Imagine if the police developed a similar level of empathy for their fellow man. Just because "it's the law" literally doesn't mean that every officer HAS to enforce it. Ever been let off with a warning for breaking a law? I have, multiple times for speeding, running a stop sign, etc. It's called discretion, and just because "it's the law" to impound someone's vehicle, doesn't mean it's absolutely fucking required for the office to do it.

I'm poor, I've contacted my state senators multiple times about issues that made things far too difficult for poor folk. Every single time they at least attempted to get changes implemented, many times successfully. You wont know if you don't try.

Does that justify impounding his vehicle at great expense in addition to the ticket? OF course not. And that cop was a liar. He didn't HAVE to impound, he could (amazingly), but the ticket was all he HAD to do. Police departments use the law like a bludgeon like this to steal your stuff. He only pays when they take his income tax or drops $50 in there and promises to start paying to get his licenses back or stay out of jail. And another thing is his daughter is just like him. Its impossible to know every law. Have you ever read a book of laws? Its insane how much is illegal. Its estimated that people break 2 laws on average per week.
well to be fair, there are hundreds of regulations. this affected him personally yes, but also brought this to his attention. i doubt he changed it because of personal anger. that anger is gone the next day, working out such a bill is a lot of work. its just with everything, if it affects us we have focus on it and understand it better. thats why someone who had breast cancler and survives starts a breastcancer foundation and not a skincancer one... a real evil person would look into who is impounding, make a new law that requires a special license he will give to a business partner and profit from every impound without changing the law
@@jsmith-u5i We have come so far away from common law. A drivers license and vehicle registration was at first only for commercial drivers. Only a Business owned vehicle could be impounded. Business are commercial entities and have no rights but people do. People have the right to travel regardless of the mode of transportation. Unfortunately statutes have taken precedence over laws. We are supposed to be a country of laws not a country of statues.

I had this happen to me because of a tag reader error. I took the case to court and had it dismissed but the towing charges and impoundment fees, well over $500, could not be dismissed. The judge stated that those fees were between me and the towing company. My lawyer threatened to sue the towing company as their fees exceeded State Laws on towing fees and the fact that there was no traffic violation to begin with. I did wind up paying $250 to get my truck back, , ,

You won't know the impact of something and how hard,devastating and painful it is unless it happens to you. Be it be loss of loved one or ruined business, personal life etc. Big or small, the event makes it's impact. Also the officer was to be praised for doing his duty regardless the person and the position he holds

For example if a person has a fracture I would not understand his or her pain unless I had one before. Another example could be the grief over the loss of a loved one.
I remember watched some bounty hunter who repo kids car when he need for his father to take him to hospital. This guy just take the kid brutally. And the father died 1 week later. They live in most rural area. No people around so cant borrow a car or something.
It Arizona I put my car in storage when I was traveling and the state took away my registration without notifying me, so I'm pulled over and inconvenienced for tags I've paid for but were withdrawn. Apparently, the insurance company reports when you remove insurance for storage, but the driver is supposed to notify DMV or MVD - since the driver is left out of the process and not notified by anyone, this is poorly managed. It took 5 mos. to correct the situation and most people are unable to get it corrected I'm told by someone working for the court - it's like stealing money from good citizens by creating a paper jungle and not notifying anyone - these laws are insane and not properly executed.

You leave them for another company, and they report it to the dmv that you canceled the insurance. Then you are stuck running around and no accountability.

