped him escape by giving him a ride back to California with him and his father in the car.

      @@Retrosenescent "Aiding and abetting". Even assuming there was some defect in the Nevada statues that somehow allow a person to knowingly help a murderer flee after the crime, instead of fixing it the state legislature came up with this stupidly specific "duty to report" BS law.
      Apparently, as long as you're only the getaway driver in Nevada that's A-OK!

      Everything in his environment is orderly and organized.
      If one remembers- when he showed off some of his mechanics tools( garage) they were all very neet and in professional mechanics tool chests.

    Years ago, I was walking to the home of a friend when I heard the screams of a young child. When I got closer to the screams, I looked and saw that a grown man was viciously spanking a young boy. I approached them and yelled at the man stop. When he stopped to look at me, the child pulled away and ran. I told the guy off for beating the child. Some people would refer to this as discipling a child, but I saw it as abuse of a minor. Any decent human being would have done the same as me, I believe. I always thought that humans innately had a desire to protect children from harm. But I guess I'm giving some people too much credit. If I ever again encountered a similar scenario, I would react in the same way.

    my best friend use to bully younger children on the playground. when I caught her,I told her bullying is wrong and i dont abide. She either had to stop or lose my friendship. She chose my friendship. I was abused as a child and I have always stood up against those who like to harm others. Ive gotten into the middle of drunk men fighting. Idc,I will always step in. No one stepped in for me when I needed it.

    My husband and I listen to these analyses and talk about it as it goes along. In the end Dr. Grande always has such a great summary. My husband said “I don’t know anyone who can talk about a subject with such clarity, lack of personal agenda or bias and just sticks to the facts”.

      Yes! Thank you. My thoughts exactly. Totally different scenario but say he was driving his buddy to the bank, his buddy jokes he is going to rob the place before he goes in. Then the buddy runs back to the car says he just robbed the bank with cash in hand, says lets go. The guy drives off with him and they go about their day driving around like nothing happened. He would be an accessory to the robbery plain and simple. So why not in this case where a little girl is molested and murdered? I really don't get this case and the argument they had no legal reason to charge the guy. It's the first time me hearing of this case and it makes my blood boil. I'm surprised Dr. Grande didn't mention the bill passed was specifically for children under the age of 18 only. So only can someone be obligated to notify if a child is involved and would be punished if they fail to do so when a sexual assault or violent act has taken place against that child.

He did not assist; he was initially oblivious to what was happening and later witnessed a crime in action when he went to find his friend. He then chose not to intervene in any way upon discovery. He did not help his friend nor the girl; he walked away.

      @@LDiamondz I am aware of the legal term and what it means, which is why I replied buddy. The only way Cash was going to be guilty of being an “accessory” is if Strohmeyer had done something like informing Cash *beforehand* that he was about to commit an assault on and murder a child.
      He was legally not guilty of any crime, so I don’t know what you are arguing about. He literally *wasn’t* an accessory 😂 he couldn’t even be expelled from his university because he was legally not guilty of anything.
      The reality is Cash was oblivious to Strohmeyer’s intent to commit an assault that night. And then when he happened to stumble upon Strohmeyer in the act, he was oblivious that Shrohmeyer would follow an assault with murder. He was standing outside the bathroom.
      Cash was functionally (and legally) a bystander who chose to do nothing. I’m not saying that’s the correct thing from a moral standpoint - I think we can both agree it’s not. But *legally* he had that right until laws were changed in Nevada.
      Grade literally explained this in the video. People want to be angry at Cash when in my opinion, that girl’s father should had been charged with some kind of crime if he wasn’t. His negligence was the direct reason she died - not Cash.

    His friend took a little girl who was a stranger to him into the bathroom - that's the point at which you say 'no don't do that, it is inappropriate'. He watched his friend go into the bathroom with the child, went in and observed his friend going into a cubicle with the child and observed that his friend was in there for 25 minutes - all those things would scream 'something is not right' to any normal person. The fact that he did nothing when he must have known something untoward was happening, makes him complicit in the crime IMO.

    The Finnish laws of that nature translated to English is.
    When someone knows another person is in danger that is either life-threatening or has a serious danger to health. And doesn't help or try to get to help that considering his/her possibilities and the situation can reasonably be expected is punished by fine or up to 6 months in prison.
    It is simple when there's very low population density, the one person who sees the accident should act, since without otherwise the help would definitely be late, if it would take hours or even days before next person would actually come to that place.
    In practice, you are not expected to put yourself in real danger nor do anything you don't know how to do. And panicking is a real excuse. However, danger to clothes and a dirtying vehicle is expected from a person if its needed.
    And if the victim was the responsibility of one not trying to rescue him then it's higher punishment scale and a different crime.
    But these laws are something that works in an inquisitorial justice system instead of an adversarial legal system.

