Being Careless with a Car

- The plaintiff brought his vehicle into the defendant’s shop for work. Unfortunately, the plaintiff claims the defendant left the vehicle outside during a snowstorm, and now it needs new carpeting, so the plaintiff is suing. The defendant claims the damage isn’t his fault because the plaintiff didn’t alert him about pre-existing issues with the vehicle.
First time I've ever seen Doug get a little rattled after the defendant asked him how he was doing 😂
"Rattled" not "raddled".
😂
I thought the plaintiff was being stupid until the defendant admitted he had told the him that the windows leaked bad. If that is a known factor then the defendant should have made arrangements to keep the car inside. If he couldn't get to it for a month tell the defendant to come get it and bring it back on a day when it can actually be worked on.
The plaintiff already knew it leaked as well! It's his car! If the car was at the shop more than a few days he should have covered the car with a car cover. Or talked to the defendant and asked him to keep it inside. Though that is a big ask for a busy garage.... especially for a limo!
I agree and I'm glad the plaintiff won. The defendants admission "I told him the windows leaked like a sieve" is why he loses the case. It's based on the legal definition of "reasonable care". He had a duty to the plaintiff to bring it inside, put a car cover on it or call the plaintiff and tell him to bring it back another day. Total negligence.
@@MrCharlesEldredgeexactly. Why was all the responsibility placed on the defendant. If it was my car the first thing out of my mouth would have been, “It’s going to be kept inside right?”
They ALL knew the windows leaked because that's what the floor needed replaced in the first place
I agree the plainitff should have said that but 100% legal liability is the defendants because his admission that it "leaked like a sieve" was when the car was in his shop. @@traceyaz125
If the people on the streets are a representation of American intelligence, then we're in big trouble.
Bingo that's majority! They have kids, they vote, the have jobs and perform jury duty! Don't ever catch a case!😂
I know right? It's incredible, and it would be hilarious if it wasn't truly sad.
Facts
Should a group of people who seem to have their own issues with grammar and punctuation judge the intellectual abilities of others?
That’s every country in the world- and obvious.
Defendant is honest. Lucky for the plaintiff too.
Once again I liked both parties. Wish they could have worked it out on their own.
What the hell, Doug? Trying shame the defendant for telling the truth & not perjuring himself? What a fool you are, Doug!
So proud of the defendant's response, "Truth!" Gives me hope for this world!
"I told him the windows leak like a sieve!" 😖🤦♀️
😂😂😂😂
I've never seen her take into consideration that a plaintiff wasn't planning on buying a new whatever to replace what was damaged. And also never saw her give full replacement value. What the!
The defendant messed up royally.
How did you miss this??
It would be different if the Defendant didn't know the windows leaked. However, he knew and still left it uncovered. Had he not known, that would be different. A person would assume a car/limo to be water tight. I mean if your windows allow that much water inside, there's an issue. But, the Defendant knew and that makes all the difference.
Definitely the deciding factor in this case!
Why didn't the plaintiff get his windows fixed?
@@mickm6309 That would have been really smart unless he thought he would never see any rain!!!
Plaintiff knew too! And it's his car!
Exactly. The decision is correct. The defendant had a legal duty to exercise "reasonable care".
Harvey: No one is listening to me URG!
Me: you just got that now?
I applaud the defendant for his honesty. The world needs more of this. People should go to his shop because it’s not easy to find an honest mechanic. I’m sure he will do better about protecting vehicles in the future, but at least you know, he’s honest.
Been watching for a long time. I think the best entrance ever was when the three plaintiffs entered, walked up to the plaintiffs side and then turned their backs to the camera and faced the gallery of people. The gallery just looked in awkward silence. Josephine told them to turn around. (That was the bailiff before Douglas).
Wadd are ya gonna do? Take me out on a fishing boat like Freddo 😂😂😂😂😂😂😂
I had this exact situation except my limo is a Cadillac. Yes they can leak in heavy rain. When they are at the shop, they should check on it and cover it with a tarp if needed. In my case, homeless people actually moved into it! The customer has no control over that when it is in the shop's possession.
So now you can feel good about helping the homeless!
@@LoveChild71
ahahahaha lolololol 😂😅😂
Fred Flintstone...giggle
I like both of them. They are both honest!!!
Plaintiff has Shemp from the 3 stooges hair cut 😅.
