    I don’t blame the doctor, you cannot blame the doctor because Lori refuses to co-operate so how can they do a proper assessment? This is for Lori’s benefit, she needs to grow up and get it over with, she is delaying her own case, she knows she is guilty. Thank God she is already charged with the other 3 murders, let’s hope Charles can get his justice swiftly 🙏 justice for Charles Vallow. The police failed him, he begged them for protection, he told them how crazy she had become but no one listened, 💙

      I go back and forth because anytime she is talking about anything other than the murders she is 100% lucid .When she spoke to Colby she could recall events and people places ect .Being super religious doesn’t make you not competent!!! Either way there is no god waiting for Lori just the depths of hell

    Agree with the judge. I can see her wanting to come back after found guilty and say it wasn't fair because she didn't know (fill in the blank) and want another trial. She definitely is manipulative, but this court must have confidence in her competency.

      @@Harlem55 Imagine if a lawyer had raised the issue in the Darrell Brooks case. Had the judge not done the whole competency process, she would've then practically been forced to halt the trial the minute Brooks went crazy during the trial. People are presumed competent but if there are questions raised about competency, the court then has to hand it over to mental health professionals to diagnose what's actually going on in her brain. It doesn't mean the court believes she's incompetent, it simply means there is a question that needs to be solved properly before the time comes for the defendant to think of every possible excuse to get a second shot at a trial.

    Even at normal speed, the attorney needs vocal coaching. She needs to breathe deeply into belly and allow calm, more professionally effective voice. She comes off as hysterical, in trying to be persuasive, perhaps.

    Lori has nothing to look forward to for the rest of her life other than this trial. She's trying to milk it for her own entertainment and to feel like she has a little bit of power by acting out.

    When Lori Vallow was found incompetent to stand trial in Idaho, she was transferred from the jail to a mental hospital for 10 months of competency restoration treatment. In Arizona, inmates remain in jail while they receive competency restoration treatment. I wonder if Lori pretended to be incompetent in hopes of getting transferred out of the jail to a mental hospital again but then when she discovered that Arizona doesn't work that way, she told her attorneys "Never mind."

      Not a chance I don’t think. She will never give the slightest indication she is incompetent. She wants control over her narrative and wants to tell her rubbish story, she wants to be seen as a prophet so to speak who does what Jesus tells her. She is delusional but in her mind she isn’t and everyone else is. It’s not lost on me that her lawyer filed the Rule 11 right after her new story to Colby about what happened to the children was made public. The lawyer then deemed her possibly incompetent as it was utter nonsense. After that she wants to represent herself as she knows lawyers will likely not go with her stories as they just don’t add up to evidence.

      I have that video saved and still haven’t carved out the time to listen. Maybe I will over this holiday week. Maybe I’ve been subconsciously putting it off because I know it’s gonna be rough. And by that I mean rough listening to Colby and seeing his reactions. 😢 That poor man has been through absolute hell. I can’t even comprehend how he feels.

      It hasn't been determined by this court that there is a delusional disorder. If there is one, it should come out in the evaluation by the next interview with the doctor. Then perhaps she would be found incompetent. Personally, I think she will be found competent. LV knows what to say to present herself as competent because she IS competent, previous delusions aside.

    Hey Peter, this discussion around competency motions prompted me to ask this. International Day of People with Disability (IDPwD) is coming up on December 3. Could you maybe do a video about the laws and limits for people with intellectual disability, brain injuries or speech disabilities, how they’re assisted to testify or otherwise give evidence? To my understanding, just having an intellectual disability doesn’t preclude a person from standing trial, testifying or being a witness. But I’m curious how their rights vs risks are weighed up.
    Not that Vallow has an intellectual disability! But the same laws are applied to psychological capacity as to intellectual/cognitive, yes?

    I think Judge just wanted defense to allow the rule 11 process play out and let the rule 11 judge rule on it. Defense didn’t like what rule 11 judge did so they ran to this judge.

    Most Prosecutors/Attorneys weaponize the Competency process as a delay tactic or as a defamatory/ inflammatory dog and pony show hoping to get a rise out of the defendant or cast a subconscious bias to the Judge in an effort to help either sides case. They have absolute immunity so they always get away with it and don't care about any damage mentally, reputation wise to the defendant because they like to use Competency as a Lawfare tactic against you to get the plea deal they want (especially for people already in jail it adds extra time for them to use as credit served as part of a downward departure when the state knows they have a weak case) . They only have to file a "Suggestion" as " Good faith" (which is of course extremely vague and hard to prove bad faith).