      @Bolangerfi It's better than not punishing at all for that crime like in the US. Inquisitorial system isn't about how hard the punishment is but about philosophy about how to get to the truth.
      The hardness of punishment is about rehabilitation vs retribution. Finland definitely has less off, lets do a worse crime trying to hide the original crime than the US.
      And less recidivism.
      I think getting a slap on the wrist is more of a deterrence than getting nothing because rules have been ejected to avoid completely ruining a person's life because normal penalties would be too harsh. And then randomly get completely ruined because you make a slight mistake and the rule doesn't apply to you anymore.

      @Aileen Bremner The problem with that is the adversarial justice system and high legal costs aren't truly compatible with such law that can be applied too easily for anyone. And then we add the two-party system causing tribalism and its effects on prosecutors. It's a completely different model of checks and balances and playing a game of which side wins, in both politics and the legal system. And this would be a too widely applicable weapon in such a system, unfortunately. The system kind of works, but there are plenty of ways it fails and causes havoc but changing a wrong part towards our better system would make it completely dystopian. The right part to start fixing would be actually changing the legislative to a multiparty system and that's not happening because current parties like their power. (Multiseat districts with proportional representation.)

    In my country you have to report accidents and crimes by law. I am unsure what the penalty is for not doing so. Since everyone has smartphones its a pretty easy call. I also believe adults must assist in accidents if it is safe, but I assume they do not punish people who do not as "if safe" is a pretty difficult standard.
    In this story the "bad samaritan" would be found guilty of aiding a criminal.

      @@erdelegy Ah my ears where obviously off as I didn't hear it was an older case. The laws have not changed much but obviously it was harder back then. I doubt very much that "I didn't have a phone on me so I just said nah and kept on walking" would save a person from legal action. Again, I live in a small country. Stories like this are not common and unheard of at this level, we have as many people in our country as America has in a relatively large city.

      @No Way You cant get sued if you react to a crisis, unless your reaction is itself clearly not intended to help victims, of course. Then again, getting sued here is very different than in say the US, since you can only sue for actual damages. What would happen is that the suing person would sue the state, not a person, for damages. You would obviously loose if the person who caused damage to your property did so to save you.
      In other words, first responders, be them official or civilian, are immune to prosecution and lawsuits unless clear violations where done using the accident/crime as a cover. The idea that someone trying to help the community could be punished for doing so it insane and would create a very cold society.

    Several European countries have 'Good Samaritan' laws. These laws provide an obligation to provide reasonable assistance to anyone in immediate need. E.g motor vehicle accidents, trips and falls etc. This is no more than would be expected from any reasonable human being. The sort of assistance you would appreciate yourself.

    I always thought that anyone present during a crime could be charged with "Acting in Concert"
    When I was a kid (15 or 16) a few of my friends were arrested for being passengers in a Stolen Car.
    One of their buddies boosted a car and was out joy riding on a winter day. Being around 15 or 16 years old back in the 70s, every one was good with the idea of getting out of the cold and riding in a car. Nobody bothered to ask where the car came from...Typical operating procedures from back in the day.
    I'm pretty sure that I've heard of people being convicted for being present with a perpetrator during a crime in which someone was killed.
    I honestly thought that not trying to intervene by at least calling the cops( or casino security) would be a crime

      I think you already answered the question in your post. How laws are interpreted and applied often depends on the identity of the accused. When dealing with an "undesirable," the authorities can be quite creative in piling on charges. When dealing with an upper-middle-class white guy, then the authorities are going to be much more worried about constitutional rights and the limits of law enforcement. I'm a bit surprised that no charges were filed after the case got so much attention, but I'm not at all shocked that prosecutors didn't go after him from the start.
      We all know this, even if many want to deny it. That's the real issue with the Rittenhouse case. I think a lot of people believe that if Rittenhouse had been black and defending locals from right wing counter-protesters, he would have been convicted. What is or isn't legal depends on the will of those who enforce the law.

    Disturbing on so many levels. A parent can’t get a hotel room for his kids but can gamble? Arcades are not supposed to be long term baby sitters. The opportunity for the crime began there. The crime occurred and zero empathy for humanity. Disgusting 🤮! So grateful that my kids are raised! What a sick world 🌎 when common sense or any empathy! 🤔❤️🇺🇸

      Not sure why you say that. Most people WILL help you in an emergency: fire, flood, robbery, illness -- I've been in all of those situations, and have had outstanding, compassionate help from strangers.
      It probably depends on their definition of "emergency". If people see an assault, many people have been reared to think "it's not my business."

    When I was in college, I found child "p" on my best friend's laptop. Not photos, but video of acts on kids. It has scarred my mind for 20 years. I didn't report him to police, but I did tell his father over the phone. Never saw him again after that.

