In the exact same industry. Would I be denied for them having the same name even though I used it before them and I have evidence of that? They are 90% of the reason I applied for a uspto trademark

Hey Houdini, great question. You can start the process now using the Intent-to-use basis but your mark will not be registered until you convert the application to use-in-commerce. I'f there is a chance for the name to be changed between now and then, I would wait until it is being used in commerce. Hopefully, that helps.
