  • They call themselves First Amendment Auditors and Citizen Journalists. They are on social media, they are in your face, and more people are doing it. Now, 50,000 state employees have been instructed how to respond.

    Actually, public photography on a public sidewalk is very legal, the problem is office misconduct, ego and creating laws in their head while violating the rights of others during their very limited required training. These city employees often are simply revenue generators, issuing tickets, while barbers and hair stylists require considerably more hours of training plus a state license.

      If they claim to be operating as a business then they need license. They are running a business they have to pay taxes.

      Auditors and news reporters both depend on the First Amendment and the Freedom of the Press. Yet, it's like they're trying to distance themselves from ordinary citizens in order to be on the cops' good side so they're not disrespected when filming. I was simply just referencing the video in which they state a mass email was sent out to government employees most of which would be apart of the justice system since that email would only relate to them and their job. Auditing or "Frauditing" as these reporters put it, aren't isolated incidents it happens across the nation. If auditing with rights violations has become a regular occurrence then something is not right with the current state of the justice system in general.

      Nope. That's wrong. In many cases the settlement amount is much smaller than expenses of going the whole nine yards in court. They know their chances to get the jobless fraditor reimburse the expenses are slim to none. Any lawyer would first advise to settle, even with a clear win.
      As for firing - cops are not one team, they are as human as the other guy. They just use it as a pretext to get rid of the worthless.

If the "frauditors," as you term them, truly presented a threat to the police, I doubt the latter would be approaching them as casually as they do. Also, real terrorists, assassins, etc, would be unlikely--as in almost zero probability--to surveil police stations out in the open. Finally, the visual information the videographers obtain, eg, video of police station exterior areas or of publicly accessible lobbies, the comings-and-goings of random police officers, etc, could easily be obtained surreptitiously by real bad guys. Face it, the real reason the police object to being videoed is that they do not wish the public at large to gather graphic evidence of their misdeeds.

    The only way that a good cop could get in trouble, when dealing with an auditor, is to not be a good cop. The law is the law, the constitution is the constitution, if the officer follows the law, they won't have anything to worry about. The problem is that cellphones with cameras and a place to post videos online haven't been around very long and these auditors are shining a light on police officers and their long standing behavior. I understand that the officers don't like being filmed when the break the law and trample on people's rights, but they got away with murder, literally, for too long and now the chickens are coming home to roost.

    this TV report was a hit job against the auditors. There are more officers than you think who make up their own laws and subject drivers to their fake laws. These auditors are simply exposing the unjust 1st Amendment overreach by the officers. If they officers stay within the boundaries of the law, they don't have to worry about losing their jobs, getting fired or anything else. EVERY PD must live within the law and the PD policies, not create new laws to suit their own agendas, which are sometimes way over the limit.

    When they asked the "auditor" if some of the questions are designed to provoke kudos to him for simply replying "next question" ignoring any accusations that his behavior is inticing, thats exactly the long term type of abuse that oughta be unlawful that officers in every state do to innocent citizens and have for yrs. This intimidating aggressive nature is exactly why the people are fighting back. Their alternative methods of pursuing an arrest, acting as if theyre your friend and trying to engage friendly conversations is designed and done to make you feel at ease so that as youre talking they might trick you into giving them the right to further harass you, may result in fewer altercations only verifies theyre as untrustworthy as any criminal. Their own collective actions have lead to origanized efforts by citizens fed up and tired of defending themselves against those paid to protect them such as defund the police and the first amendment auditors.

      Only issue with that E-mail is that it tell the employees to remain vigilant, and n the lookout for suspicious behaviour, it does not tell the employees that as public servants they have no expectation to privacy while in public or public common areas, it does not educate them on the actual laws that govern people's rights to film them in public areas.

All *LEGAL* Activities! Suspicion is NOT a Felony or a Misdemeanor.........it's one Police Officers subjective view and the same officer might find that a person jogging on the sidewalk as suspicious activity and demand ID! As long as the person is on Public Property and is only taking a video recording, they've done nothing illegal, immoral or wrong! It doesn't make a difference if someone decides that it's suspicious activity, once the Law Enforcement Officers get involved, they will try everything to get the person to identify themselves, threats of violence and arrest for failure to cooperate......But NO CRIME HAS BEEN COMMITTED! What really annoys me is that every single Law Enforcement Officer in the United States has sworn an oath to uphold the Constitution and yet they trample all over the Constitutionally protected rights of the person who's filming in public! Our Constitutional Rights are like muscles, you have to exercise them or they diminish and fade away!