AS THE SPANISH SAYING GOES “El pez 🐟 por su propia boca 👄 muere” “( the fish 🎣 dies by its own mouth 👄)” it applies perfect to this case
"Hoist with his own petard" ... English saying from Shakespeare. I love idioms! Thanks for sharing that Spanish one. x from Canada
maybe if the plaintiff wakes up, he can speak
The car was originally wet and leaking. The defendant told the plaintiff it leaked. Didn't the plaintiff have a responsibility to take care of the seals? And, where did the plaintiff store the vehicle since it was full of water to begin with?
"Why did the Plaintiff originally walk on the Defendant's side?" Not too bright 😮.
This is why you answer the question and don't add anything extra. It is the same reason that your lawyer will tell you never talk to cops. It is easy to slip up and say something that hurts your case.
RIGHT!
You mean be dishonest and don't tell the truth? What happened to morals? You should treat every situation as if God was standing next to watching, bc He is!
But it’s better that the truth came out. Not better for the defendant but better for our world. Honesty is best. Let true justice prevail- and if the defendant hadn’t been honest the plaintiff would not have gotten justice.
Chill out, Harvey! 😂😂😂
Found it weird that Doug told the defendant he should have kept his mouth shut outright (and JM kinda implied the same thing, but not outright like Doug). Isnt everyone supposed to be honest in court, and isnt that what the judge expects? The guy deserved to lose, but how f***in weird of a reaction
The plaintiff probably had text stating the defendant told him anyway.
Because he should have. Duh?
I don't agree. I think the Plaintiff should be responsible because he should have fixed the issue before bringing the car back. Especially since the car was out of his control. The Plaintiff is clearly trying to get free upgrades for his old car
Specifically on those old Fords, there’s a rag material underneath the carpet that’s the padding and once the padding gets wet, it is almost impossible to dry it. Even if you leave it in the car with the windows, rolled up in direct sun for three weeks straight and it gets to be 135° inside the car that padding will hold onto the moisture and it will become so moldy that the smell will never leave.
I have sold over 100 cars and pulled out seats, carpets and padding and all that stuff and some manufactures use foam that’s outdoor foam and does not absorb water
But most of them use that old rag carpeting that holds onto water, and it becomes moldy
So the old padding and the old carpet should’ve been replaced when he took out the seats because think about it, that’s a limo, a bunch of people have been in there-and vomited, spilled, leaked bodily fluids, etc.
New Carpet & padding $500.
Just get new carpet and padding. But, if the windows leak, and you can’t buy a $10 tarp???
Or, put it inside.
I was waiting for the "Flintstone" remark and Judge M did not disappoint! :P
Plaintiff should spend the money and FIX THE SEALS on the windows. Cheapo.
The Defendant shot his self in the foot 😂😂
The defendant had a duty to keep the car protected while he had it. If his garage holds 25 cars thats all he should have at one time. The car shouldn't go outside untl its ready to be picked up. But 2k seems excessive.
Same thing happened to me with my 1965 Impala when I took it for a tire change and I got it back with a section of the floorboard missing.
So, the defendant knew about the leak when he worked on it before, but was it his responsibility to know if the windows had or had not been repaired since the last time he worked on it? Why doesn’t the plaintiff bear any responsibility for telling the defendant that, “oh by the way, I haven’t had the window seals fixed yet so keep it inside.” Unfair ruling.
JM is my spirit animal
The defendant should have put parts over the windows, it would have cost like $200.
bro what's with that hair on dude behind the defendant talking to doug hahaha it's like a guido turban 😂
🤣🤣🤣🤣 I hadn't noticed that until I read your post and went back. That is one COOL hairdo, or is that a Hair don't!!!!!
He's wearing a Jewish beanie. I forgot what it's called. Something like yamikka
Oh my gawd. Those people in the square are such bird brains.
plaintiff is an absolute ray of sunshine
Boy, did that turn around fast.😮
How do you feel ? 😂😂😂
Harvey threw a temper tantrum.
you have to have a certain adhesive for carpet
Lol cars are outside all the time....
But dude knows his car windows leak...
