    Thanks for the update. Reading Dr. Sharma's argument sounds good. That would help a veteran argue in favor of their claim - I would think.
    Hey, I was listening to Hill & Ponton and discovered that BIPAP requirement makes the veteran eligible for 80% disability rating and a mouthguard prescribed for sleep disorder is a 50% rating. I mention that because they were surprised to hear that info and thought I'd pass it on. I know you'll be checking to see if it's true.

      Thank you for being a member!!! Sleep Apnea is either central, mixed or obstructive. Obstructive is by far the most common.

    Thanks for this breakdown . So if someone does an intent to file now they can still get rated under the old scale as long as it’s in favor of the veteran. That’s great info .

      Correct. I thinks scenario 1 applies to most veterans and scenario 3 applies to those that wouldn’t benefit from the separation of ratings.

    I've had 0% service connected GERD since 2017 and just realized I should have been at 60% this whole time. I take 40mg omeprazole and it doesn't really even work well. If I miss my medicine, my like becomes wrecked...can't sleep, think, or be productive. Luckily, I submitted an intent to file last August to get my presumptive allergic rhinitis, so I'll be filing for an increase for GERD. Was worried that they would use the new criteria but glad to know they'll use whichever criteria is higher if I wait until after May 20 (which I plan to do). Saw my PCP in early March and now have a GI appointment for GERD in May 9, 2024. Wish me luck!

      GERD/IBS effective May 19. Everything else is still waiting. If your claim is heading to the Rator, then you will be based on the current system.

    I'm about to have to use the claim sharks..I was denied service connection on my supplemental. Claim for anxiety disorder secondary to tinnitus with my psychiatrist saying it was more likely than not caused by tinnitus And the C and p guy telling me he did it in my favor. Out of ideas

    For clarity, if I submit my claim in April and the new changes go into effect well before the VA makes a decision, I will fall under the old rating criteria? I have to SUBMIT after the changes?

      It’s when the claim is processed and decided. To be completely clear…
      If you submitted your claim on April and the decision is granted after May 19…then your rating will be both and the VA will take the higher.
      If that same claim is processed prior to, then only the old (current) rating schedule.

    I saw on a Facebook group where, if your claim was still “pending” after May 19, then the new rules would apply. Is that true or false? I filed on February 14 and my C&P is on May 14th. Where do I fall?

      You can submit the ITF now which would be most advantageous for your situation (my opinion). Then submit the claim after May 19. EZPZ scenario 1.

    For the pending removal of tinnitus as a condition to a symptom, if i have current tinnitus rating and have a secondary claim submitted already linked to tinnitus, would they deny my secondary or honor old rating structure? Im 3 months into my filing date.

      No. And the VA rates symptoms then ropes them under DCs. Meaning tinnitus will most likely be roped under DC 6100 which is hearing loss. So now those veterans with 10% for hearing loss with tinnitus is rated as hearing loss but that doesn’t mean you can’t submit secondaries to a symptom. The same rules apply.
      Anyone saying tinnitus is going away and secondaries to tinnitus are going away only reads the headlines versus reading the actual changes.
      I explain this more in-depth here and tinnitus can be roped under other conditions, not just hearing loss.

      VHV has a solid comment to this.
      One thing I will address is yes, hemorrhoids ‘could’ be secondary. As explained, these are not roped together (pyramid).
      So you can be rated for IBS. If your OBS has lead to your hemorrhoids, you can make the secondary claim. Assuming service-connection, you would then be rated for BOTH hemorrhoids and IBS.

      @@VAClaims-VHV There are multiple causes for hemorrhoid's 1. Eating a low-fiber diet. 2. Regularly lifting heavy items just to name a few.

    I have a claim in now for gerd and one for IBS, its been a year as of the end of this month.
    Will the VA hold my claim for the new reg's , don't what the hold up is, last update was in Oct.2023

      If your claim is processed and closed prior to May 19, 2024 then you would ONLY be rated off of the old (which as of right now is current) rating schedule. Meaning GERD/IBS will be roped together.
      If your claim is processed and closed after May 19, 2024 then you would be rated off of both rating schedules and the VA is forced to take the higher of the 2 ratings.
      So old could be GERD 10% and IBS 10% but you would only get one of those 10%s added to your overall rating. Then new would change that rating to having BOTH 10% ratings. So then the VA would go with the new. Unless the old (current) ratings is higher.

    I have 50% for flat feet. On February 2021 va now give a separate rating for plantar fasciitis under a different diagnostic code 5269 I have been diagnosed with bilateral plantar fasciitis should I file for plantar fasciitis.

    When you claim GERD, can you be granted IBS if you meet the criteria?

      Technically that answer is yes but the VA rarely adds claims. You’ll see that for Radiculopathy on lumbar claims.
      Simply put…if you want to claim both GERD/IBS, submit for both. Don’t leave it to chance. That goes for any claim.

    I just received a 30% rating for IBS with GERD today. However, like usually they screwed me on my effective date. It should've been 01/27/2021 instead of 12/13/2022.

      Effective dates are often missed when awarding service-connection. If you know the facts and believe this error, HLR for effective date. You can submit that online through va.gov and the whole submission takes about 5mins.

      As explained by Dr. Sharma and he makes a solid argument. I like how he uses the rationale the VA is using and provides his reasoning, too. I do think we will see more lower ratings of GERD (10%) and a lot less higher ratings of GERD (30%+).
      But…those with GERD usually have IBS, too. I do believe the overall changes to the GI body system is favorable for Veterans as a whole. Best to get your ITFs in now to be considered for both (Scenario 1 as discussed).
