Yeah, cops can tell the difference between someone high off their ass being fidgety and someone being animated when stressed. Given the amount of people they interact with on a daily basis, no doubt they’ve met plenty with anxiety that they can understand. You would only fail if you gave them an indicator that you’re intoxicated and trying to do something you’re not supposed to do when under the influence. Your anxiety won’t be that reason. Just see all the arrest videos where people are like “I’m so sorry, I have anxiety and am really nervous…”? All of them are under the influence. They’ll know when it’s used as an excuse to cover up their antics and when it’s actually genuine.
Same here. I actually got pulled over in a bad area, I didn’t know it was a bad area because I just moved. I thought it was just a cool marsh area. I was shaking and constantly moving so they ended up searching my car. The cop searching was super nice but the other kept telling me he knew I had drugs in my car. I didn’t and was let go with a traffic signal warning. I have a mild type of tremors that causes my hands to shake uncontrollably when nervous and in anyway upset.

Pretty sure if the officer didn't witness the infraction, he has no authority to conduct a traffic stop. They can't just show up at your house because someone said you were speeding, had a headlight out or ran a stop sign ect. They have to have witnessed the violation, especially in a non felony traffic infraction. It can be video or personally witnessing, but they can't rely of someone else. That guy should have refused to engage. He wasn't on the road or even in a vehicle. The most they can do is wait until he gets back on the road and look for a reason to pull him over. There's no justified traffic stop here. He had a right to remain silent and should have done so. He screwed himself by volunteering information. He was probably gonna be screwed anyway when he started driving, but there's not really a civil rights violation when you willfully waive your rights. Don't rely of the police to maintain your rights. Have an attorney.

Vets are a common venue for obtaining drugs. Years ago, we had a cat who could not cope with a new kitten, and he was prescribed Ritalin. When prescribed for animals, pharmacies charge far less than the "human" price. I think we paid like $5 for a bottle of 20-25 pills. I was not familiar with the stuff, but my daughters said those pills could fetch big money at their high school. We also had a cat with diabetes. The pharmacy did not even require a prescription for insulin, and the cost was just pennies.
Here’s a great example of not talking to the police. All cops got was a hear say complaint. He should’ve shut up and not said a word and gave consent to search his car, and they wouldn’t have been able to do anything.
I agree!! I think the reason there’s no info on this case is because either it was dropped completely or the guy got a good lawyer. He told them he was hard of hearing and they continued turning away from him while they were speaking or they would ask him a question and if he didn’t answer they took his silence as agreement. There was only hearsay, like you said, about reckless driving, they never saw him driving at all, and they decided to search the car??? It just doesn’t add up.

The guy was partially deaf, they tracked him down because someone called them and said he was “driving recklessly”, he was inside of a business and not even behind the wheel when they made contact! They assumed that he was “on somethin’”, and I realize that they did end up finding meth in his wallet and a bag with residue on the very bottom of the center console, but I’ve personally known many people with involuntary movement issues. Yeah, cops can tell the difference between someone high off their ass being fidgety and someone being animated when stressed. Given the amount of people they interact with on a daily basis, no doubt they’ve met plenty with anxiety that they can understand.
You would only fail if you gave them an indicator that you’re intoxicated and trying to do something you’re not supposed to do when under the influence. Your anxiety won’t be that reason.
Just see all the arrest videos where people are like “I’m so sorry, I have anxiety and am really nervous…”? All of them are under the influence. They’ll know when it’s used as an excuse to cover up their antics and when it’s actually genuine.

Same here. I actually got pulled over in a bad area, I didn’t know it was a bad area because I just moved. I thought it was just a cool marsh area. I was shaking and constantly moving so they ended up searching my car. The cop searching was super nice but the other kept telling me he knew I had drugs in my car. I didn’t and was let go with a traffic signal warning. I have a mild type of tremors that causes my hands to shake uncontrollably when nervous and in anyway upset.

Pretty sure if the officer didn't witness the infraction, he has no authority to conduct a traffic stop. They can't just show up at your house because someone said you were speeding, had a headlight out or ran a stop sign ect. They have to have witnessed the violation, especially in a non felony traffic infraction. It can be video or personally witnessing, but they can't rely of someone else. That guy should have refused to engage. He wasn't on the road or even in a vehicle. The most they can do is wait until he gets back on the road and look for a reason to pull him over. There's no justified traffic stop here. He had a right to remain silent and should have done so. He screwed himself by volunteering information. He was probably gonna be screwed anyway when he started driving, but there's not really a civil rights violation when you willfully waive your rights. Don't rely of the police to maintain your rights. Have an attorney.

Although this guy did deserve to go to jail, this is a really good example of the extent the police are willing to bend the law to get what they want. Dude admits to trying to open the safe without a warrent, which he just said he knew he needed, then laughs. Goes on to talk about how he wish the guy didnt ask for a lawyer. Good job on the arrest but we should really hold our police to a higher standard.

How about when he refused the search and they still did it anyway without a signed warrant or probable cause and he was on private property and was not driving at the time so the officers can't charge him DWLS.

Generally speaking though a 911 call in and of itself (particularly if it's anonymous) does not establish reasonable, articulable suspicion. However, RAS could have been established during the consensual encounter, it would ultimately be up to a judge and/or jury to decide

You can tell he was really looking forward to getting those meds. He was tweaking hard and probably coming down and needed something to help ease the withdrawals.

Vets are a common venue for obtaining drugs. Years ago, we had a cat who could not cope with a new kitten, and he was prescribed Ritalin. When prescribed for animals, pharmacies charge far less than the "human" price. I think we paid like $5 for a bottle of 20-25 pills. I was not familiar with the stuff, but my daughters said those pills could fetch big money at their high school. We also had a cat with diabetes. The pharmacy did not even require a prescription for insulin, and the cost was just pennies.

Here’s a great example of not talking to the police. All cops got was a hear say complaint. He should’ve shut up and not said a word and gave consent to search his car, and they wouldn’t have been able to do anything.
I agree!! I think the reason there’s no info on this case is because either it was dropped completely or the guy got a good lawyer. He told them he was hard of hearing and they continued turning away from him while they were speaking or they would ask him a question and if he didn’t answer they took his silence as agreement. There was only hearsay, like you said, about reckless driving, they never saw him driving at all, and they decided to search the car??? It just doesn’t add up.

THANK YOU!!! All these comments cheering the police were making me think I had slipped into a different universe! The guy was partially deaf, they tracked him down because someone called them and said he was “driving recklessly”, he was inside of a business and not even behind the wheel when they made contact! They assumed that he was “on somethin’”, and I realize that they did end up finding meth in his wallet and a bag with residue on the very bottom of the center console, but I’ve personally known many people with involuntary movement issues. So I think that was crap. Pretty sure that the reason there’s no more follow up info is either because it got dropped completely, or he got himself a lawyer to pursue a lawsuit 🤷🏼♀️
