Hi, I am a recent LTC holder and US Law Shield member and I’ve been struggling with this 30.06 & 30.07 interpretations and I came to your channel to see if I could get better clarification. So my question is, if 30.06 means I can’t conceal carry & 30.07 means I cannot open carry as an LTC holder, does 30.06 mean I can open carry, because I interpret 30.07 as I can conceal carry just not open carry. So let’s say I walk to an establishment that only has 30.06 posted, and I have my firearm concealed, if I tuck my shirt inside the waist band to now display my firearm to open carry, is this legal, since 30.06 says I can’t conceal carry? I’ve yet to get any explanation for this, but this is how I interpret it. I do understand that if places include both signs than you can’t do either so that tells me that if they’re individually posted then my reasoning sounds legitimate.
So if you’re in unlawful possession, either concealed or open, and you use your gun in a self-defense shooting, your self-defense insurance provider will not cover you because you were in unlawful possession at the time you used the gun, regardless of whether the shooting was justified. I don’t have a beef with businesses or SD insurance companies regarding this matter, but I’ll be damned if I give any of my money to any business that makes it unlawful for me to possess my gun inside their establishment.
My question is on the new 30.05 signs that are about to come out. Currently if a government building that is not statutorily prohibited from carrying a gun posts a 30.06 sign it can be legally ignored by the license holder. Will the same be true if a government building posts a 30.05 sign?
@@grumpyguys4082 unfortunately while that was the intent of the sign, that is not how the law was written. The law says if any person passes one of those signs with a gun they are guilty of trespassing. It further on puts that having a license to carry is a defense to prosecution. That does not prevent you from getting arrested, that just means you will win in court. I am trying to figure out how to avoid being arrested, especially since I teach LTC classes I'm sure that in time cops will start to realize that people who have a license aren't getting convicted and most of the time the charges are getting dropped entirely, therefore does not worth arresting someone for. Until then though, I am trying to figure out how to avoid being arrested.
@@grumpyguys4082 I will also put out there that if he's like most instructors he probably told you that the general signs that prohibit firearms on these premises, or a picture of a gun with a circle around it and line through it or things to that effect are not enforceable. That is true under 30.06 or 30.07, but under 30.05 until the courts determine otherwise, they can be interpreted as being legally enforceable signs. The reason I say that is because 30.05 gives a wording that is similar to 30.06 or 30.07 but it says the property owner must post signs with that wording, or " a substantially similar" sign. Until the courts weigh in it can be argued that a no guns sign communicates the same message and therefore is similar.
@Grumpy Guys I will also say you should search RUclips for :30 .05 there are a couple gun channels that agree with my interpretation. I will say though that I agree with your instructor that the intent of the law is to prohibit unlicensed carry of firearms, that is not the way it got worded though. I don't know about you, but I wouldn't want to be the test case.

I'm not sure if it's something that he created himself or got from another gun organization, but I guarantee was not created and issued by the state of Texas. Other than the test itself, instructors don't get issued anything that we are to give the students.

Also Point Blank C.H.L has a couple of videos called "Constitutional carry sucks" part 1 and 2 cover our conversation. Supposedly 30.05 was changed but ??? Hope this helps.
Question if the area (gym) Lifetime fitness building has a just a sign that says no guns allowed in this building , but with no 30.06 or 30.07 sign can I still walk in peacefully with my concealed?
I know this was asked a year ago, but maybe someone else has this question. I am no lawyer, having said this, in my CCW class we addressed this. Even if they have it posted but it doesn't match the requirements then it is an invalid sign. Invalid signs are not legal signs. Technically, this means that they did not post it properly and no one has physically asked you to leave. So technically, the sign at that establishment is not legal. Having said this, on technicality you are correct that you can just stroll in there. However, a cop could come out, you could be arrested and face legal fees in court. Then you have to turn around and try to convince a judge that it was OK for you to do this. Is this really the path that you want to take? Chances are, the judge will side with the establishment because it is private property and they did make their wishes known, even if the sign was not technically legal. All of this mounting up to one point, is it really worth it? You may or may not loose this one. The best advice, work out from home...or go to a different gym that does not care if you carry.

My job displays 30.07 (not allowing open carry) only, so you can technically cc but that's pertaining to the public. As an employee who cannot carry openly or concealed while in uniform or on the clock (and in order to be on property for myself anyway you basicly have to be in uniform) is that legal? Allowing public to conceal carry but not certain employees. Again I only say certain because I'm a member of maintenance.
Brian Guzman your employer gets to set rules, boundaries, and limitations. So if your employer upon hiring you gave a document or hand book specifying rules like no weapons allowed on the premise that means you can't carry. Regardless if you're licensed or not an employer has the right to tell you that you can't carry even if they say patrons can carry.
I visited a hospital in San Antonio. The had both signs posted, but in the foyer of a parking garage and the both were obstructed by trash cans. Would this be a defense to prosecution ?

Learn the law in the great State of Texas, take the License to Carry course instead of relying on internet searches of randomly gathered information. Skip searching for a class offered only on the weekends or at night, take the classroom portion online at www.bcsgunclass.thinkific.com. You can take it on your phone, tablet, or laptop. State certified an approved shortest class allowed by law (4hrs), cheapest ($40), and the easiest (watch videos).
What about long guns? I know there’s no law against concealment or open carry of a long gun, but do these signs ALSO pertain to long guns, even though it is unstated?
IraMcCLoL Correct. They can still ask you to leave but you’re not breaking any law if they don’t have a 30.06 AND 30.07 sign posted. Just leave if they ask.
But has to be in a belt holster or shoulder holster... Not a pocket holster or a gun case, or in a purse. as law biding citizens they make it hard on us...smh

The law says the sign must be printed in contrasting colors. Putting vinyl letters on glass is not even an actual sign, and unless the glass is black and the lettering white, it isn't contrasting colors. The truth is, no one is being arrested for carrying past signs. The worst thing that has happened is the cops come and ask you to leave. Carry everywhere. If it's concealed, no one will know.
what if you for whatever reason had your weapon on you and you ran into the store really quickly and forgot to take it off and a robbery happens while one may be inside the establishment?
robersonjason83 your not supposed to have a firearm period. I mean legally of course however you do what ever you have to do and feel is morally right in that situation.