    I remember when this happened; I had just graduated college and I was moving into the house I just bought, painting, pulling up old carpet, etc., so the radio was on all the time and I remember hearing about this. It is every bit as reprehensible and disgusting to me now as it was then. I've always known that there are many among us who choose to do nothing when they see these atrocities occur, and likewise, I've also always known that it is ABSOLUTELY INCUMBENT upon people like me to offer assistance, call the police, report these things. I'd just like to think that there are many more people around like myself than there are of selfish, narcissistic psychopaths like David. Truly SICKENING. He should also be sitting in a prison cell!

    I hadn’t heard this case before, so I was going to give David the benefit of the doubt; sometimes people are in shock or try to convince themselves it’s not what they think it is. Then those comments from the interview made it clear that he is an awful person.
    I wonder though if another legal recourse would be civil litigation? Like, wrongful death?

    Very callous. Not in the same kind of situation, but David reminds me of many people I encountered in my daily life during my residency in Maryland for 15 years.
    So sad. Sherrice could’ve been easily saved if David had an ounce of compassion like most people do.

      @No Way I can’t imagine myself being a blink away from my daughter no matter where we are. What her father did - a total neglect, especially in such a large public area - was a criminal act in my eyes. I’m sure he has to leave with the guilt for the rest of his life.
      I was very shocked to hear that a father took a young daughter with him to a casino (even in an arcade), where she was roaming around by herself without being noticed by casino and arcade securities.
      Very sad for the innocent young girl having to be in such a horrifying situation and being murdered…

    It seems to be a fairly common failing, I can think of two or three instances where there were multiple winesses, one of whom was quoted as saying he know the perpetrator was going to kill someone, and was just glad it was not him or his girlfriend. The crimes were reported by people who were told about it by witnesses, not by the witnessess themselves.
    Sometimes it doesn't take much to stop an assault, I once witnessed what I thought was horseplay until the one on the ground was getting kicked in the head, I started to yell, and the ones doing the kicking fled the scene, it occurred to me after that they might just as easily have assaulted me, but I doubt if I would do anything different. I stood guard over an unconcious youth until the ambulance got there, since the security guads in that mall seemed to be of the bad samaritan types. They did not show up until the police arrived.

    I’m a little too humanitarian for most people. I’d rather run myself ragged and suffer without complaining than watch suffering of innocent children and animals. So many people have the “not my problem” mindset. I believe that is largely the entire worlds problem.😞

    I've been a subscriber since 2019, before you started doing crime analysis as much. This video is one of your best. Great synthesis of mental health factors and a real life case scenario. It goes far deeper than what David should have done, and our society should pay attention. Those of us who are aware of the needs of others not only need to pay attention but also need to keep working to set up protective systems. We must not happily stand by and do nothing.

    On the laws, a major contradiction we have, is that when people do act to save or help others they can often end up being sued. Even though they provably saved a life or prevented a major harm, they are sued for a minor or adjacent harm that 'might not' have occurred had they not intervened or waited for professional assistance, whatever the case may be. Now, people are being mandated to act in a way that may invariably drag them into court. Unfortunately, our overly litigious society is what has caused the decrease in people willing to step in, but this case seems more relegated to a particular human psychology that some people are prone. Just some thoughts anyway. Another great video!!

    It seems to me that as soon as he saw the assault happening and neglected to act, he became complicit. 20 seconds of action (pull Jeremy out of the stall, tell her to run) would have changed everything about this story. Jeremy still goes to jail, the girl goes home shaken but safe, and David is a 'hero' and not negatively impacted at all.
    I don't see a need to insert myself in most people's quarrels but when it's someone unable to fend for themselves you should definitely step in and do the right thing.
    Aside from empathy for the victim which would have been plenty of motivation to act, I wouldn't want there to be any chance of me getting dragged into someone else's legal troubles, and I wouldn't want to associate with someone capable of the crime. I'd drag Jeremy to security myself.
    I hope someday David realizes it was easily within his power to save her that day and that it haunts him.

    Very interesting (and infuriating) case. Maybe because I grew up in France, I see duty to rescue laws as obvious and I find it disturbing the US don't have such laws. I can't see either how reporting a crime could present a risk, unless you deal with a corrupt police force. As of 2012, 28 countries had adopted such laws.

    California needs a Duty to Rescue law. I was assaulted by a group of people during a holiday BBQ get together in the backyard of a retired member of law enforcement. No one stepped in to stop it, despite how loud my screams were or the fact that the attack occurred mere feet away from everyone else. Everyone responded by looking in the opposite direction and just ignored my assault.

    Roman law only knew punishments for actions people had carried out. Germanic law saw it as an offense not to render assistance to a person in danger (without endangering the helping person itself). That means: for the lack of a certain activity. Many European nations like Germany and France have "failure to render assistance in cases of emergency" as a crime itself.

      Yes, that's why the paparazzi who took photos of Princess Diana while she was dying were investigated. If they took a picture before summoning for help, they committed a crime, even if they only got there after the accident and had no part in causing it. Non-assistance to a person in danger was often charged when I lived in France, and charges would be reported on the radio. It was taken very seriously.
