If you have to pass through a state, county, etc. that has restrictive gun laws fuel up before you cross into that state or county. Don't stop and spend or buy any thing that would support their economy
I am a Law Abiding Firearms Owner in the State of South Australia and have been Licensed here for over 35 Years (pre the Ban on semiautomatic Rifles being Owned by City Slickers such as Myself). Under South Australian Firearms Law, I am Required to drive directly from My Home to My Gun Range or Firearms Club or Hunting Ground or such like, Without Detour or Delay. Even the simple act of stopping for Fuel or to get Myself a Drink on a Hot Australian Summer’s Day could get Me into serious trouble, about transporting My Firearms. Thus such Weapons Transportation is Planned and well thought out before it happens and local communities and businesses en route miss out completely from any kind of support I might otherwise have given them. In this way My Weapons and Ammunition remain completely under My Control at All Times and are never left alone, even secured in a locked car. On such journeys I can not even transport an Unlicensed Passenger with Me because of the legal difficulties doing so might cause for Me or My Passenger, if I were stopped by Police for any reason.

transporting a firearm by vehicle through New York state can be risky if you do not have a New York firearms license. We rely on the federal Firearm Owners Protection Act (FOPA) to protect us on interstate travel. But there have been cases where the New York Police have arrested persons who had fully complied with the law, the police simply ignored the federal law. The New York State Police and the New York police Department do not recognize the FOPA and will arrest travelers passing through the state even if they have complied with the law. They will leave it up to the courts to sort out. This means you could end up in a jail cell for a few days waiting for the courts to release you. So how can we avoid that? You could try taking a copy of the FOPA, (Title 18, Part 1, Chapter 44 926A) with you to show any officers if you were stopped. But in my opinion they would be to busy to read it or not even understand the law if they did read it, after all they are not lawyers. @@HGAviator That’s tricky. As a general rule, no. One known exception is Illinois. If you have a CCW in your home state but NOT in Illinois, you CAN transport a loaded firearm in a vehicle BUT you can under NO circumstances take that firearm out of the vehicle. That’s the only one I know of. Other than that, it’s best to lock it up properly and store it. It’s ridiculous.

My understanding is that one's car is considered as the same as their home in some legal instances, I think having to do with search warrents. I live in Indiana and travel out west every year. When we go through Illinois, we make sure our gas tank is full and never stay in a hotel there. Just keep moving.

Even if you are an employed policeman/woman and traveling through New Jersey off duty. There are cases of them being arrested for carrying their service weapon for protection. That's messed up. I just won't go to such states and it seems they have very high crime rates in their cities as well.

If I travel in my motorhome, it is my home. I will do whatever it takes to protect my family and myself however I see fit. You can be perfectly legal, drive 100 feet and cross an imaginary line, and now you are a felon. It shouldn't be this way in America. Several years ago, I visited family in the Northeast. I really had to think through this issue. If caught in one of the communist states with a weapon that was legal in my home state, I could have been arrested and charged, which would have most likely cost me my CPA license and my job. I would have then been forced to spend thousands and thousands of dollars in legal fees, all of which would have devastated my family financially. I basically had to decide what took priority, my family's safety or my family's finances. Safety won out, but I was nervous as heck going through those communist states.

