Thanks a lot for this information ,this clarify the incident I have 4 days ago when a police officer pullover me for a minor traffic violation,and when he ask me for my DL he notice my CWL, and ask me if I I have a firearm with me I told him yes and the weapon was located in my waist and in a very nice way ask me to step out of the car,, he check the firearm, and never write a ticket just a warning.,icontinuing my trip.
If an officer asks me if I have a weapon I always say "Yes I do, it is in my center console, a closed container, and I will not be opening it as my license is in my door and my registration is in my glove box, would you like me to get them?" . I have had officers ask to see my gun to "Run the numbers" or "make sure its legal". I have denied all of these requests and even said I would be happy to speak with him about the stop behind my car or at his car if he would feel safer. One cop said yes he would feel safer. I got out, locked the doors behind me, and we spoke. The bottom line is be respectful and calm,.
Stopped in rural Oregon. "Officer I am a concealed carry permit holder. I have a pistol on my right hip. My wallet is in my left back pocket. What would you like me to do." The officer replied "are you going to shoot me son?" I say "of course not". The officer says again in a calm voice "license and registration and insurance, please". Colorado Springs... got my nephew out the car, came in through the passenger side and disarmed me. On and on. No telling with police sometimes.
I find it a little concerning that if I choose to provide my drivers license along with my concealed carry permit, the officer is allowed to "secure" me in handcuffs and to top it off, the officer can then go in to MY vehicle and retrieve MY property. I know you implied that in most cases the officer will probably not go to that extent but I still find that it is worth mentioning how odd that is. Thanks for the information. I will just keep my mouth shut unless asked if I'm carrying.
I have always kept my dl, insurance and carry card in the same place....I make sure to have it out before the officer walks to my vehicle...even if it means riding the brake for an extra block Untill i have all my paperwork taken out from the spot I leave it in and remove my firearm from myself and put it into a console or glove box. (before I come to a complete stop.) I make sure to have the paperwork in my hand and both hands on the top of the steering wheel...now the same conversation happens but in different words every time...(20 years of carrying concealed and probably pulled over 40 times lmao) all of the florida police have asked me to exit my vehicle to step out of my vehicle to separate me from my firearm...just be polite and do as asked because these people who work as police officers risk their lives to support their families and want to go home every day/night to see them....if you happen to be stopped by a crooked one...yes there is crooked law enforcement...he or she isn't going to mess with you if you follow by their rules ...they only extort the criminals not the person who hurried up to make it through the yellow light...be safe all ✌

Some things you do because you have and other things because it’s the smart thing to do under the circumstances. When traveling, I keep the paperwork, including my cwp, in the visor. I always advise the officer that I have a cwp and that I have a sidearm on my hip ( never say GUN) and my paperwork is in the visor. Other than holding the pistol for safety during the stop there is no reason to give him permission to search the vehicle or to answer questions. It’s easier and smarter to be polite than getting shot. In SC we have to disclose the cwp and that we have a firearm.
In New Jersey it is unlawful for anyone to carry any type of firearm on them if the said person is not a LEO. There are only 1200 license to carry holders in the state of NJ and they are all retired LEO's. Also in some cities (Newark, Camden, Paterson) simply having a CWFL from another state is ground for a charge of conspiracy to commit pre-meditated murder. Also the Governor just singed 5 new laws into effect and one of them is that if you are a military veteran that was deployed to any theater of combat then the law presumes that you have PTSD and are therefore under a disability that automatically disqualifies you from possessing any type of dangerous weapon (Weather lethal or non-lethal) due to you now being a danger to public safety.

I'd suggest drivers stay calm, speak slowly/clearly, do use slang, profanities or humor, if you have a knife or weapon; don't fidget or shift around. let the trooper or officer lead the conversation, that way he/she will feel safe & inform any back up or assisting units of your ccw gun. handgunlaw.us is very helpful.

In Georgia, Courts have ruled that a traffic stop does NOT give a LEO "carte blanch" authority to seize firearms during the duration of the stop unless the officer has reasonable articulable suspicion that an additional crime, outside of the reason for the traffic stop, has happened or is about to happen. Any seizure of a firearm outside of that is a 4th Amendment violation. Sounds like some lawsuits need to get rolling in Florida for LEO's that temporarily seize lawfully possessed firearms during traffic stops under the guise of "Officer Safety" or whatever other BS they come up with.

