    I took the CHL test yesterday and the cop instructor said you cant shoot them if their fleeing with your property. "your property isnt worth someones life". your going to jail if you do.

      John D III I've heard this too. It's good advice, although not necessarily legal advice. One thing to always remember is that CHL instructors are typically not lawyers. My instructor told me similar advice. He said exactly what was said in this video, with the caveat that he would never shoot someone for his property, only for defense of your life.

      Also, since you took the class 3 months ago and not 2 years ago, it was a LTC instructor, as CHL's are no longer being issued, due to the legality of open carry of handguns in 2015.

    Don't shoot a tresspasser upon returning home and finding them? but shoot someone who comes into the structure while I am inside? does fear for life apply at all?

    Some years ago a neighbor two streets away shot a burglar fleeing with his TV. The criminal died. Neighbor was no-billed by a grand jury. It was all reported in the Dallas Morning News.

    Most important, make sure you're legal. Take a License to Carry course. Now you can skip searching for a class offered only on the weekends or at night and take the classroom portion online instead at @t. You can take it on your phone, tablet, or laptop. State certified an approved shortest class allowed by law (4hrs), cheapest ($40), and the easiest (watch videos).

    Sooo many grey areas. Should I, could I, maybe's its all pretty frustrating. I believe the only way to save ones own arse is to hold the squeeze unless immediate life is threatened. If he is fleeing...become 'Frozen' and "let it go"

    so when you say running away with your property you can shoot them. do you mean shooting them from my property or can it be like lets say someone breaks in and steals something important and theyre running and i chase after them and shoot them on the street NOT on my property but on the street can i still get in trouble for that?

    If someone steals your property and you see him running with it just take aim and shoot him.
    He shouldn't be on your property in the first place. He is guilty because he is running away.
    Make sure you kill him as the dead can't testify against you.
    If you get enough bodies piled up the rest of the burgles will get the information or they will be part of the pile.

    It all comes down to the family. There are no fathers teaching their children from right or wrong. They probably are doing drugs are in jail again.

      But it is just a thing, things can be replaced, human life can not. We carry homeowners insurance for just this reason, do not get me wrong if I caught him he will get a beating and go to jail, but killing, in my opinion, is extreme but hey you do you

    Let's say you live in a rural area and police are 45 minutes away and a group of teens show up in a Uhaul and bust through your front door and proceed to empty your house can you shoot them after they refuse to stop after a warning? In my State no I think you are required to help them load the truck and give them warranties and user manuals for all Eletronics.

      That happened to me once, helped the intruder carry all my things out to his van before joining my son on the couch with some ropes and handkerchiefs. Luckily he wasn't armed so it wasn't too bad.

    Are the laws same if you live in an apartment complex? I keep trying to find out but no luck everything i find is about people who own properties i just live in an apartment with crazy unstable neighbors i really need to know. And i do legally own a firearm.

    Don't shoot someone over a tv or something people. A good rule of thumb is if you have to think should I, or can i shoot, then don't do it. There should be no time you take a life, unless it is to save yours or someone else's. That or seriously bad injury. Maybe if someone had broken into your house and you had reason to believe they meant you harm.

      Texas, California, Florida, New York, it doesn't fucking matter. Fuck the law. If I find anybody coming into my home, ESPECIALLY at night, then your ass getting shot. Rather i'm single or have a family. If I get a murder case, then FUCK them. I'll take my murder case & do my time without any regrets. It beats being dead. Its either me or them, & Idk about you guys, but I like living. So the way I see it,at the end of the day when push comes to shove, the laws don't mean shit. We all have to look after ourselves or our own. I'm not going to rely on hope that the police get there in time before i'm dead. Shoot that mother fucker Dragon Slayer.

    What? For a $500.00-$2000.00 worth of property? You shoot the perp, while he's running away from you. He drops said proprty, TV perhaps, property just got broken in the process, the perp dies, now the game levels up to more than recovered property. Was perp armed or unarmed? The lady in the video did not specify that.

    The reality is you may or may not go to jail if you shoot someone who is not a threat to you (because they are fleeing with your property, and already out the door). If you are lucky enough to not go to jail, you will then have a civil suit for wrongful death. Even if you win that, which is somewhat doubtful, you are looking at 2 years of your life ruined by this. Is that property really worth all that life trauma?? The tone of this video is way too nonchalant.

    Well presented, especially the part concerning the concept of reasonability that threads its way throughout our legal system. Personally, nothing I own is worth killing someone over unless the thief is a direct threat to me or someone else. If someone breaks into my house and I'm in it, I'd opt for barricading myself in a room if possible and calling 911. If the intruder insists on entering the room I or my loved ones occupy, then they're going to get shot. Why do this? It lessens the chance you might kill a neighbor, friend or family member by mistake and also marks your location in the house so the police don't mistakenly shoot you instead of the bad guy. Why anyone would want to get into a gun battle with a burglar over a tv or any other material object just seems foolish.

      It’s not a question of value. It’s a question of allowing someone who does not respect me or my property & is willing to risk being killed. As soon as they break in to my house I will not give them an opportunity to show me just how much they don’t respect me by showing them how I treat criminals who threaten me & my loved ones. You get no 2 nd chance. They should have paid more attention to reality in a civil society if they want to keep living

    I saw that there was a shooter in a supermarket killing people. This just happen in Colorado. Now if you are carrying can you shoot the shooter to save lives? If so will you go to jail for shooting the shooter?

    No property is worth even a burglar's life. If a burglar is fleeing, without an apparent deadly weapon, there is no threat of harm; while it may be legal, it would not be moral to use deadly force. Legal - yes, moral - no. If you have doubt before you pull the trigger, then do not shoot.

      The way I understand the Texas law is in the day time you can not use deadly force on a burglar but at night you can. So yes at 4am your justified because in the darkness you can not access just how much force is necessary but in the day light you could easily see if a person was armed with a weapon.

    Shooting anyone as they flee is the same as shooting them in the back. There's no threat to you if they run _away_ from you. I'd like my property back, but I'm not going to dismiss my morals for a law that allows me to do so.

      That depends on How you're being tried. Years ago In Austin TX, a man, while coming back to his car while on a date, saw someone trying to break into his car, he yelled and pulled out his gun which resulted in the car thief running away. The armed car owner chased him down and shot him in the back, killed him, and then claimed Self defense. The prosecutor charged him with murder, but the jury all acquitted him. I suspect that , if it had been a bench trial, the judge would've had a different verdict. After reading the story, I thought it was murder too, but the jury felt differently. I live in Austin and was surprised by this ending.

      @@djs12007 Had I been on the jury I would him guilty of murder, the man's life was no longer in danger, that is how the law reads, peoples personal feelings have nothing to do with facts, if personal feelings get into the way of being on a jury then those people should not have been on the jury, I have been excused from jury service for less of a reason