Then, the DMV should notify the insured when you start driving the car, but they don't notify anyone. In AZ. the DMV saves on postage and doesn't notify even when the tags expire. I guess they extend that "savings" on other notifications, too, because I never got any notice they were cancelling my registration - not for it expiring, but because they are thinking maybe somebody doesn't have insurance - they should check with the insurance company prior to canceling, maybe? And the insured should be informed. The computer age allows monitoring, but they don't have the system working properly. AND, worse, a clerk at the court says "these letters are very difficult to get" when you prove you have had full liability insurance the entire time = so they are apparently cheating good citizens out of $500 fines because they do not provide letters even if they PROVE they were always covered. Beyond those reasons, when a vehicle is impounded the Fourth Amendment does not apply. If the senator was a black man, the police would tear the truck apart looking for drugs, a gun, or money. If money is found, civil forfeiture applies. The cops keep the money. So you are going to buy a boat with $1,000 in cash. Your tags are expired. Well, you know the rest of the story. The Supreme Court is hearing a case on civil forfeiture right now. I think I know how they will rule.

In fact vehicle registration fee should be much much higher so that people are actually aware of just how much roads and highways are coasting the US. Right now most roads/street expenses are paid from State/Local/Federal budget and is not reflected in the vehicle registration.

What's stupid about requiring people to update their auto registration on time ? I don't know how it works in whatever state this took place, but in mine, it works like this. You get a notice in the mail that your tabs expire 45 days. You can go to a local office and buy them directly, mail in a check, or order online. You also have a 15 day grace period.

Yes, a governor can veto a bill just like the President can veto a bill. In this case, the House and Senate would have to each vote to override the veto by a two-thirds majority in the next session. Be thankful that such is the case. While the veto can prevent bills you like from becoming law, it can also stop really bad bills that don't enjoy the support of the people.

In PA we use discretion, we could tow as well, we don't (unless you have no insurance or a suspended license)..you get a ticket and move on to hopefully renew your registration as soon as possible, I can't see how it was mandatory that that officer had to absolutely tow it.

You don't have a "right" to drive, nowhere in the constitution does it say anything about the right of the people to "drive" a motor vehicle . That "right was given to the states by congress and they say you need one to operate a motor vehicle in their territory . The states FURTHER clarified the restrictions placed upon IT by them (states) in order for people to know that it only operates within the power approved by the states when they ratified it with the Bill of Rights. I was very sick with heart problems on the way to see my VA doctor when this happened to me... an officer parked at a gas station at a busy intersection using his computer to check every car tag with a hand held wand, looking for expired tags and expired insurance. He ordered my car be towed and intended to leave me there to die. The tow truck driver was empathetic and wanted to take me back to his shop so I could call for help, but the officer ordered him not to do that. The officer got a call and left, so the tow truck driver drove me one mile to his shop and I was able to call for help from there. That incident cost me $800+ and I ended up having blow out heart failure a few months later. I'd love to know what it cost the legislator. Probably nothing. I'm happy that law has changed. I would be happier if someone had forced a court challenge to get a court order declaring ALL those seedy confiscations were unconstitutional, purged the black marks on everyone's driving records, and forced them to reimburse ALL the fines, probation costs, and other costs associated with unlawfully targeting poor folks with even worse financial devastation. People who make laws like that are just pure evil. There is no word bad enough to describe an officer who would leave an ill person suffering heart failure on the side of a road with no phone to call 911... when THEY are already there supposedly to HELP the public. Most folks are good people, regardless of the situation. But there's always someone... that's just... evil to the core. Big sigh.

