@@janettepulido6393do well! Just be vulnerable and study the regulations as what conditions warrant the different percentages so you know how to frame what you are saying in relation to the percent that you want (hope that makes sense lol)

would be cool if you had your psychiatrist friend do a video breaking this down on a “hypothetical” veteran and their symptoms. For example, he could use a veteran suffering from PTSD/MST and how her current symptoms could juxtapose the new criteria for mental health.

I was just denied Mental Health for Severe Major Depressive Disorder secondary to pain from my knees and ankles from Jumping out of planes. I walk with a cane and knee braces. Yes I have been rated for my knees, I am waiting a decision for my ankles which were severely sprained in service as well as my lower back. I was also diagnosed with Chronic PTSD and Anxiety. I was diagnosed by 3 different VA counselors and a VA psychiatrist! I have been in treatment since 2021. I was prescribed and take meds daily for my depression and anxiety. I even submitted a nexus letter from an independant psychiatrist and my claim was denied...........Reason I was denied..........the rater said ...............there is no current diagnosis in my treatment records. My VSO read that and about lost it. Because of Civ Div and what I have learned just roll with it and keep fighting.

Been diagnose with ptsd and mdd, claim denied by va for not service connected, recent applied for insomnia and a c and p exam for mental health which I was already denied, how will this be handle for insomnia.

I’ve done CBT for the last 2 years at my VA. In the last year they have been inconsistent. I hate no call no shows, especially when it’s a VA Therapist. Currently rated at 70% for PTSD and this will bump me up 100% with ease. This new rating system has the potential to change many of our lives! When do you think this will take effect?

I had high hopes for your FB page and it was beneficial at first. And then…like every other social media VA site, it became inundated with the 2-year-service vets trying to link their hangnail from 30 years ago to their current OSA claim.
There is a huge need for a channel that focuses on transitioning Service members for BDDs and the 12 months after while everything is presumptive. TAP doesn’t provide it, and too many members wait past their 12 months presumptive time.

@AF-O6 my current problem is Clay was doing great bringing factual information out there. But any of these videos talking about the proposal is just click bait. Vba staff and senior va employees have received zero information on any implementation of these proposal. No va press release on this topic since February 2022. It's getting as bad as the other or our good buddy Brian Reese at vaci...

Hey Clay, I have a quick question I just can't seem to get an answer for. Up until recently I have been able to call in weekly about the status of my supplemental, mental heath claim. It doesn't reflect the status on va.gov, but it is in the decision phase.
My question is, up until last week the call center reps were able to tell me the status, but this week they told me that my "VA file is labeled as sensitive" & cannot view it.
What does this mean? I'm not a VA employee or have been working since I was let go during covid. Is this "sensitive" restriction because of my mental health?

Will there be a new DBQ for Mental health. I took the changes to my Psychologist and had her review it and list were i fell in the domains, according to her i would be 100% she rated me based on her assessment of me at 2, 3 ,3, 2, 1 but i am leery about filling for an increase with the new ratings as for now I am 70% and I dont want to be reduced

What if I had a moderate level of anxiety before the military but it got worse due to negative experiences in the military? Can I get a rating based on a condition I had prior to service that worsened as a result of service?

Wish once this takes effect I could just submit for an increase because I’m at 70 now for ptsd but according to new criteria I’d be 100%. I’ve been at 70 for ptsd since 2009. Wish they could just use the c&p notes from back then and see that according to new standards I would be 100%. Is this something that can be done or will a whole new c&p be needed? 🇺🇸🦅🇺🇸

Clay I am being reduced from 80 to 70 because it is illegal to have two breathing claims, sleep apnea 2003, asthma 2018 secondary to SA????
Those claims are roped together SA, Asthma and COPD.

How can I have a consultation with you?
OMG I have to tell you this, I just had a Higher Level Review and for head aches 30% to 50% and the examiner asking how the headaches made me feel and that why I got 30%. I ask her did they even look at my medical record? Because I know it says it in there, because I made sure my neurologist how my headaches make me feel and how they leave me. I mention that I hate the all the reviewer does is look at the DBQ to make there decision. She told me "we are not suppose to do that" ... We you did! Because I would think to look at my treatment records from the VA from my neurologist and not some NP or Nurse who doesn't treat me. We left it at that and she said they were going to look into to see if she could help me out. I took that as a denied, so now I have to do another Supplemental and wait even longer.
It be like that sometimes, you can go 1 step further and download your VA Health records, supply the notes from your Neurologist (like the exact pages that you linked/uploaded in that supplemental claim) + your migraine log etc on the Supplemental. That's how you setup yourself up for success bud.
Reason I say download your health records because that's the only way you can actually see with your own eyes what your "doctor" wrote in his notes. My psych notes for example say like, "veteran seems to be in good health today, no change in medications/continue therapy, etc etc". In this example, the veteran seems to be in good health today would work against me if I have many successive sessions with them stating the same shit even if during the meeting itself I was raging and talking shit with them.
But HIS notes are what matters. So make sure you've done your due diligence and read what your doctor actually writes in his notes as he's having that appointment with you. They're not going to just show you their screen. You have to download your medical data, which is done on the myhealthevet site I believe.
And to not be judgmental on the doctors side, they're usually following a script/answering questions on their sheet also(I forgot what it's called but I believe it's called an Encounter Log). Along with off the cuff conversations etc which they can also throw in their notes.

