@AdrianOtw Legality. The legality of who is competent to declare war varies between nations and forms of government. In many nations, that power is given to the head of state or sovereign. The official international protocol for declaring war was defined in the Hague Convention (III) of 1907 on the Opening of Hostilities.
I.e. War can both be declared legally and illegally.

The droid correctly deduced that it was a trap, if the lawyers can prove to a jury that the droid had reasonable evidence to suggest a false surrender, then they can prove that anakin was ambushing them under the pretence of surrender. Even then, just because the droid ordered to fire, the intent from anakin was still a war crime, he attempted to carry it out, I assume there are charges for attempted war crimes but I’m not actually sure.

This is because B1 battle droids offload unnecessary data in the form of speech, so they can free their processors to do important things. I’m doing so, other B1s hear that information and while they don’t understand the full situation, collectively as a hive mind they become more tactically aware like with ant pheromones.
However, when Anakin says “hold your fire”, a battle droid used to the absent chatter of its compatriots is more likely to obey - mostly because they understand that listening leads to smarter decisions. Unfortunately this does lead to a gap in their offense, but overall it’s an interesting development in droids.

Dishonorable acts do not engender peace. The Geneva Convention just puts that universal concept into writing.
The point I'm making is that any setting which has war would surely have some sort of rules of engagement. Otherwise, war could never end.

I understand why it's considered a war crime to do this, but I too did not see the problem until I read the comments. Though, for me I still see little reason to not do it if it works. There are no rules of war. There are only the victors and the defeated. Power dictates. I understand later legitimate surrender will be problematic, but the goal is to win. Why worry about losing except in the case of it being the plan or a step to fight another day (a chance to win later). Furthermore, in this case they are only droids, non-life. Just destroy them all, so that this new tactic is not discovered by the rest of your opponents.
I can understand that you may lose men on your side that might've been freed back into the war effort. That's the only real concern, loss of manpower, but if it can be avoided and still have this tactic, then that's great. To clarify, I would not consider it to 'work' if you lose too many men. Keep in mind that soldiers fight willingly (usually). Unless they didn't sign up for it, their lives are offered and may be demanded. It's called sacrifice, and they should know it if they are on the battlefield.
Granted, I probably would not use this tactic except as a possible last resort in the case of a human enemy. I'm just pointing out that there has never been and never will be any secured rules or fairness in war no matter how many tears are shed, how many suits talk, or how many honorables participate.