IN LISTENING TO THE OPENING ARGUMENTS I WAS THINKING OK YOUR VEHICLE YOUR PROBLEM TIL THE TWIST THE DEFENDANT TOLD THE PLAINTIFF MEANING HE WAS AWARE OF HOW BAD IT LEAKED SHOULD'VE KEPT IT INSIDE / TEXTED HIM COME GET IT BECAUSE OF THE BAD LEAK THEN HE WOULDN'T HAVE HAD TO PAY SMH BUT @ LEAST HE WAS BEING HONEST I THOUGHT HE WAS GOING TO DENY IT GOOD CALL
So if he knew the first time it leaked and choose not to fix it he knew the hazards of not fixing it.
The way this started, it has to be a great case!
The people on the street with Harvey make me have zero faith in humanity
The plaintiff knew the car leaked! If the car was at the shop for more than a few days he should have put a car cover on the car.
Sure the defendant told the plaintiff the car leaked, but as the plaintiff said, the defendant mentioned it along with a list of things wrong with the car. The plaintiff dismissed it because he was choosing not to fix all those things.
I'm sorry, but this is the plaintiffs responsibility. Now let's see if the judge can get it right in her ruling.
Edit: Ridiculous ruling!
Judge contradicts herself all the time. He had a old rug so he can expect a new but since he priced a new one he gets the price of a new one. That guy gonna cut up some old rug and tack it down in that old limo.
The premise of "making you whole" in the law, is dependent on the facts of each individual case. There are certain circumstances, where something can't be fixed, or replaced with something used or of an equivalent value, and then the option becomes to replace new and that burden falls on the person who caused the damages, regardless if it costs more. There are a lot of factors that go into it and it's left to the discretion of the Judge.
Although, I do agree with you that she has a really bad habit of contradicting herself, particularly on very basic things that she shouldn't get wrong.
@@sashabenoit1518you literally contradicted yourself.
"The judge contradicts herself, but THIS time she didn't; even though she does it all the time."
The defendant messed up royally.
How did you miss this ? 🙈
@@VladmirPoopN No, I didn't. Two things can be true at the same time. The Judge has contradicted herself many times, that's just a fact. So I was agreeing with that statement in general, not in reference to any case specifically and I never gave my personal opinion on this case. Just because I've noticed that she has contradicted herself quite a bit and I acknowledge that fact, doesn't mean that I automatically expect her to do so every time. That's ridiculous. Besides, in order for her to even be contradicting, she would have to be right part of the time. Otherwise, there would be nothing to contradict in the first place. And my first comment was just explaining how the law works and how there are nuances that the Judge takes into consideration when making a ruling and in those circumstances, it doesn't make it contradictory.
When the shop was done with it that day, why in the h_ll didn't the owner come and get it, knowing that it leaks, and go put it in his own stupid garage! The shop doesn't have room when they have 30 other cars to get working on! The limo is a used piece of property owned by one person-the owner! It would have different if the owner and shop would have agreed to leave it in the shop for a few more hours until the owner can come and get it. Totally on the owner, the shop is not a baby sitter!
I can tell by a lot of the comments that people really dont know the law, lol!
not 1 word about fixing the leaks;
The people that stopped to watch and answer Doug's questions are complete idiots most of the time. They'll probably end up on the show.
When you're called fredo you're being called a weak and stupid
The floors woukd mot have needed replaced originally if they windows diddnt leak so they ALL knew about the windows from day 1
The huge guy in the navy blue hoodies is hot wow
I think the plaintiff should also bear some responsibility, he was told the windows leak, he should have had his windows fixed. Hope his friends are smart enough to travel in it during heavy rain or snow, you would be getting a cold soggy ride.
Body man made a mistake because he knew the window seals were bad. He should have kept that quiet. Once he knew about thge seals he had a higher stanndard of care to make sure the car was covered from rain.
You can tell who doesn't watch this show when they enter and go to the wrong lectern.
You can tell she didn’t want to give the guy anything 😂😂 if she would let more people on her show talk, they would win 😒
If more people got to the point, sticked to the facts, and stopped editorializing, she would let them speak. The "story" doesn't matter. The facts matter.
Haha😂...
Wow I didn’t expect that ruling
The defendant messed up royally.

He said he knew the seals on the car windows were horrible but still left the car outside causing the damage
How simple are you?
Man, I was/am so stoned right now... but a car should be rain proof, no? Isn't that the whole idea? There's no reasonable expectation of the car being parked indoors. What a faux ruling.
You pot head.

$2000 for old carpet? How simple and thick are you? How often do you see her give someone the full value of anything when it wasn't new? He deserved compensation but definitely not $2000 at all.