is there anyone that can help me with filing my disability claims? I submitted a supp claim last year and was recently denied due to lack of evidence. I have absolutely no idea what i'm doing and it seems like i'm going nowhere.
Talk with a Vet Rep like your County VSO, V.F.W., or D.A.V. to get your claims filed; I was seen in a Month and had my rating upped 20% for Tinnitus and Depression within 2 Months.
I was approved for SSDI in 2006, Parkinson’s Disease and Chronic Pancreatitis, recently found out I was eligible to apply for VA benefits for them being service connected, i.e. Parkinson’s due to TBI and chemical exposure, Chronic pancreatitis due to chemical exposure, I am 65 years old and worry that they won’t be able to find my military medical records since I retired in 1995 and they stopped sending records to the National Archives in 1990, any advice while I am waiting?
Hey Rickie, I would go to your local veterans services center and they can help you with past records. In Michigan, we have a veteran's service center in each county that has access to the VA system for disability claims, records search, and other veteran services. Good luck, my friend.
I’m going back to therapy after a two year break since my last therapist left. How long should I wait before filing for increase. I am hoping I can stick to one this time. I’m tired of therapists leaving.
Since these changes aren’t in effect, you’re doing what you’re suppose to be doing. Keep at it and keep an eye on these changes.

If you’ve already had a C&P for mental health but are waiting to be rated, are they going to send you to another C&P if you’re not rated before the new criteria goes into effect? Or are they just going to rate from your current C&P results?

It was a good idea but no one knows about it and tbh it doesn’t matter. I’m a fan of HLR with an informal conference.

If I had a telemedica nexus and they rated me “70%” should I just assume a rinse and repeat at my c&p and should get that!?
I wouldn’t ‘assume’ that but essentially the same evidence and self-reports used for the 70% would be the same discussed during your C&P exam.
That’s the rating. Service-connection is a whole other ball game.

Speaking to a social worker doesn’t warrant an increase, your symptoms are what warrant the increase. I would file an ITF or…file the increase now but it’ll be rated off the current (old) system. hey bro i checked my STR and seen its says " Bil feet with very mild Pes Planus " is this enough to submit a claim for bil. flat feet ?
You're going to need a current diagnosis. I found mines in my STR from my MEPS exam. I got a current diagnosis and my podiatrist stated the military caused the my conditions to worsen with the marching, running and standing for long periods of time. Currently rated at 50% for bilateralples plans.

I also recently had a C&P and received my DBQ. I believe I will be rated at 70%, but under this proposal, would be at 100%. Is it possible to submit an intent to file now, for the same condition that is currently in the “evidence gathering” stage? I will absolutely submit another claim once this comes into effect, just wondering if I should do the intent to file now/if it’s possible.
Has anyone had a zoom exam? I have an in home online meeting for my mental health claim. I feel like this may be not in my favor.
Very common and the method of the exam doesn't equate to outcome. Your evidence, meaning the Big 3, are what matters.

I did and I feel that it was favorable in my case. It helped me to get across to my examiner how I am ONLY comfortable in my home setting and would be too anxious outside
I got a 50% for MDD & the letter said exactly what you said “ disability most closely approximate the criteria for a 50%”. They ignored my symptoms in the 70% range. Should I just refile or submit under the new CFR?
If you have the evidence, then HLR. If not, then get the evidence and submit supplemental. Once the proposed criteria is final, these decision will be more objective.

@@TheCivDiv It’s frustrating, talking to a new therapist. I let my VSO submit paperwork from the local police dept on suicide attempts. My psychiatrist talked about it in my nexus letter but the C&P guy completely ignored it. If I do a higher level review is that when I get a hearing or my VSO can ask them if they reviewed ALL the evidence?

Where has it been said anywhere that these changes are coming? It's been expected to happen. But we've yet to see or hear anything. Even the va and vba staff that I've spoken with. Have not been given any information on these changes going through.
Even the vba staff on the veterans benefits reddit page has said the same thing. Because they'd love to see the memo stating this. That way, they're more prepared for when exactly this happens.
VA press release states …”WHEN the changes are in effect…” and there has been absolutely 0 indication of these changes not happening. The process started 2 years ago and was overshadowed by the PACT Act. Now it’s time.

@@TheCivDiv I'm well aware of when it started up until the comment section closing. But they've never mentioned when or what changes are being implemented. VA press release has mentioned changes to va health care and a few other things. But nothing specific about the PROPOSED changes.
Like I said, not even senior vba staff have heard about anything yet. They're the ones that have to make sure these changes are followed accurately.
@TheCivDiv until there's an official announcement about when these changes are proposed to be implemented. These videos are good for informing vets on the possibilities. But it's click bait for now. Not only that, but these proposed changes are very similar to tbi criteria. In which vba staff only have certain raters work these claims based on how complex it is. Over half the tbi ratings are underrated, too. So all these videos and posts on reddit saying it'll be easier... it's a wait and see. But prior history thanks to tbi shows us, that they'll still be down rated if the rater gets it wrong.
Edit February of 2022 was the last va press release over this subject. February 24, 2024 was the va press release about expanding va health care. Sorry Clay but this is click bait. Just as bad as the dickhead from VACI

The last va press release was February 2022, talking about the proposed changes. The latest press release discussed the changes to the va Healthcare system. There's been zero press release since the va talked about the discussion phase of this proposal. Vba employees, even senior employees, haven't received a memo on anything.

@@MeeTube717 I made the assumption because findings your ratings is pretty easy, didn’t mean to offend. VA app or VA website. VSO can also help. Don’t believe everything you watch on RUclips about how VSOs suck, there are good ones out there. The task you want them to help with is extremely easy.

I’m more concerned if I’m static on any 70% ptsd/mst I have a few other connected not rated and some rated as well some say deferred some say continued. I use the Va app all the time read my claim letters just aren’t sure of the process of continued and deferred for rating increases

There is no way I can answer this question as YOU know YOUR symptoms. If you do plan to go this route, I'd recommend gathering the evidence.
