He will most likely have the charges dropped. He could have been up to no good but I would wager it's extremely hard to prove he was doing anything for sexual gratification or arousal being he was in a public setting where the expectation of privacy doesn't exist. If your eyes can see it you can also capture it on video or photograph it.