    It’s because the Dr M did not formally interview LV, he spoke to her briefly so his report wasn’t detailed. LV refused the interview.

      It won’t come out in the trial. I don’t even think they will be able to say she’s a convicted person spending life in prison unless she opens the door to that fact. The conversation with Colby I think resulted in her lawyer filing rule 11 but it won’t come in to her trial

    I remember hearing about this case locally . Our news reported the killing of Charles as a self-defense shooting. The reporting seemed fine with the self-defense claim. As a gun owner, I would never shoot a person over an argument. I would leave. How many cases have we heard recently where self-defense is claimed and the the defendant is found guilty?

    Honestly, Peter, after watching some trials and listening to you, explain legal issues that come up in trials. I don’t know why any late person would want to represent themselves. There are so many big things you have to know in order to competently be represented. I seriously doubt that anyone, who is not an actual trial attorney could safely and confidently way through the waters and get to the other side in one piece. I know I wouldn’t want to try it. Although I am well educated, with a masters degree, I would never ever dare to represent myself in any legal proceeding. No telling how much trouble I would create for myself.

      she's in jail for life anyway she knows that imo i think she wants to represent herself to use it as a platform for her creepy beliefs and shes a narcissist so i think she wants to be able to spin the narrative and be able to question witnesses at her own discretion

      While I agree with this, not everyone can afford representation when it comes to legal matters unfortunately. But if given the option of free counsel most people with an iota of intelligence would take it before attempting to represent themselves.

    Peter, you WILL be covering this case, won't you? I have been following this case/story since watching Netflix's docuseries "Sins of our Mother". So I have seen both Lori's first trial as co-conspirator and murderer of Tami (sp?) Daybell, Tylee and JJ, as well as Chad's trial for the same crimes, and now I am glad that the other victim(s)are having justice sought on their behalf. I do feel like of course her choice to represent herself falls into the whole "He who acts as his own lawyer has a fool for a client" category...her statement at sentencing for the Idaho trial is an example of how she could well use this opportunity to get up in court and say whatever she wants put out there. Also....it's interesting to me that she's finally gone back to Vallow after quite loyally (and for awhile, according to family members) clinging to her husband and at least his last name long after he threw her under the bus at his trial. At which he was sentenced to death. I predict she seeks to marry yet again! Just a crazy, crazy story and set of circumstances. Thanks Peter for all your astute, unbiased and intelligent breakdown and coverage of these cases! You da man! lol

    The judge made the right call! If this question is not answered properly by a mental health professional who has spoken with her, there will forever be this juicy ripe apple, ready to be plucked the second she gets convicted. All it takes is one very good appeal attorney to make the right arguments and the whole thing needs to start over.
    I don't think this judge actually believes she's incompetent, he knows very well what manipulative games she's playing, but that belief needs to be solidified by an expert, especially because she has not made many statements in court. It's not like there is an overflow of evidence from her to justify a lay human to legally opine as to her mental state.
    If she wants to represent herself, she needs to cooperate. Nobody is asking her to tell her life story in court, nobody needs to know the details of her crimes, but she needs to talk. If she's purposely being vague, then the doctor should be able to recognize that and then that'll mean she's competent to understand the situation enough to be vague about it. She could actually say that literally and it would help her achieve what she wants: getting to represent herself. But what we cannot have is a judge filling in the meaning of her silence without an expert basis.
    If she truly wants to get a speedy, pro se trial, she needs to be willing to answer the judge's questions. She will be her own lawyer. We cannot have a lawyer who does not speak, it simply does not work. If she wants to shut up, then she can have a lawyer to speak in her place. If she thinks she can do better, she actually needs to try.
    Better to take just a little bit more time to have a clear record than to ask an appellate court after the fact to determine what the words typed in a transcript mean. This circus needs to effectively end when the jury delivers its verdict so that the families can have some peace.

    Thank you Peter. You had mentioned this judge not liking the defense. I think it stems from the last hearing and possibly before. They can be very rude to the judge. Especially the male attorney. I also don’t think the judge appreciates Lori Vallow not wanting to show up to hearings because he wouldn’t let her wear street clothes. I’m wondering though… isn’t make up considered contraband? She sure has a lot on.

    Lawyers don't have fancy hairdos like they used to. I don't think this lady has been a lawyer very long. Wouldn't you know Lori would want to defend herself.? That imo would be disasterous.She has done nothing but manipulate her whole life.I guess that judge is tired of her. He's probably got no respect and i don't blame him.