Criminals will disregard all of the above, and IF arrested, and IF prosecuted, can be rehabilitated by our outstanding correctional facilities throughout the country, all of which have impeccable track records for accomplishing this task. Law abiding citizens carrying firearms can rehabilitate the criminals at the scene of the crime.
Constitution doesn't state what type of person can have a gun and what type can't. Law abiding or not you have the right to bear arms until you commit a crime with one.
My brother was moving from NY to GA and was stopped and they asked him can they search his car. He said that he would prefer to get back on the road as soon as possible. They told him they were going to search it anyway. They got a canine unit and had his vehicle emptied and searched and they left him and all of his stuff on the side of the road. He was not ticketed for anything, even though he didn't do anything illegal.
@@Baman21 Some cops will search regardless of having any suspicion or permission. They'll make something up and harass you until you give them something to work with. And when the K9 comes along and "gets a hit" try to get video if you can. Some dogs will fake a hit when the handler says a specific word or makes a specific move. There was a story recently about a dog that retired with 100% hit rate. Every. Single. Time it was brought out, it got a hit. The dog had learned that when it got a hit, it was given a treat. Therefore it would fake hits because it wanted treats. I'd like to think that was just poor training, but it's possible the handler wanted *exactly* that behavior in order to get a high hit ratio. I hope it backfired in the end. If the dog gets a hit and absolutely nothing is found, that ought to count against the dog's credibility.
They just keep compounding these laws to the point that an officer will have the book and just thumb through until he figures out what law you’ve just violated. Next, our firearms are like insurance. You have it in the event that you need it. While your trying to figure out how to unlock these two cases, you may be watching a violent criminal take from you. The interesting part of the 2A for me is the "well regulated" line, which given the context of the militia acts of the following year, seems to imply that able-bodied citizens would be incorporated into an official chain of command that would be under the jurisdiction of its CO and ultimately the state. Nothing I've found seems to back any interpretation of a "well regulated Militia" to mean unorganized militias of private citizens to protect their own interests, either with or against the government. The intent seems to be to create a fighting force to protect the state and federal government's interests and national security if needed, to be deployed and commanded by said state and federal governments and their officers. Although the issue of state vs federal control wasn't clearly defined and subsequently contested in later conflicts. In any event, these legislations were ultimately superseded with the Militia Act of 1903, which created the United States National Guard. The national guard seems to fall under the definition of "well regulated militia," as it is comprised of ordinary citizens who are enrolled by a captain or CO. Given that enrollment into said regulated militia is now voluntary rather than compulsory, and given that in the time period of the 2A enrollment was compulsory for all citizens, does the 2A still cover free citizens who have not enrolled in militia (e.g. national guard) duties and thus are not "well regulated"?

And weapons were critical to one's God given right to self defence, which falls under the umbrella of the 10 amendments which are there to ensure the government can not usurp those God given rights, then we can be assured we still have the unhindered right to be as well armed as any military both for self defense and to defend our country. There has been no amendment changing the second amendment no matter what laws may have changed the definition of the militia. Also context is important, if we think of who the founding fathers were--wealthy merchants and land owners. They explicitly did not want a direct democracy, because they did not want the common man rising to power as that would threaten their wealth and status. Governments exist to protect the interests of those in power, aka the wealthy elites. Given the time period in which the article was written and given who the people writing it were it seems more likely that the founding fathers were more concerned with being able to source a fighting force to protect their own assets, rather than secure rights of the common man. People do things that are in their own best interest, that's simple human nature. And the people who are in power to make the rules are, always have been, and always will be the upper class. I'm not really making a judgement on whether that is good or bad, it's just the basic reality in which we live. Also people make it seem like the individual rights interpretation of the 2A is some obvious thing but it's been debated in courts for a hundred years. Moreover, the individual right to bear arms interpretation has only existed since 2008--with the District of Columbia v. Heller ruling. Prior to that it was entirely constitutional for states to ban firearms. Moreover it passed with a 5-4 ruling. If literally 1 of those votes fell a different way, carbines would probably be illegal in most democratic states right now, and it would be entirely constitutional.
I am a single female over 55 with arthritis and other chronic pain issues. The reason I have a firearm and a CCW in my state of Pennsylvania, is for self defense and protection of myself and my son with special needs. We travel mostly in our home state, but sometimes venture over state lines of adjoining states. All of our travels are "touristy". Traveling with it locked away and unloaded defeats the definition of self defense! It appears the laws are not made to protect me and mine. But rather charge me with a crime. I guess they'd rather feel bad if we're murdered, and spend money and time searching for our killers!!!! Not having constitutional carry is ludicrous!!!!!!!!!!!!!

If you travel through NY or NJ and stop , or are stopped for a traffic violation , and you are dumb enough to say you are transporting a firearm, or the container is seen, expect to be arrested. @@rcre7052 good comment. This begs the question, how is someone from northern New England supposed to visit any other part of the country, with a gun. I'm from New Hampshire, nothing is illegal here. But I absolutely have to drive though MA, CT, RI NY and/or NJ to visit any other state in the union. I frequently go to the midwest, that requires going through MA, NY and NJ based on the route I take. My main carry gun is a Glock, that doesn't have 2 safteys so isn't legal in MA. My mags are more than 10 rounds, so not legal in NY or NJ either. How am I supposed to go other places if I can't bring any of my guns through the states I HAVE to drive through? If there was a route I could take to avoid those states I would take it, but the only other route goes through Canada, and I sure can't take that one. But I also don't go anywhere without my carry gun, and at least an AR15.

