This is amazing! Derivative Citizenship in adoption cases is one of the most complex areas of law. Imagine being given bad news 53 times--then someone digs deeper and pulls up a win. Great job!
We want to apply for naturalization of two grandchildren born in Mexico to our 26 year old son who is a U.S. citizen but who has lived in Mexico since before his 15th birthday. He is not eligible to obtain the certificate of birth abroad for his kids, because he hasn't lived in the U.S. since 1999. He is very discouraged, because the process is complicated and he can't afford an immigration lawyer, so we want to initiate the process ourselves as grandparents of his two children, ages 3 and 5. We created an account on the USCIS website but can't find any procedure for initiating this process as grandparents. How do we start the process?
Hello. I'm a US citizen who lives abroad. I got a passport through my parents who were naturalized. My children were also born abroad. I couldn't file for a CRBA because I lived 54 months in the U.S. before they were born. You have to live 60 months before they're born according to the rule. I wanted to learn the easiest way to make my children (who are age 5 and age 7) US citizens. Is it an option that I move back to the US, get a job and then file a N-600 or N-600K for them? I have learnt my children can become citizens through my parents (their grandparents) who are also citizens. They are retired now and also live abroad. They both have passports and Certificates of Naturalization. Would these 2 be sufficient proof of living for 5 years in the States? I would like to know if they can file the N-600 or N-600K from overseas or do they have to be living in the US (or can they fly to the US and file it there). Which other documents do we need to show? Eg. birth certificates, marriage certificates, dna tests etc. and whether they should be copies originals or attested copies? Also how much your law firm will charge to handle the process and appx how long after filing is the interview date? And finally, back to my original query: I wanted to learn the easiest way to make my children (who are age 5 and age 7) US citizens. (please advise if there is another way/better way to make my kids citizens or at least obtain U.S passports. Thank you. Sameer
my father become a US citizen 2008 he filed a petition for the family me, my mom and my siblings then unfortunately he died in 2011 and we came to the united state in 2012 so i may have derive or acquired citizenship under the child act of February 27 2001 so i met all requirement except that i have not lived in his physical custody in the united state so my question is if i applied for N600 certificate of citizenship will it be approved by the USCIS .
I am a USC but due to lost passports i am not able to prove my 5 year presence requirement for my children born 1994,1995 1997 2004.Further to which when I applied for the first time and was denied I was not told that my children could derive citizenship through my father who was a USC (born and died in US). My children are now "aged out" so to speak and I am being told to apply for Green Card for them. They are USC..but I how do I apply for derivative citizenship even for the 11 year old?
Hi, I'm having a hard time understanding the chart. Please help me? I was born 1979 and my mother became a citizen in 1986 but my father is a green card holder. Please tell me what I should do?
So what can I do If my mother was residing in us more than 5 years but we don’t have any type of proof other then two birth certificates from my 2 older brothers?????
Is it important that my grandparents are still living or does the citizenship through grandparents also works if both us american grandparents are death?
Hi, I have recently found my father through Dna, a further Dna test with my half brother proved conclusively that we had the same father, my dad served in the US airforce in England, he was a US citizen by birth, and lived all his life in the US, barring his military service, I was born August 1952, would I be able to acquire US citizenship? Regards mark.

+salelo salilo you can file for a consular report of birth abroad at the United Consulate General in the United Arab Emirates. Giving your child a US birth certificate
I can share my story for you too. I was born in South Africa in 1997 to an American mother. After trying to approach a green card at 15 and facing many difficulties to do so because of the quality of my South African citizenship, I learned of an alternative route. Under section 322 the Department of Homeland Security allows the transfer of US citizenship by grandparent/s to the grandchild, provided the grandparent has resided in the United States for at least 5 years, of which 2 were prior to the age of 14. I then had to file an application N-600K, supporting documents with the filing fees and after a couple months of processing, I was approved to travel to the United States on a simple tourist visa and attend an interview. 2 days after my arrival at the USCIS office, during my interview, my documents were reviewed in my presence and I was asked a few minor questions to verify my paperwork and I was not tested in any way, in regards to academics or understanding of English or US history. After waiting for about 15 minutes after that, my certificate of citizenship was ready and I was clear to say the oath of allegiance and was awarded US citizenship 3 months before my 18th birthday, the official expiry age to claim citizenship. I am now residing in the United States and in the process of joining the US Army.