Not sure if this helps, but this is how I handle it. Pull over, put the car in park, put my hands on the steering wheel in plain view and wait for him to engage me verbally. At that time he will have told you why he is stopping you and I say, I am a valid CCW holder and my gun is on my right hip ( or wherever it is...I NEVER put my gun in the glove box or console ) I am telling you this as a courtesy so things will go smoothly during this stop. He will instruct you as to how he wants to handle it but most just have said, you dont reach for yours..I wont reach for mine...and they proceed with doing their job. I did have a guy asked me to get out of car and he asked me if it was ok for him to disarm me during the stop...I told him sure and followed his instructions. Just make sure you keep your hands where he can see them and follow his commands. I drive too fast so im no stranger to being stopped but I have never had a cop be anything but polite and appreciative of the heads up I gave him. Keep in mind that by showing him your permit to carry, he knows you are not a criminal.

I let the officer make whatever statement he wants to open with and then immediately verbally identify as CWP and then get needed documents out under his direct supervision. Never had a problem.

A civil traffic ticket does not give police the right to take your gun. Civil and Criminal are 2 different things . Police cannot arrest you on a civil violation or take your gun .

Wrong. No 2 or 3 step rule. Make sure firearm is encased, holstered, glove box, console not readily or easily accessible. Loaded or unloaded. No permit required for firearm in your vehicle, not on your person. Check out FS 790.025 for more.
Many states require you to inform the officer you have a CCW when you are first stopped. Regardless of the law, it is good common sense to always infom the officer.

I was stopped one night for making an illegal right turn on a red. Pulled over, turned the engine off and my dome lights on. I had three rifles in cases set in the front seat and my 1911 secured in a holster below the rifles. LEO came up to the drivers window and asked for my papers. When he returned to my car and gave me my papers back he noted my firearms. "You have guns! You supposed to tell me you had guns in the car." I said "I've discussed with some LEOs I know and they all agreed that if the first words out of my mouth is 'Officer, I have a gun,' that most would take that as a threat. You asked me if I had firearms and I promptly answered your question." He paused in thought and said "Have a good evening."
If I recall correctly, it's not a crime to not tell an officer you have a firearm. This includes if the leo asks. Its breaking an ordinance which is punishable by a $25 fine to the clerk of the court. Not exactly a big threat there. I keep what I have private. It's not their business what I have. They might believe it is, but it's not.
thats a good question and I'd like to hear the answer....i am completely unaware of how that would go down tho since I either drive myself or remain seated in the back seat of a taxi or towncar since I have been of age and legally carried a weapon.
Before a cop pulls you over he or she already knows if its felony stop because they already ran your plates before you are stopped and if the registered owner is a felon there already on edge.

Simply informing an officer of your possession of a firearm does not by virtue give him the acrticulable cause to enter your vehicle without consent, in the name of "officer safety"... the officer would need to have reasonable suspicion that a crime is/has/or is about to be committed based on the preponderance of evidence available... basically the officer would need to suspect you of illegally being in possesion of the firearm based on the facts at hand... he cannot simply speculate the firearm is being illegally possessed... or he would need reasonable suspicion of ANY other crime to gain access to search your person/papers/vehicle PRIOR to the search. This is well supported by case law and the supreme court... shocking you didn't know that. "Officer safety" is one of those ambiguous & open ended phrases law enforcement & prosecutors hang their hats on... and fortunately for us (the people) such a subjective phrase has not been validated or recognized by our courts... every case is based on the circumstantial evidence.

For one, you can't "frisk" a vehicle.. that would be called a SEARCH... and that can not be done without R.A.S. or probable cause... that being said, the ONLY thing an officer can do WITH R.A.S. is pat someone down for weapons, WHILE investigating them... granted they already have R.A.S. prior to the frisk/pat down... a frisk/pat down is OUTSIDE the pockets and does not allow the officer to search your bags, pockets, nor vehicle... educate yourself young one.