I have CCW in PA. I live two miles from MD and work there. I have family just over the border of MD in WV. I can go through three states in 15 minutes. I am covered in PA and WV but to drive 10 minutes through restrictive MD I have to go through all the crap. I ride a motorcycle and it is a pain in the butt to carry a lock box and such.

The laws make it useless for a person to carry a firearm especially in California. You have to balance the risk of being able to defend yourself against the risk of having to defend yourself against illegal laws.

You can legally send guns from yourself to yourself with no FFL. For instance, a local competitor here in NM ships her guns to her hotel in OH, competes, then sends the guns back to her home.
here’s a legal loophole: put the gun in a sealed box that’s clearly addressed to you and ONLY you. unless the cops have enough probable cause (like they saw you running from a crime scene wearing a ski mask type of probable cause) they are legally restricted from searching that box without your consent. if they do, it won’t take a great, expensive lawyer and months of fighting in court to dodge a felony. it MIGHT take a night at the local jail, and some cheap, half decent lawyer you bought off facebook marketplace to beat the case. you could also sue the local pd, or if you’re feeling lucky, the entire state and make some money off of it. just be careful if you do this in New Jersey, New York, or california. they’ll do anything, regardless of whether or not they legally can, to slap you with a felony gun charge. from my time living in jersey, the cops are pretty chill, so i won’t worry about them breaking the law. but cali or ny on the other hand... yeah good luck lmao
Good information. I took a class at Sportsmans Warehouse to obtain concealed carry from Arizona and Utah as I drive from Oregon to Texas a couple of times a year. I bought your book "Legal Heat" and always travel with it. Such a pain driving through California. Everything locked in a case in the back of my 4RNR. Try to avoid driving through there when possible.
You could be perfectly legal but if you are stopped and they know you have guns they can still take them. You know to determine if the are legal firearms. After s year or so they might get back to you to tell you yeah those guns were legal but as the policy of this department they will be destroyed.

You can't LEGALLY bring anything NY defines as a "firearm" (handgun aside from FOPA, SBR, SBS, AOW, or other NFA stuff), an "assault weapon" as defined by the law, or high capacity (read standard capacity.... Anything over 10 rounds) magazine. You CAN transport a handgun in accordance with federal law, but the mags have to be low capacity. Rifle or shotgun is fine as long as it doesn't meet the criteria for an assault weapon under state law. It's all a bunch of convoluted nonsense, but I want to make sure people are as informed as possible. Take all of that with a grain of salt though, as I'm most definitely not a lawyer lol.
He needed to also talk about the ammunition. NJ doesn’t allow hollow points, Green Tips, etc. you get a year for each round. Allegedly. So, I’d check what ammo is banned when passing through several states too.

Best thing to do, follow the speed limit, make sure you have a full tank of fuel before going into said state, and if stopped by a cop, refuse any search and answer zero questions not pertaining to the actual stop.

I would spend upward of 20K to 25K a year supporting local businesses in the pursuit as an avid sporting clays enthusiast too attend Sat or Sunday Tournaments. Haven't shot in a tournament in the north east since 2015.

I am a Law Abiding Firearms Owner in the State of South Australia and have been Licensed here for over 35 Years (pre the Ban on semiautomatic Rifles being Owned by City Slickers such as Myself).
Under South Australian Firearms Law, I am Required to drive directly from My Home to My Gun Range or Firearms Club or Hunting Ground or such like, Without Detour or Delay.
Even the simple act of stopping for Fuel or to get Myself a Drink on a Hot Australian Summer’s Day could get Me into serious trouble, about transporting My Firearms.
Thus such Weapons Transportation is Planned and well thought out before it happens and local communities and businesses en route miss out completely from any kind of support I might otherwise have given them.
In this way My Weapons and Ammunition remain completely under My Control at All Times and are never left alone, even secured in a locked car.
On such journeys I can not even transport an Unlicensed Passenger with Me because of the legal difficulties doing so might cause for Me or My Passenger, if I were stopped by Police for any reason.

