    Great video. All very true and accurate except for one thing: you CAN file a trademark application before your brand is in use. You will need to start using it before it gets REGISTERED. But often you want to file an application BEFORE anyone has heard of you. Uber, Stripe, and many huge companies filed their first trademark applications before they even launched. Hope this helps.

      Don't be foolish. You need to do the research too. There is much more than just paying the government fee. You could have an infringer. You may need to do a cease & desist, like I got.

    I cannot say enough how glad I was to research my new name to replace the prior name I had because I got a cease and desist. There was no way I was going to have to change my name again! The new name I thought up was proved by the trademark company, not to be available, so the next name we researched and it was available. Sure it cost more, but when I saw the hundreds of pages of research that was done, we knew we'd be able to keep the name.

    Yes! My brand mean a lot to me more then anything cause I had heart surgery and everything didn't go as planned so I believe and have faith my logo going to have strong meaning to many people

    Great video Adam, but maybe you should've talk a little bit about pricing too? And also about how registering the trademarks work. You can register your name/logo in your own country, in Europe (EUIPO), separately in US (USPTO) or worldwide (WIPO). Now I'm not sure how much it costs in US, but here in Europe it's around 850 euros (and that's just filing for a trademark by yourself!). It's definitely something that has to be done by a trademark lawyer, you don't wanna make a tiny mistake and lose 850 euros...

      Marvo, Establishing a trademark is MUCH MORE than the government filing fee. Your trademark needs to be legally clear too - in sound, appearance and meaning under trademark law. This is called a COMPREHENSIVE SEARCH and takes about 5 hours in the USA and 8 hours for an EUIPO. It includes common law research as well as established trademarks, as first use matters too.     I have a killer band name. The only problem that I seem to be hearing all around is that I can't trademark until I have a product to sell, and at this time the debut release is going to be delayed. I don't want anybody to steal the name, but I guess there's nothing I can do at this point.

      @FTW_666 I didn't use it. I put a bunch of things out under my own name. I played all the instruments myself anyway so there's no band really. But if I ever do a band thing then I will use the name. I don't think it's as difficult as I thought. I think as long as you have a few things out there to sell then I'm sure you can trademark the name. I don't think it has to sell anything it just has to be official and on the market. I say if you've got something going get it out there and use whatever name you want. Just put it out there through CD baby, distrokid, or one of those labels so you can get your stamp on it. You'll be fine. Good luck!

      You need to do the research too. There is much more to this than merely paying the government fee. You could be infringing, with your new name or logo. You need to research each before starting. I had to change my company name and it took 3 years to recover from the $230,000 drop in sales. You bet I did the research on the new name.

I am an artist and I got other artist friends that get less views than me on their songs but when you type their names all their music comes up. When I type in my name it’s hard to find my music like i have to write my artist and songs name to be able to find it. Am I missing a trick or something?

    My brand is super important to me. My name you see here is my musician name. So the conclusion is I continue growing it and then worry about trademark? I also have another name that am building for a clothing line. So that would be 2 trademarks. How do I file for a trademark Worldwide? I think it'd be too much money and effort to try to trademark every country individually.

    Lots of common sense here. The added reality we see - entertainment and clothing are the 2 toughest classes to be legally clear in - based on trademark law whereas similar names do affect your legal use - in sound, appearance or meaning. Here's the link to the USPTO that talks about this need: www.uspto.gov/trademarks/basics/private_attorney.jsp. There is so much commercial activity in these 2 classes - clothing 1st, then entertainment 2nd. So, if legally clear, then keep going and file for the trademark. Clothing can wait for s o m e commercial success. Entertainment is especially essential to get right on the first day - heck before the first day. Otherwise back to the creative.     I outsource my logo from Pakistan, sent it in my name to Washington Copyright Office, then resent it to Washington for copyright transfer in my corporation name. I hired a Trademark Attorney to file with United States Patent & Trademark Office. Currently, awaiting decision, I’ll get both. Faith is the hallmark of the Christian.

    can you do a video on stage names and how they are used. I have been trying to come up with a new stage name because the name that I use is one that would cause confusion with an other artist. I am at a block so I am trying to find vids about how to create a stage name. I tried a generator for stage name and they all gave me the same name top of the list. the problem is it is the name I have used since I was 16 years old Raven. I have hit a road block as to what to use. can you please do a vid on stage names how is the best way to come up with a stage name.

    SO, i'm doing something and the name is highly important to me with the way it's spelled, particularly symbols. There's two variances I do. I plan to launch strictly digitally, specially given the pandemic, and build from there. I can't disclose too much more than that because it's one of those special projects. I feel like I'm saying too much as it is but I overthink things. I'm wondering if, since marketing will be involved, if I should trademark the name I'm doing, both spellings of it, to reassure I don't lose it, specially since someone uses the regular spelling of the stage name I have, even though inactive and across the world from me, nothing similar at all between us other than being artists.     The name of the trademark attorney in Orlando, Florida wasn't in the discussion box. A singer has a stage name but it's not registered or trademarked how to go about which ways to go either copyright or trademark the name?

    My main takeaway from this video is, unless you are making a considerable commercial splash in your field of work, don't bother going through the time and money it's going to take to establish your trademark. If it turns out to be a lucrative business, then it's something you might want to consider. The only question I still have is, if I release an album under the BAND NAME that I want to use, what's going to prevent me from getting sued way more money than I've made or can afford to lose by a potential "other band" who DOES own rights to the name? Also, if they are from another country, can they still sue me over use of the name? Do they have to send a cease and desist letter before they can take action? What do I stand to lose by establishing a fan-base and then have to jerk the rug by changing my brand and my image? I couldn't possibly recoup all those fans I've lost by suddently changing my brand.
