Now I need to see if this is still the same 9 years later. It makes sense though, that your attorney should not 'help' one to incur more debt in order to file bankruptcy, since the point of, at least chapter 7, is to not pay the debts you have already incurred.

You can do, BUT the system is set up to work without any input from individuals. If debt payments are made late, credit score goes down, if too much debt, too low credit, people don't have the means anymore to get a new car loan for example to get to work or buy a house, or find an apartment with judgments, and so on. If clients have a job, creditors will take the money, I had clients who had three garnishments at the same time. Creditors freeze bank accounts. Without bankruptcy, creditors will will do what they can do. Bankruptcy give people power to get back up.
@@Lickerlaw this is not entirely true. If the cc defaults, the accts go into collections. It is possible that the collection agency sues but they do not have legal rights. It is junk. The creditor is not suing. It is not a quick process to get sued and get garnished. You can fight the collection atty and win.
When I got divorced I didn't file anything and just stopped paying the bills. When the credit card caller's found me I just told them to piss up a rope, you can't get blood out of a turnip. It took a while but they would eventually go away. Then some other collection company would buy the debit and start over again. I always found being honest with them always worked the best. I just told them: I'll pay you when he'll freezes over and until that happens stop calling, I have no intention of giving you any money! That would get rid of them until some other company bought the debit and started the cycle over again. But I never did file bankruptcy or get a judgement levied against me either.

I’m currently filing for a bankruptcy chapter 7. I lost my car in a repo recently seeing that the payment was to high and my lawyer said to stop paying for it since I’m filing chapter 7 and now we’re in need of a car, can I get another car loan under let’s say a siblings name and credit? Or should I wait till bankruptcy is over to do that?

Only thing about have a sibling or parent put a car loan under their name is I can’t be on the registration and if something happens it will fall under them seeing that the car is registered under them. So I figure co-signing I can be on the registration and get the insurance for the car on my own. I haven’t filed yet

I first contacted my lawyer back in 8/30/18 and at first before talking to him I was stressed out and nervous but after talking to the lawyer it made it a little less stressful seeing that he had all the answers and steps of how a bankruptcy works and the difference between a chapter 7 and 13. The reason I haven’t filed is because he advised me to wait until the creditors file a judgment against me and once they do that I would have to appear in court to get my wages garnished. At that point once I’m served that judgement is when I file and the judgement will stop and my bankruptcy meeting will take place 30days after I file. That’s why I’m getting a car now seeing that my old car died and I’m still waiting to get served and I don’t know when that will be so I’m to get a car before filing. My lawyer did say he couldn’t advise me about getting a car loan before bankruptcy like this video says but he did say their is a exception for a ‘valid purpose’ but that he couldn’t advise to take on new debt. So here I am also trying to figure out how to go about the car loan before filing.

oh, absolutely, there is no lobby for people who work and live pay check to pay check. But make no mistakes, there are many people who are against free stuff and think bankruptcy should not be an option. Filing bankruptcy and getting people out of debt is actually healthy and good for the whole economic system. You need to get people out of debt so that they can contribute again to the whole economy not only to a few creditors they owe money to. Bankruptcy does not only benefit the individual, it benefits the society.

Was wondering if anyone would know the possible answer. I was involved in a car accident and I had no insurance ( stupid I know) the accident was not my fault but HER insurance still blamed me. I tried to fight her insurance on the claim of it was “my fault” because the know I did not have insurance. So no one could of protected my side. SO they sent me to collection for 40K. If I file for bankruptcy does that debt go away? Meaning do I still have to owe that 40K ?

What if I have a cosigner and I'm only 3 payments away from being paid in full. I want to file but I don't want to trash cosigner's credit. Any hope for me? Even if I get through paying for vehicle will they take it if I file chapter 7?
One co-signer can always file bankruptcy if the person doesn't want to keep the car. But, the other co-signer would be still liable. We have every so often cases in which also the second co-signer filed bankruptcy, if that is the case, meaning both file bankruptcy, than there is not problem, no one is liable.

Wouldn't they repossess the car to get some of the equity out of it?
CHINESE STEEL there would be no equity if you just took the loan and if there is you can exempt it (the car)