The main reason you never tell a police office that you're carrying a weapon (if he doesn't ask you)...is because if it happens to be a fake cop who stops you. Right away you gave your most powerful leverage away. And yes...some people do dress up as cops and drive a car with lights on it...but they are NOT cops. They are pretending to be cops and have bad intentions. I repeat...DO NOT give information away that was never asked of you (for your own safety and protection). A private vehicle is your own private property. If a police officer came to your private residence...would you tell him you have a gun in your house...just to let him know? NO!!!! Neither should you do it when it is your own private vehicle.
Don't hold your wallet with your firearm, no need to inform in Florida for firearm, but you can tell as well, just in case they tell you to step outside, and if they see it on your hip

I got the first ticket in 47 years in Florida last fall. I was at fault. I gave the trooper my DL and my CCW permit from Missouri. He asked me where the gun was, I told him my right front pocket. There were no problems of any kind and I kept both hands on the top of the steering wheel. It was cordial, and I told the officer right off I was was at fault- I had passed a traffic stop without slowing down properly. The trooper returned my papers, I shook his hand and apologized....still got the ticket, but no problems other than my inattentiveness which is why I was stopped in the first place.
So you got money stolen, extorted, pirated, etc. from you for committing a "crime" in which there was no actual victim. Even after being nice and stroking his thieving ego, you were still basically robbed... So, yeah, this is why Police are viewed as thieves, pirates, tax collectors, etc. Far from hero's.
The majority of the time, all a cop wants to do is give you the ticket and go. Since you do not have to declare anything, why put them on a more heightened sensitivity? You cannot say that it relaxes them since even on the video, there is more procedures such as getting removed, disarmed and the work that goes behind that. It is just best to be nice to the officer and get the ticket and leave. No need to add to the excitement. That's what I've always done. Obviously, if your information he asks is next to the gun, then that would be the only time that I would inform him and then go through the whole show that most likely will happen.
John R it doesn't have to. I've had three interactions with police since obtaining my CWP and have never been disarmed. Only one even asked where my weapon was located. I do live in a state that has a requirement to inform the officer and that may have something to do with it. There really should be no reason for anything to change because you told the officer you were legally carrying.
Michael Carnes your right. I forgot some states have that requirement. Mine doesn't. Either way, If I don't have to, unless it's going to be revealed, I wouldn't bother, but you make a good point. Always best to follow the laws.

B.s .......letting an officer know you are armed and have a permit will only get someone like me in more trouble use to happen all the time when I was doing my paper route......had a cop pull me over when I was in the left hand turning lane waiting for traffic well waiting for when it was safe for me to go I made a left turn a u turn the cop put his lights on when he approach my car advised him he had no reason to pull me over and asked him what he wanted he then said he though I was broke down mind you I have the whole thing re tired on tape from my front camera and back camara my reply was really if that was the case why did you not place on your overheads and approach me while I was waiting to make the turn he did not answer cause he know he was lieing he then said I was free to go I said I know that since this is an unlawful traffic stop but he did not know he was on tape the whole time I hate bad cops really make a it hard for good ones out there

I am more concerned with my safety, not theirs. Concealed carriers are one of the most law abiding groups in the US, even more than police officers when comparing some gun crimes. The truth is, if you're not a criminal, you have an infinitely greater chance of being shot and killed by them than you do of shooting and killing them.

I don't believe that's true, I've been pulled over by the police since I've had my conceal carry permit and the officer never asked me if I had any weapons with me during the stop.

With all the police getting shot by traffic violators, I can understand their extreme caution.

I drive too fast so im no stranger to being stopped but I have never had a cop be anything but polite and appreciative of the heads up I gave him. Keep in mind that by showing him your permit to carry, he knows you are not a criminal.

I let the officer make whatever statement he wants to open with and then immediately verbally identify as CWP and then get needed documents out under his direct supervision. Never had a problem.

Many states require you to inform the officer you have a CCW when you are first stopped. Regardless of the law, it is good common sense to always infom the officer.

Your common sense seems to be based on the (false) myth that cops get killed all the time. A cop's death is a quite rare event, that's why many times reaches the news. Law enforcement is NOT even among the top 10 occupations in the US by death rate. Furthermore, among the causes of on duty cops fatalities, the most frequent ones are car accidents (all day behind the wheel) and heart attacks (diet?). So the belief that they fear for their life is a lot of BS.

I was stopped one night for making an illegal right turn on a red. Pulled over, turned the engine off and my dome lights on. I had three rifles in cases set in the front seat and my 1911 secured in a holster below the rifles. LEO came up to the drivers window and asked for my papers. When he returned to my car and gave me my papers back he noted my firearms.
"You have guns! You supposed to tell me you had guns in the car." I said "I've discussed with some LEOs I know and they all agreed that if the first words out of my mouth is 'Officer, I have a gun,' that most would take that as a threat. You asked me if I had firearms and I promptly answered your question."
He paused in thought and said "Have a good evening."