He changed the law not to "continue breaking the law" but to rid a policy which was unjustified. I'm glad he felt what the affects of the towing policy has on his constituents. Expired tags usually means expired registration, expired registration usually means expired insurance, in my profession. No insurance means financial burden and loss for anyone hit by someone with lapsed plates, registration, and insurance. Someone hits a pedestrian, bicyclist, motorist, or their property with expired tags, registration, no insurance then you'll have an understanding as to why this is in place. Then you'll be asking why this law wasn't in place. There's ZERO reason why ANY car should be on the road with you with expired tags, registration, insurance.
I agree with the Senator. Getting a citation for an expired tag is understandable. But getting it seized and towed away is absolutely ridiculous. Good on him!
dog guy, neither me or any member of my family has ever had their car towed off the side of the road for not paying for tags/liability insurance, etc. I just think it's a stupid law that a vehicle is actually confiscated and towed to impound for something like this. A large majority of LEOs also agree, and usually allow the person to drive off (in my state anyway). Waiting around to have it towed can often use up a lot of time for the LEO, who typically have other business to attend to. Hard core or new LEOs will likely have it towed, though. Here's the thing, the state is going to get their money for the tag anyway, even if it's 3 to 6 months expired. It's not like driving a couple of months with an expired tag is going get you any type of "free ride", unless you never plan on re-tagging the vehicle for the rest of its life. Good day, Sir. .... The fact that he tells he is a senator and knows the mayor of town, gives me a bad taste in my mouth. He should have acted like he was any member of the public and then gone for changing the laws, had the cop made an exception for him, he would never have pushed for a law change. I doubt he will ever let his tag expire again so this law wouldn't effect him again either way. His truck got towed like anyone else and it sounded like he didn't even know the law existed in the first place. Good on him for wanting to save the citizens in his town from this happening to them too. Some people are living paycheck to paycheck and a bill may get forgotten and before you know it you get pulled over and your family vehicle is impounded. A lot of times people don't have the several hundred dollars to get their vehicle out for a few days and before they know it the vehicle costs over $500 to get out and thats a lot to some people. He didn't have to try and change anything for the citizens but he did.
No, no, no! Get your vehicle inspected for public safety or face the consequences! Most states put it on the windshield in big numbers on the drivers side! Actually, this is not the byproduct of Senator Harbin's work. He is a first term senator, so he did not create the law in the first place. He did precisely what is right with an unjust law. He changed it. The law would be particularly discriminatory against those who are low income. Imagine having to choose between groceries and registering a car, so you let the car registration slip. You end up getting the car impounded after a traffic stop. Now you can't even get to work because you don't have a car. Changing the law to enable a person to leave a traffic stop without having their car impounded was the right thing to do. Sure, it took first hand experience to discover that there are some laws that are just plain stupid. Thank you, Senator Harbin for doing what is right unlike the swamp creatures at State House.

Years ago I moved and never got my renewal, didn’t realize it for six months. So now I would lose days from work, and have to come up with enough money to pay for the tow plus the ticket, and the registration all at once. And every day I weighed cost another 50 bucks in storage fees.

We have come so far away from common law.
A drivers license and vehicle registration was at first only for commercial drivers.
Only a Business owned vehicle could be impounded.
Business are commercial entities and have no rights but people do.
People have the right to travel regardless of the mode of transportation. Unfortunately statutes have taken precedence over laws.

I had this happen to me because of a tag reader error. I took the case to court and had it dismissed but the towing charges and impoundment fees, well over $500, could not be dismissed. The judge stated that those fees were between me and the towing company. My lawyer threatened to sue the towing company as their fees exceeded State Laws on towing fees and the fact that there was no traffic violation to begin with. I did wind up paying $250 to get my truck back, , ,

For example if a person has a fracture I would not understand his or her pain unless I had one before. Another example could be the grief over the loss of a loved one.
I remember watched some bounty hunter who repo kids car when he need for his father to take him to hospital. This guy just take the kid brutally. And the father died 1 week later.

It Arizona I put my car in storage when I was traveling and the state took away my registration without notifying me, so I'm pulled over and inconvenienced for tags I've paid for but were withdrawn. Apparently, the insurance company reports when you remove insurance for storage, but the driver is supposed to notify DMV or MVD - since the driver is left out of the process and not notified by anyone, this is poorly managed. It took 5 mos. to correct the situation and most people are unable to get it corrected I'm told by someone working for the court - it's like stealing money from good citizens by creating a paper jungle and not notifying anyone - these laws are insane and not properly executed.

You leave them for another company, and they report it to the dmv that you canceled the insurance. Then you are stuck running around and no accountability.

