    Finding myself in this position, I had no idea what this entailed, or what was involved. Then I start looking into it and find out how much it costs. If I could afford that the thousands of dollars this typically requires, I wouldn't need to do it...

    Great video. IMO bankruptcy is going to become more common in America with the pandemic. I also read where creditors are Slashing credit lines and cancelling cardholder accounts.

    Upsolve works ONLY in certain states. If you're from MOST states then Upsolve is only going to direct you to certain attorneys in your state.

    I went through this and filled out the forms.........They wanted almost $4000+ from me before all can be started on Chapter 7. I am on SSDI and can not afford that, HELP ME PLEASE.

    I crashed my loan car. Yes I know, stupid…. And to top it off my full coverage policy had been canceled and i didnt know so now im stuck with this debt and a car with $15,000 worth of repairs. Life really went downhill fast.

    I tried your site, although my income is over 4400 per month the questionnaire should have asked if this income from VA disability, social security or a pension etc

    This is WAY too much work. And how do you expect someone broke to afford a lawyer???? I don't have all the documents...WTF. I'll just let my 15,000 in debt accumulate, and ignore bill collectors. What is the worst that can happen? They won't send me to prison. I just can't ever get a loan or credit card again.

      If there are personal loans, they could sue you. Depending on the verdict they might garnish wages.

    Hey Joseph,
    what are your thoughts on Nanotechnology, Artificial Intelligence, and 5G Stocks?
    I have a case of FOMO (fear of missing out) with these Stocks with regards to the above mentioned industry's:
    TSM, IBM, INTC, CSCO, QCOM, VZ. They all pay dividends, and are financially sound. Please let me know what you think.

    I thought you had to file for the chapter 7 first and then take the credit counselling course? and then the deptors course after? Am I wrong in saying that???

      You have to take the credit counseling course before your bk case is filed.

      Upsolve can't help homeowners, the laws are complicated. It's a legit nonprofit. Have you tried legal aid?

    I just came across this video. I checked out the screener and it says because I own a home (mobile home) it cannot help me. I have to pay for a lawyer to file. I cannot afford that. I am on SSI and have a 30 year old mobile home. After paying debts, I have about $5 left every month. I guess this screener is for people who have money, those that cannot afford anything can’t use this app.

      Sorry this is a little long;
      I have an old mobile home but pay lot rent. From what I have found online having to file myself, there is nothing extra at all to file as it is not a house or has any mortgage on it. Mobile home people rarely get assistance or help. Even our state laws for renters are different for mobile home owners Vs. apt or home renters.
      legal aid does not help the disabled. I have tried many times for different issues. For bankruptcy, they refused to help and said the reason for denying me is; “able bodied people have more to risk. Being disabled and on SSI income is not a risk”. I was told by them that SSI income is exempt so I just need to send notice to all collectors to stop contacting me and then just ignore any attempts at collections. They even said to not bother going to court if I get a lawsuit as my income is exempt so they can’t take it. That is the dumbest thing ever to tell people that.
      Bankruptcy last for 10 years on your credit. Court ordered judgements for bad debt is renewable every 10 years, with no limit to how many times it can be renewed. So They are telling people to have judgements on their record for the rest of their lives, compared to filing bankruptcy.
      To add to that, at any time the collector can freeze the bank account to try and collect after getting a court judgement. The judgments also have interest that grows on the debt. So SSI people have to go to court each time the account is frozen to prove the income is SSI to have it released. There is also no limit to how many times a freeze can happen. So a collector can freeze your account every month for the rest of your life if they want to.
      You can’t file bankruptcy later as court judgements cannot be discharged in bankruptcy.
      My mother listened to legal aid and is now 11 years into a debt that could have been discharged. She just had it renewed for another 10 years last year. She was told the same thing by legal aid 11 years ago. So she sent letters to the creditors and they sued her in court. Legal aid said not to bother going as they would have proof of the debt so they will win, but can’t touch her income. So after they froze her account, they threatened to do it every month if she made no payments. So she made an agreement to pay them $15 a month until the debt is paid. That is laughable as the total is over $7,000 now with interest, and growing. They figured out she had a disposable income of $15 every month so that is what they demanded or else they would keep freezing the account just to cause hardship. So she is trapped and will never get it paid off or settled now.
      I am trying to avoid the same situation of have a life long debt. I can’t afford a lawyer and legal aid flat out refuses to help. There is no online help I can find so I am stuck doing it myself. I did find that people like me that are low income can have the court filing fees waived, by law, so I do not have to pay to file in court or pay for the credit classes beforehand. I did not know that was possible before.

    What about a homeless guy in Florida like me with supper bad record keeping. I haven't filled taxes since 2013. I'm used to not getting paid and with everything online I've no pay stubs etc

      That's awesome that you haven't paid taxes in 9 years! Keep it going bud. Almost no chance they'll ever find out....but if you file they will know immediately! So don't file taxes ever again and you're good to go

      You can usually keep your primary home and car (as long as it's not a super-expensive car) in bankruptcy. Court figures, you have to live somewhere and have a way to drive to work

      Banks and credit unions often let people sign a reaffirmation agreement in a Chapter 7 to help them keep their car loans through and after bankruptcy (depends on payment history and contract)

      I'm not an expert but I believe when you file it there is a thing called an Automatic stay which will immediately put actions from collectors to halt. But there are some exceptions and it may vary state to state so you'd have to find out.

      Ask them to validate the loan.. ask to see the promisary note ..that has that third party collector on it saying you owe him. They don't have it. You don't owe them anything

    CRAP. You DO need a lawyer. Because even if you file on your own? There'll still be fees. And if you screw ANYTHING up? The court will likely reject your petition, you'll lose any fees you had paid and you're back to square 1.

      if you are that dumb to not be able to follow a simple questioner where only you have the answer then yes you will definitely need a lawyer but this is exactly like doing taxes, very easy and yes it does take time but once you are done and like I said there is no reason for you to mess it up..

      @sadie jones yes I did, I'm not going to say it's easy but it's not hard either, there are a few classes the court will make you take and the forms are in your state website. Here in California it's all time consuming but at the end if everything it's filled correctly then you will be fine. The best part of doing it yourself is that the moment to file the first motion for bankruptcy you can stop all the mail and phone calls from debt collectors.
