  • The plaintiff brought his vehicle into the defendant’s shop for work. Unfortunately, the plaintiff claims the defendant left the vehicle outside during a snowstorm, and now it needs new carpeting, so the plaintiff is suing. The defendant claims the damage isn’t his fault because the plaintiff didn’t alert him about pre-existing issues with the vehicle.

    I thought the plaintiff was being stupid until the defendant admitted he had told the him that the windows leaked bad. If that is a known factor then the defendant should have made arrangements to keep the car inside. If he couldn't get to it for a month tell the defendant to come get it and bring it back on a day when it can actually be worked on.

      The plaintiff already knew it leaked as well! It's his car! If the car was at the shop more than a few days he should have covered the car with a car cover. Or talked to the defendant and asked him to keep it inside. Though that is a big ask for a busy garage.... especially for a limo!

      I agree and I'm glad the plaintiff won. The defendants admission "I told him the windows leaked like a sieve" is why he loses the case. It's based on the legal definition of "reasonable care". He had a duty to the plaintiff to bring it inside, put a car cover on it or call the plaintiff and tell him to bring it back another day. Total negligence.

    I've never seen her take into consideration that a plaintiff wasn't planning on buying a new whatever to replace what was damaged. And also never saw her give full replacement value. What the!

    It would be different if the Defendant didn't know the windows leaked. However, he knew and still left it uncovered. Had he not known, that would be different. A person would assume a car/limo to be water tight. I mean if your windows allow that much water inside, there's an issue. But, the Defendant knew and that makes all the difference.

    I applaud the defendant for his honesty. The world needs more of this. People should go to his shop because it’s not easy to find an honest mechanic. I’m sure he will do better about protecting vehicles in the future, but at least you know, he’s honest.

    Been watching for a long time. I think the best entrance ever was when the three plaintiffs entered, walked up to the plaintiffs side and then turned their backs to the camera and faced the gallery of people. The gallery just looked in awkward silence. Josephine told them to turn around. (That was the bailiff before Douglas).

    I had this exact situation except my limo is a Cadillac. Yes they can leak in heavy rain. When they are at the shop, they should check on it and cover it with a tarp if needed. In my case, homeless people actually moved into it! The customer has no control over that when it is in the shop's possession.

    The car was originally wet and leaking. The defendant told the plaintiff it leaked. Didn't the plaintiff have a responsibility to take care of the seals? And, where did the plaintiff store the vehicle since it was full of water to begin with?

    This is why you answer the question and don't add anything extra. It is the same reason that your lawyer will tell you never talk to cops. It is easy to slip up and say something that hurts your case.

    Found it weird that Doug told the defendant he should have kept his mouth shut outright (and JM kinda implied the same thing, but not outright like Doug). Isnt everyone supposed to be honest in court, and isnt that what the judge expects? The guy deserved to lose, but how f***in weird of a reaction

    I don't agree. I think the Plaintiff should be responsible because he should have fixed the issue before bringing the car back. Especially since the car was out of his control. The Plaintiff is clearly trying to get free upgrades for his old car

    Specifically on those old Fords, there’s a rag material underneath the carpet that’s the padding and once the padding gets wet, it is almost impossible to dry it. Even if you leave it in the car with the windows, rolled up in direct sun for three weeks straight and it gets to be 135° inside the car that padding will hold onto the moisture and it will become so moldy that the smell will never leave.
    I have sold over 100 cars and pulled out seats, carpets and padding and all that stuff and some manufactures use foam that’s outdoor foam and does not absorb water
    But most of them use that old rag carpeting that holds onto water, and it becomes moldy
    So the old padding and the old carpet should’ve been replaced when he took out the seats because think about it, that’s a limo, a bunch of people have been in there-and vomited, spilled, leaked bodily fluids, etc.
    New Carpet & padding $500.
    Just get new carpet and padding. But, if the windows leak, and you can’t buy a $10 tarp???
    Or, put it inside.

    The defendant had a duty to keep the car protected while he had it. If his garage holds 25 cars thats all he should have at one time. The car shouldn't go outside untl its ready to be picked up. But 2k seems excessive.

    So, the defendant knew about the leak when he worked on it before, but was it his responsibility to know if the windows had or had not been repaired since the last time he worked on it? Why doesn’t the plaintiff bear any responsibility for telling the defendant that, “oh by the way, I haven’t had the window seals fixed yet so keep it inside.” Unfair ruling.

    The plaintiff knew the car leaked! If the car was at the shop for more than a few days he should have put a car cover on the car.
    Sure the defendant told the plaintiff the car leaked, but as the plaintiff said, the defendant mentioned it along with a list of things wrong with the car. The plaintiff dismissed it because he was choosing not to fix all those things.
    I'm sorry, but this is the plaintiffs responsibility. Now let's see if the judge can get it right in her ruling.

    Judge contradicts herself all the time. He had a old rug so he can expect a new but since he priced a new one he gets the price of a new one. That guy gonna cut up some old rug and tack it down in that old limo.

      The premise of "making you whole" in the law, is dependent on the facts of each individual case. There are certain circumstances, where something can't be fixed, or replaced with something used or of an equivalent value, and then the option becomes to replace new and that burden falls on the person who caused the damages, regardless if it costs more. There are a lot of factors that go into it and it's left to the discretion of the Judge.

      @@VladmirPoopN No, I didn't. Two things can be true at the same time. The Judge has contradicted herself many times, that's just a fact. So I was agreeing with that statement in general, not in reference to any case specifically and I never gave my personal opinion on this case. Just because I've noticed that she has contradicted herself quite a bit and I acknowledge that fact, doesn't mean that I automatically expect her to do so every time. That's ridiculous. Besides, in order for her to even be contradicting, she would have to be right part of the time. Otherwise, there would be nothing to contradict in the first place. And my first comment was just explaining how the law works and how there are nuances that the Judge takes into consideration when making a ruling and in those circumstances, it doesn't make it contradictory.

    When the shop was done with it that day, why in the h_ll didn't the owner come and get it, knowing that it leaks, and go put it in his own stupid garage! The shop doesn't have room when they have 30 other cars to get working on! The limo is a used piece of property owned by one person-the owner! It would have different if the owner and shop would have agreed to leave it in the shop for a few more hours until the owner can come and get it. Totally on the owner, the shop is not a baby sitter!

    I think the plaintiff should also bear some responsibility, he was told the windows leak, he should have had his windows fixed. Hope his friends are smart enough to travel in it during heavy rain or snow, you would be getting a cold soggy ride.

    Body man made a mistake because he knew the window seals were bad. He should have kept that quiet. Once he knew about thge seals he had a higher stanndard of care to make sure the car was covered from rain.
