I'd say Kirk DID pass the test. Many times. He successfully failed numerous times. He did what every Starfleet captain should do, he didn't give up. He tried EVERYTHING and was not deterred by his failures. He faced that fear and failure again and again and again. I think resolve is also a quality that should be expected in all Starfleet officers. "Cheating" on an unwinnable test after trying more times than anyone else I think is a completely pardonable offense.

I mean , Kirk did not cheat , frankly .He took the needed action to complete his mission .And even if he cheated , it would still be a good solve to the problem .Because believing that impossible situations do not truly exist is a possible quality and the whole test is made to artificially remove any possibility of success .To reject the idea of being consigned to failure , especially when it means the deaths of other , is downright admirable .It would be a bit freightening to imagine a commanding officer who simply admitted defeat because he was told that the situation was unwinable .

I mean, yes, Kirk did cheat, and it is true that a captain would have to work under pressure and handle stress and fear of failure. That being said, my personal opinion is that Spock's test was absolute bull. A captain may run into a no-win situation, but Spock's test dictate that they accept that they have lost, and that everyone under their command would almost certainly perish, whereas a proper commander should be encouraged to reject this premise, to continue to look for any and all solutions to escape this predicament, which is exactly what Kirk did. Now, in a real-world situation, you can't just reprogram more favorable conditions, but out of both approaches, I'd stick with Kirk's since Spock's seems to imply the order would be for all crewmembers to begin writing their obituaries.
Is there any other hint that there were Orions in Starfleet in TOS era? I'm pretty sure they were antagonistic. And I know that there have been members of starfleet from Antagonistic species (Nog, for example) but this feels... off.

I'm more of a Star Wars fan, but I did like these new Star Trek movies with Chris Pine. They had a perfect cast to play the characters. Plus, Zoe Saldana is really sexy in her underwear in this scene.
While Kirk's motivation for joining Starfleet was different as his father was alive when he became Captain, him "cheating" the Kobayashi Maru happened during both timelines. The difference is, he received a commondation for out-of-the-box thinking, not what happened in this movie. (Stated in Star Trek 2: Wrath of Khan)
I am in the military and real world, I would want someone like Spock to be in charge over Kirk, Spock is more logical and rational, Kirk is emotional and believe in the crew and hope. Logical and rational have a stronger chance of surviving a battle then hope.
I didnt like this scene. I would have liked it if it hadnt been a blatant cheat, like enemies would leave their shields down in a fight. Creating a condition that would have seemed plausible and exploiting it, THAT I could see as being accepted, but having the enemy make a mistake they would never make just made the whole thing ridiculous. And to top it off, arguing in front of a tribunal like he legitimately won, just made Kirk look so bad. I loved the casting and music/art direction of the series, but the writing was just horrible. They fumbled the ball big time and ruined what could have been a great reboot.