If I recall correctly, it's not a crime to not tell an officer you have a firearm. This includes if the leo asks. Its breaking an ordinance which is punishable by a $25 fine to the clerk of the court. Not exactly a big threat there. I keep what I have private. It's not their business what I have. They might believe it is, but it's not.

Before a cop pulls you over he or she already knows if its felony stop because they already ran your plates before you are stopped and if the registered owner is a felon there already on edge.

Simply informing an officer of your possession of a firearm does not by virtue give him the acrticulable cause to enter your vehicle without consent, in the name of "officer safety"... the officer would need to have reasonable suspicion that a crime is/has/or is about to be committed based on the preponderance of evidence available... basically the officer would need to suspect you of illegally being in possesion of the firearm based on the facts at hand... he cannot simply speculate the firearm is being illegally possessed... or he would need reasonable suspicion of ANY other crime to gain access to search your person/papers/vehicle PRIOR to the search. This is well supported by case law and the supreme court... shocking you didn't know that.
"Officer safety" is one of those ambiguous & open ended phrases law enforcement & prosecutors hang their hats on... and fortunately for us (the people) such a subjective phrase has not been validated or recognized by our courts... every case is based on the circumstantial evidence.

For one, you can't "frisk" a vehicle.. that would be called a SEARCH... and that can not be done without R.A.S. or probable cause... that being said, the ONLY thing an officer can do WITH R.A.S. is pat someone down for weapons, WHILE investigating them... granted they already have R.A.S. prior to the frisk/pat down... a frisk/pat down is OUTSIDE the pockets and does not allow the officer to search your bags, pockets, nor vehicle... educate yourself young one.

The main reason you never tell a police office that you're carrying a weapon (if he doesn't ask you)...is because if it happens to be a fake cop who stops you. Right away you gave your most powerful leverage away. And yes...some people do dress up as cops and drive a car with lights on it...but they are NOT cops. They are pretending to be cops and have bad intentions. I repeat...DO NOT give information away that was never asked of you (for your own safety and protection). A private vehicle is your own private property. If a police officer came to your private residence...would you tell him you have a gun in your house...just to let him know? NO!!!! Neither should you do it when it is your own private vehicle.

I got the first ticket in 47 years in Florida last fall. I was at fault. I gave the trooper my DL and my CCW permit from Missouri. He asked me where the gun was, I told him my right front pocket. There were no problems of any kind and I kept both hands on the top of the steering wheel. It was cordial, and I told the officer right off I was was at fault- I had passed a traffic stop without slowing down properly. The trooper returned my papers, I shook his hand and apologized....still got the ticket, but no problems other than my inattentiveness which is why I was stopped in the first place.

The majority of the time, all a cop wants to do is give you the ticket and go. Since you do not have to declare anything, why put them on a more heightened sensitivity? You cannot say that it relaxes them since even on the video, there is more procedures such as getting removed, disarmed and the work that goes behind that. It is just best to be nice to the officer and get the ticket and leave. No need to add to the excitement. That's what I've always done. Obviously, if your information he asks is next to the gun, then that would be the only time that I would inform him and then go through the whole show that most likely will happen.
John R it doesn't have to. I've had three interactions with police since obtaining my CWP and have never been disarmed. Only one even asked where my weapon was located. I do live in a state that has a requirement to inform the officer and that may have something to do with it. There really should be no reason for anything to change because you told the officer you were legally carrying.
Michael Carnes your right. I forgot some states have that requirement. Mine doesn't. Either way, If I don't have to, unless it's going to be revealed, I wouldn't bother, but you make a good point. Always best to follow the laws.

B.s .......letting an officer know you are armed and have a permit will only get someone like me in more trouble use to happen all the time when I was doing my paper route......had a cop pull me over when I was in the left hand turning lane waiting for traffic well waiting for when it was safe for me to go I made a left turn a u turn the cop put his lights on when he approach my car advised him he had no reason to pull me over and asked him what he wanted he then said he though I was broke down mind you I have the whole thing re tired on tape from my front camera and back camara my reply was really if that was the case why did you not place on your overheads and approach me while I was waiting to make the turn he did not answer cause he know he was lieing he then said I was free to go I said I know that since this is an unlawful traffic stop but he did not know he was on tape the whole time I hate bad cops really make a it hard for good ones out there

I am more concerned with my safety, not theirs. Concealed carriers are one of the most law abiding groups in the US, even more than police officers when comparing some gun crimes. The truth is, if you're not a criminal, you have an infinitely greater chance of being shot and killed by them than you do of shooting and killing them.