transporting a firearm by vehicle through New York state can be risky if you do not have a New York firearms license. We rely on the federal Firearm Owners Protection Act (FOPA) to protect us on interstate travel. But there have been cases where the New York Police have arrested persons who had fully complied with the law, the police simply ignored the federal law. The New York State Police and the New York police Department do not recognize the FOPA and will arrest travelers passing through the state even if they have complied with the law. They will leave it up to the courts to sort out. This means you could end up in a jail cell for a few days waiting for the courts to release you.
So how can we avoid that? You could try taking a copy of the FOPA, (Title 18, Part 1, Chapter 44 926A) with you to show any officers if you were stopped. But in my opinion they would be to busy to read it or not even understand the law if they did read it, after all they are not lawyers. And if they have been instructed to ignore the FOPA then no amount of debate with them will help you.

If you have a CCW in your home state but NOT in Illinois, you CAN transport a loaded firearm in a vehicle BUT you can under NO circumstances take that firearm out of the vehicle.

Even if you are an employed policeman/woman and traveling through New Jersey off duty. There are cases of them being arrested for carrying their service weapon for protection. That's messed up. I just won't go to such states and it seems they have very high crime rates in their cities as well.

If I travel in my motorhome, it is my home. I will do whatever it takes to protect my family and myself however I see fit. I really had to think through this issue. If caught in one of the communist states with a weapon that was legal in my home state, I could have been arrested and charged, which would have most likely cost me my CPA license and my job. I would have then been forced to spend thousands and thousands of dollars in legal fees, all of which would have devastated my family financially.
I basically had to decide what took priority, my family's safety or my family's finances. Safety won out, but I was nervous as heck going through those communist states.

I've talked about this with several police officers and highway patrol..if you don't bring it up they won't bring it up!
My brother was moving from NY to GA and was stopped and they asked him can they search his car. He said that he would prefer to get back on the road as soon as possible. They told him they were going to search it anyway. They got a canine unit and had his vehicle emptied and searched and they left him and all of his stuff on the side of the road. He was not ticketed for anything, even though he didn't do anything illegal.

And when the K9 comes along and "gets a hit" try to get video if you can. Some dogs will fake a hit when the handler says a specific word or makes a specific move.
There was a story recently about a dog that retired with 100% hit rate. Every. Single. Time it was brought out, it got a hit. The dog had learned that when it got a hit, it was given a treat. Therefore it would fake hits because it wanted treats. I'd like to think that was just poor training, but it's possible the handler wanted *exactly* that behavior in order to get a high hit ratio. I hope it backfired in the end. If the dog gets a hit and absolutely nothing is found, that ought to count against the dog's credibility.

The interesting part of the 2A for me is the "well regulated" line, which given the context of the militia acts of the following year, seems to imply that able-bodied citizens would be incorporated into an official chain of command that would be under the jurisdiction of its CO and ultimately the state.
Nothing I've found seems to back any interpretation of a "well regulated Militia" to mean unorganized militias of private citizens to protect their own interests, either with or against the government. The intent seems to be to create a fighting force to protect the state and federal government's interests and national security if needed, to be deployed and commanded by said state and federal governments and their officers. Although the issue of state vs federal control wasn't clearly defined and subsequently contested in later conflicts.
In any event, these legislations were ultimately superseded with the Militia Act of 1903, which created the United States National Guard. The national guard seems to fall under the definition of "well regulated militia," as it is comprised of ordinary citizens who are enrolled by a captain or CO.
Given that enrollment into said regulated militia is now voluntary rather than compulsory, and given that in the time period of the 2A enrollment was compulsory for all citizens, does the 2A still cover free citizens who have not enrolled in militia (e.g. national guard) duties and thus are not "well regulated"?

