In my state the owner in default has 120 days from the notice of default date ( public record) to redeem. If you buy property from the bank you get it with clear title (owner in default cannot redeem after his 120 day redemption period) but if you buy at auction there could be liens on property.
Thanks, but I wonder how this timeline process differs from siblings wanting to foreclose on our inherited property that I'm trying to buy from them. What are are the steps in that process of sibling foreclosure? Right now I am in the threat stage and no paperwork or anything has has come my way. Their was a misunderstanding in the way the contract was written. I feel I did everything I was supposed to, but main sibling feels different and claims he hired an attorney for foreclosure. The probate lawyer who made the contract thinks he has a case, but some important details were left out of the contract like exactly how much of a substantial payment I was supposed to pay to tide them over until I could get the big loan for the rest. Brother won't talk to me about it to let me know exactly what to pay. I feel lawyer should have helped us figure out dollar amount at the last meeting we had. My monthly payments have been made. If I have a few months or longer in the process I might be able to make that balloon payment for the balance. Any information would be greatly appreciated. Thanks!
There is a foreclosed home that has the for sale by owner sign in front here when I live and when I asked if the home was REO ( real estate owned ) the property manager replied " we own the home " I was also informed the house has been vacant for about 2 months now . Would this property be REO ? and would I be able to assign this home if I get it under contract? Or would that depend on the contract before signing?

How do you feel about adding a clause in the assignment contract that states I can renegotiate the purchase price with the original seller and I get the difference as an additional assignment agreement fee and the purchase price will not affect the total due at closing by the assignee?

Hey Jerry are all Bank owned/REO properties the result of no investor buying a foreclosed property at the bid price? in other words can a bank for go an auction and send it straigt to an REO agent ?
@@FlippingMastery Very good, but most of what you described relates to nonjudicial foreclosure states. Here in NY, it's a different process. We are a judicial state. Unfortunately, getting a preforeclosure owner to discuss options is extremely difficult. I do foreclosure defense work (and I'm very good at it). Most homeowners in preforeclosure have gotten bombarded by investors and scammers, and when I come along I am perceived as just another one of those guys. Plus, the govies are always sending preforeclosure notices to beware of scammers. Do you have any ideas on how to address this problem?
Every investor has a set of magic keys. Promise you they're going inside vacant homes and if the home is occupied they are still examining the outside lol
Not sure if this legal, but a old professor of mine told me he would have a home inspector go knock on the door and just ask the person to view the home and pay them cash if they allowed it. It was his work around to never buying a bad property from auctions.

Try to learn house hacking, determine if it’s something that would work for you… you can end up owning a couple real estate properties kinda “easy”.