Beyond those reasons, when a vehicle is impounded the Fourth Amendment does not apply. If the senator was a black man, the police would tear the truck apart looking for drugs, a gun, or money. If money is found, civil forfeiture applies. The cops keep the money. So you are going to buy a boat with $1,000 in cash. Your tags are expired. Well, you know the rest of the story. The Supreme Court is hearing a case on civil forfeiture right now. I think I know how they will rule.

In fact vehicle registration fee should be much much higher so that people are actually aware of just how much roads and highways are coasting the US. Right now most roads/street expenses are paid from State/Local/Federal budget and is not reflected in the vehicle registration.

What's stupid about requiring people to update their auto registration on time ? I don't know how it works in whatever state this took place, but in mine, it works like this. You get a notice in the mail that your tabs expire 45 days. You can go to a local office and buy them directly, mail in a check, or order online. You also have a 15 day grace period.

In PA we use discretion, we could tow as well, we don't (unless you have no insurance or a suspended license)..you get a ticket and move on to hopefully renew your registration as soon as possible, I can't see how it was mandatory that that officer had to absolutely tow it.

I was very sick with heart problems on the way to see my VA doctor when this happened to me... an officer parked at a gas station at a busy intersection using his computer to check every car tag with a hand held wand, looking for expired tags and expired insurance. He ordered my car be towed and intended to leave me there to die. The tow truck driver was empathetic and wanted to take me back to his shop so I could call for help, but the officer ordered him not to do that. The officer got a call and left, so the tow truck driver drove me one mile to his shop and I was able to call for help from there. That incident cost me $800+ and I ended up having blow out heart failure a few months later. I'd love to know what it cost the legislator. Probably nothing. I'm happy that law has changed. I would be happier if someone had forced a court challenge to get a court order declaring ALL those seedy confiscations were unconstitutional, purged the black marks on everyone's driving records, and forced them to reimburse ALL the fines, probation costs, and other costs associated with unlawfully targeting poor folks with even worse financial devastation. People who make laws like that are just pure evil. There is no word bad enough to describe an officer who would leave an ill person suffering heart failure on the side of a road with no phone to call 911... when THEY are already there supposedly to HELP the public. Most folks are good people, regardless of the situation. But there's always someone... that's just... evil to the core. Big sigh.

Expired tags usually means expired registration, expired registration usually means expired insurance, in my profession. No insurance means financial burden and loss for anyone hit by someone with lapsed plates, registration, and insurance. Someone hits a pedestrian, bicyclist, motorist, or their property with expired tags, registration, no insurance then you'll have an understanding as to why this is in place. Then you'll be asking why this law wasn't in place. There's ZERO reason why ANY car should be on the road with you with expired tags, registration, insurance.

dog guy, neither me or any member of my family has ever had their car towed off the side of the road for not paying for tags/liability insurance, etc. I just think it's a stupid law that a vehicle is actually confiscated and towed to impound for something like this. A large majority of LEOs also agree, and usually allow the person to drive off (in my state anyway). Waiting around to have it towed can often use up a lot of time for the LEO, who typically have other business to attend to. Hard core or new LEOs will likely have it towed, though. Here's the thing, the state is going to get their money for the tag anyway, even if it's 3 to 6 months expired. It's not like driving a couple of months with an expired tag is going get you any type of "free ride", unless you never plan on re-tagging the vehicle for the rest of its life. Good day, Sir. .... I SAID GOOD DAY!

Actually, this is not the byproduct of Senator Harbin's work. He is a first term senator, so he did not create the law in the first place. He did precisely what is right with an unjust law. He changed it. The law would be particularly discriminatory against those who are low income. Imagine having to choose between groceries and registering a car, so you let the car registration slip. You end up getting the car impounded after a traffic stop. Now you can't even get to work because you don't have a car. Changing the law to enable a person to leave a traffic stop without having their car impounded was the right thing to do. Sure, it took first hand experience to discover that there are some laws that are just plain stupid. Thank you, Senator Harbin for doing what is right unlike the swamp creatures at State House.