And weapons were critical to one's God given right to self defence, which falls under the umbrella of the 10 amendments which are there to ensure the government can not usurp those God given rights, then we can be assured we still have the unhindered right to be as well armed as any military both for self defense and to defend our country. There has been no amendment changing the second amendment no matter what laws may have changed the definition of the militia. You for things completely backwards. Having a gun is like having roads for cars. Cars aren’t required for roads to exist. Roads are required so that cars can be used. You wrote so much, and yet you wrote so little. Maybe read what the founders said. And remember that it wasn’t a militia that defeated the British. It was everyone in the country.
@@jamesbizs The 2A literally starts with "A well regulated militia, being necessary to the security of a free State." I don't see how you can just completely ignore that part of it when interpreting the intent of the amendment.
Also context is important, if we think of who the founding fathers were--wealthy merchants and land owners. There's a reason we have the electoral college and why they were so worried about "tyranny of the majority." They explicitly did not want a direct democracy, because they did not want the common man rising to power as that would threaten their wealth and status.
Governments exist to protect the interests of those in power, aka the wealthy elites. Given the time period in which the article was written and given who the people writing it were it seems more likely that the founding fathers were more concerned with being able to source a fighting force to protect their own assets, rather than secure rights of the common man.
People do things that are in their own best interest, that's simple human nature. And the people who are in power to make the rules are, always have been, and always will be the upper class. I'm not really making a judgement on whether that is good or bad, it's just the basic reality in which we live.
Also people make it seem like the individual rights interpretation of the 2A is some obvious thing but it's been debated in courts for a hundred years. Moreover, the individual right to bear arms interpretation has only existed since 2008--with the District of Columbia v. Heller ruling. Prior to that it was entirely constitutional for states to ban firearms. Moreover it passed with a 5-4 ruling. If literally 1 of those votes fell a different way, carbines would probably be illegal in most democratic states right now, and it would be entirely constitutional.
I am a single female over 55 with arthritis and other chronic pain issues. The reason I have a firearm and a CCW in my state of Pennsylvania, is for self defense and protection of myself and my son with special needs. We travel mostly in our home state, but sometimes venture over state lines of adjoining states. All of our travels are "touristy". Traveling with it locked away and unloaded defeats the definition of self defense! It appears the laws are not made to protect me and mine. But rather charge me with a crime. I guess they'd rather feel bad if we're murdered, and spend money and time searching for our killers!!!! Not having constitutional carry is ludicrous!!!!!!!!!!!!!

If you travel through NY or NJ and stop , or are stopped for a traffic violation , and you are dumb enough to say you are transporting a firearm, or the container is seen, expect to be arrested. If you are dumb enough to travel through NJ and they find a single round of hollowpoints ammunition, you will be arrested. Travel at your own risk.
And this is why I have always passed on any opportunity to go to California, New York and New Jersey.

If you are truly a lawyer, why are you not familiar with the 2nd amendment? Having and Bearing a firearm is not "transporting" it. The second amendment has not deferred any authority to state or federal entities. That "right" belongs to the sovereign individual.

This should not be a problem. I have the privilege to drive anywhere in the US. But my right to bear arms does not cross state lines. Something is wrong with that.

transporting a firearm by vehicle through New York state can be risky if you do not have a New York firearms license. We rely on the federal Firearm Owners Protection Act (FOPA) to protect us on interstate travel. But there have been cases where the New York Police have arrested persons who had fully complied with the law, the police simply ignored the federal law. The New York State Police and the New York police Department do not recognize the FOPA and will arrest travelers passing through the state even if they have complied with the law. They will leave it up to the courts to sort out. This means you could end up in a jail cell for a few days waiting for the courts to release you.
So how can we avoid that? You could try taking a copy of the FOPA, (Title 18, Part 1, Chapter 44 926A) with you to show any officers if you were stopped. But in my opinion they would be to busy to read it or not even understand the law if they did read it, after all they are not lawyers. And if they have been instructed to ignore the FOPA then no amount of debate with them will help you.
@@rcre7052 good comment. This begs the question, how is someone from northern New England supposed to visit any other part of the country, with a gun. I'm from New Hampshire, nothing is illegal here. But I absolutely have to drive though MA, CT, RI NY and/or NJ to visit any other state in the union. I frequently go to the midwest, that requires going through MA, NY and NJ based on the route I take. My main carry gun is a Glock, that doesn't have 2 safteys so isn't legal in MA. My mags are more than 10 rounds, so not legal in NY or NJ either. How am I supposed to go other places if I can't bring any of my guns through the states I HAVE to drive through? If there was a route I could take to avoid those states I would take it, but the only other route goes through Canada, and I sure can't take that one. But I also don't go anywhere without my carry gun, and at least an AR15.
To add to this, NY and NJ will not issue FOID to non-residents, so wtf am I to do? They leave no legal options.