      @@kdogg6781 minutes before responding to you, I watched LIA's latest post.... within minutes of walking into a public building he had a disgusting female bulldog-like employee, bullying, barking orders, claiming it was her building, refusing to identify, saying he couldn't film which is a lie and then a cop came along and tried to order him from the building whilst demanding ID and also that he stop filming immediately and then proceeded to grab the camera/phone from the owner... No provocation from the auditor, the auditor did explain calmly and articulately what he was doing and his rights, but he was totally ignored.. In the end he had to demand a supervisor who confirmed he was totally within his rights... Not an ounce of provocation from the auditor.. The female disappeared and refuse to come out and apologise or discuss the situation. She was disgusting and shocking.... no question.
      I realise that there are poor auditors out there who do scream abuse at times, but honestly, I don't see much agro and no provocation from the auditors that I watch, it is always the other side that is prepared to violate rights to get their way regardless of the law. If you don't see this happening , then you are watching the wrong auditors.
      BTW Of course I understand the definition of provoke..but can you understand that cops do violate rights continually (which is very provocative in itself and when your rights are being violated you are being provoked to the point that you need to defend your position)

    Auditors like him have NOT broken the law in any way. When a cop violates the rights of auditors it is their own actions that has earned their firings and lawsuits. There is no thin grey camera shaped line, where if an "auditor" goes out and assaults someone, we all join in, and then create a smear campaign on their behalf to ensure he gets away with it. That's the big difference between auditors and cops. Our bad apples are handled the best we can by the community, and they aren't immune to the laws like cops are. True Scotsman fallacy doesn't matter in this context, that's like saying 'a Cub's fan was ejected from last nights game because he was shouting racial slurs'. 'Well then he's not a Cub';s fan!'. He's still a Cub's fan, he's just one no one supports, likes, who is jail for his behavior currently. You wont see that happen to a bad cop, and that's why all of this started. If they held each other accountable, we would be putting our efforts into changing unjust laws, or debunking media lies like this, but instead we take the only peaceful option we can towards ending this corrupted, violent, unjust system at the root of the tyranny tree.

      I'm building a database of 1AA encounters. There are lots of (not anecdotal, but actual) occurrences where 1AA didn't fully prepare and were wrong about property lines and easements, so they ARE trespassing. That's a law. They broke it.
      There were some auditors in Cali I think, they called 911 to "get things going". That's illegal.
      This next one is controversial... but you need to pay attention to the reality of it. When Amangansett got illegally arrested... it was because there is an unconstitutional law on the books still. But... an auditor did break a law in that case.
      So... back to your 'not really accurate statement'. Either you are talking about No True Scotsman Auditors, ie, you will be creating special circumstances to support your claims ad nauseum until you win. Or, you're wrong.

      why would you expect a cop to be proficient as a lawyer in the law? By your logic, we should only make lawyers into officers, law degree would be a prerequisite. Good luck with that one, lawyers don't study so much so they can risk their lives trying to ensure ppl uphold the laws in this country, only idiots would sign up for that job.

      They do respect rights and yet these losers will get someone arrested and then harass the same cops who helped them. One frauditor who has many court cases called the cops on the member of the public just because she was recording him they were both out in public space

      @@Bakerstreetgaming There’s auditors that do thing correct. Most of them are featured on “Audit the audit” channel and those are auditors that don’t deliberately create disturbances to get a reaction. The rest of them are annoying af and only do it to get money. What other reason do they have to film outside of hospitals, nursing homes etc? They do it in hopes that an officer approches them to bait that officer into a lawsuit. They have no lives outside of the camera and antagonizing people that are trying to do their jobs, i.e when they walk into city halls recording the employees behind the desks.

      If police would STOP turning out for reports of a person in public with a camera then there will be less needless confrontations . ( And less revenue for the auditors)
      The police need to do more psychological tests on recruits to weed out future abusive and tyrannical officers .
