I just filled Chapter 7 and had 341 meeting and car offers and credit card offers in the mail are just crazy, i believe the system won't you to be in debt forever, but I refuse to go back to that nightmare
@@AscendFinance well you won't be able to go in back into debt that fast, don't choose some of the thirsty offers that come in the mail specially car deals and high interest credit card deals,, it is August now I filed in April in my bankruptcy has been discharged, but always remember after it has been discharged that's when the challenge really start because you become a cash-only type person which could be very challenging

Why was I told by the attorney it’s not up to me, it’s up to my income and I have to file what he says I need to file?? My income varies a lot, I have my base pay but also been working a lot of overtime to get myself out of debt but as times change, cost went up, I’m gaining more debt. Thus, the need for bankruptcy. I feel it should be based on base income without overtime because overtime is not guaranteed!

Amazing video with simple explanations. I am evaluating bankruptcy due to a few rough years that put me way behind on a lot of debt. I have only talked to one local attorney and they said the chapter 13 fee was $6500. Does that sound high? Also, I have a rental property and my home which they told me had too much equity for a chapter 7. Does this mean I really only have a choice of a 13 if I want to keep them? Lastly, I used to make over $150k it’s been a struggle to get back to that level due to some MH challenges…but I believe I’m close to getting a high paying job again. What happens with my debts if I get a high paying job or a business I’m working on takes off?

Glad I ran into this clip, I have really unfortunately have been thinking I might have to go this route. My wife decided after 20yrs in corporate America,to go back to school for nursing and this bills just got too top heavy for only having one income now. My real worry is the assets you briefly touched on in this clip. I’m into my mortgage 15 years of 30. I would hate to have my home impacted. Recently my sister set me up after renting her house. I had a family dispute with my parents and she tried to make me suffer for taking my son and I out of their life. I recently just purchased a house on first buyers loan and I have a car with minus equity I don't own anything and she's suing me multiple times. So i am seriously debating on bankruptcy so i can have a clean slate. During the pandemic i lost a lot of hours at work and this effected my ability to pay rent. I applied for rent aid but it never paid so i was stuck with $10,000 that landed on my credit. I was trying to make payments but i was late by 11 days and the collection company did a judgement against me and is now trying to garnish my wages and now i owe over $11,000 because they stacked on their attorney fees. My question is that if i file bankruptcy how will that effect me when it comes to getting approved for renting apartments? Most apartments already won't take me because of that debt owed to the apartment. If i file bankruptcy will the balance owed to the debt collector for the apartment show 0? And does bankruptcy disqualify me from renting at a lot of rental places?

It will be harder to find an apartment but there are apartments that still allow people who file to rent. Honestly, sounds like you’re fucked either way so you might as well file. At least you’ll be legally protected from getting sued and/or garnished. Talk to an attorney first.

Is there anyway to force the bank into lengthening the term of the loan without doing a bankruptcy? I have no other debts except for one he locked that I couldn’t pay because of disability thank you. Nice presentation also thanks.
FORCE, no, CONVINCE, yes. If they sue you and try to get a judgement for wage garnishment, tell them they can either work out an extended payment plan with you OR you’ll file chapter 7 and they’ll get nothing. Chances are they’d rather make a deal than get nothing

This is quite possible. They use the means test which evaluates you income and compares it to your states median income. If you fall over the median income it is likely that you would not qualify, although they may then look to your disposable income which can help you to qualify. I think your approach here has you mind on the money you get, a case being dismissed? You didnt say why ut was dismiised... Too much debt? Attorney missed too many filing dates? Pretty rare to have a case like that dismissed, but you left it unexplained. Why?

So i am seriously debating on bankruptcy so i can have a clean slate. During the pandemic i lost a lot of hours at work and this effected my ability to pay rent. I applied for rent aid but it never paid so i was stuck with $10,000 that landed on my credit. I was trying to make payments but i was late by 11 days and the collection company did a judgement against me and is now trying to garnish my wages and now i owe over $11,000 because they stacked on their attorney fees. My question is that if i file bankruptcy how will that effect me when it comes to getting approved for renting apartments? Most apartments already won't take me because of that debt owed to the apartment. If i file bankruptcy will the balance owed to the debt collector for the apartment show 0? And does bankruptcy disqualify me from renting at a lot of rental places?

It will be harder to find an apartment but there are apartments that still allow people who file to rent. Honestly, sounds like you’re fucked either way so you might as well file. At least you’ll be legally protected from getting sued and/or garnished. Talk to an attorney first.
@@brianafranklin8164 speaking of garshisnments I just got a notice in the mail that the debt collection from Allied is going to try to garnish my wages for the debt I owe to that apartment complex....looks like bankruptcy really is my only option at the point because there's no way I can survive and have my wages garnished.

FORCE, no, CONVINCE, yes. If they sue you and try to get a judgement for wage garnishment, tell them they can either work out an extended payment plan with you OR you’ll file chapter 7 and they’ll get nothing. Chances are they’d rather make a deal than get nothing

Is it anything we did will get fail to discharge in Ch7 ? Such as we will lose the protection of 401K or IRA if the creditors can apply the exemption…..

When you file, you should receive a case number, I believe. Did you file with an attorney?
My attorney said if our business debt exceeds our consumer debt, even if we make over the middle income, is this accurate?

This is quite possible. They use the means test which evaluates you income and compares it to your states median income. If you fall over the median income it is likely that you would not qualify, although they may then look to your disposable income which can help you to qualify. I think your approach here has you mind on the money you get, a case being dismissed? You didnt say why ut was dismiised... Too much debt? Attorney missed too many filing dates? Pretty rare to have a case like that dismissed, but you left it unexplained. Why?
If a chapter 13 is dismissed it could be due to missed payments, failure to attend hearings or complete courses, hardships not approved, failure to file necessary forms or missing any deadlines, and a common one is a voluntary dismissal. In a Chapter 13 you can keep your home and car as long as you're able to keep up with the mortgage and car payments. You would just pay the home and car payments inside of your Chapter 13 payment plan.

@@tankdathomie I actually did not have anything of value that amount to any value so I really had a no asset chapter 7 I didn't have to give up anything I decided to keep my car because it was only worth $2,000 and it was in a title loan so I'm about to pay that off so everything went good I'm about to get my discharge my meeting 341 meeting was in May

By the way it has been wonderful my phone has totally went silent but one thing I must bring to your attention is to always keep an eye on all three of your credit files to make sure accounts are being closed because I've had to file several disputes on all three credit bureaus during this whole process