I have CCW in PA. I live two miles from MD and work there. I have family just over the border of MD in WV. I can go through three states in 15 minutes. I am covered in PA and WV but to drive 10 minutes through restrictive MD I have to go through all the crap. I ride a motorcycle and it is a pain in the butt to carry a lock box and such.
There should be NO LAW against firearms in any fashion. The 2nd amendment overrules ALL LAWS. ALL LAWS!!!!!!!!!!!!

If I were moving from Indiana to New Hampshire and have no option geographically but to transit through New York, How could I legally get an AR-15 and or high cap magazines to New Hampshire? Would I need to ship them via FedEX (for the mags) and do a dealer to dealer transfer to myself?
You can legally send guns from yourself to yourself with no FFL. For instance, a local competitor here in NM ships her guns to her hotel in OH, competes, then sends the guns back to her home.

here’s a legal loophole: put the gun in a sealed box that’s clearly addressed to you and ONLY you. unless the cops have enough probable cause (like they saw you running from a crime scene wearing a ski mask type of probable cause) they are legally restricted from searching that box without your consent. if they do, it won’t take a great, expensive lawyer and months of fighting in court to dodge a felony.
it MIGHT take a night at the local jail, and some cheap, half decent lawyer you bought off facebook marketplace to beat the case. you could also sue the local pd, or if you’re feeling lucky, the entire state and make some money off of it.
just be careful if you do this in New Jersey, New York, or california. they’ll do anything, regardless of whether or not they legally can, to slap you with a felony gun charge. from my time living in jersey, the cops are pretty chill, so i won’t worry about them breaking the law.

Good information. I took a class at Sportsmans Warehouse to obtain concealed carry from Arizona and Utah as I drive from Oregon to Texas a couple of times a year. I bought your book "Legal Heat" and always travel with it. Such a pain driving through California. Everything locked in a case in the back of my 4RNR. Try to avoid driving through there when possible.

You could be perfectly legal but if you are stopped and they know you have guns they can still take them. You know to determine if the are legal firearms. I had already researched this but its good to get validation. This is why I avoid NY, NJ, and CA like the plague. I didn't even think about boating. How on earth did you get stopped while boating? What did he do to even get stopped and searched. I would like to see details on that case.

It depends. I believe in New York, you can't even have guns parts on you. They consider just a part an entire firearm. You can't enter the state with any gun parts.

@@jhutch1470 That's definitely not the case. I live in NY (stuck here due to family) so I'm pretty well versed in the law. You can absolutely transport guns and gun parts into New York. You can't LEGALLY bring anything NY defines as a "firearm" (handgun aside from FOPA, SBR, SBS, AOW, or other NFA stuff), an "assault weapon" as defined by the law, or high capacity (read standard capacity.... Anything over 10 rounds) magazine. You CAN transport a handgun in accordance with federal law, but the mags have to be low capacity. Rifle or shotgun is fine as long as it doesn't meet the criteria for an assault weapon under state law. It's all a bunch of convoluted nonsense, but I want to make sure people are as informed as possible. Take all of that with a grain of salt though, as I'm most definitely not a lawyer lol.
So, lesson learned: don't cross state lines.
He needed to also talk about the ammunition. NJ doesn’t allow hollow points, Green Tips, etc. you get a year for each round. Allegedly. So, I’d check what ammo is banned when passing through several states too.

Best thing to do, follow the speed limit, make sure you have a full tank of fuel before going into said state, and if stopped by a cop, refuse any search and answer zero questions not pertaining to the actual stop.

WRONG. even if FOPA covers you & you & 100% compliant that will not stop Leo or DA from Charging you. lkeep firearms locked in their cases, maybe disassembled, lock with pad locks & cable wrapped cases through the frame of the trunk. If you glove box when lock with a key acts as a valet lock for the truck lock it.. Keep license registration insurance at the ready have it out before the leo approaches your window. New Jersey maintains you have to prove you own your firearms, carry copy of receipt. I use to shoot sporting clays M&M , &Cedar Hills NJ, & Sedona, Orvis in New York. other places in NY. I would spend upward of 20K to 25K a year supporting local businesses in the pursuit as an avid sporting clays enthusiast too attend Sat or Sunday Tournaments. Haven't shot in a tournament in the north east since 2015.
