They really need to start taking into account what children actually want when assigning custody. If the children are scared of a parent or do not want to see them then no court order should be allowed to force them. Not to mention forcing a women to have to constantly see an abusive partner that they are frightened of is so prehistoric. DO BETTER. Children are being killed by their parents because of it and it never changes.

My special needs daughter refuses to go with her dad because he makes her uncomfortable and scares her. She's still court ordered to go. Because that's his right as a parent. When does the child's safety trump their parental rights? Most of the time the parent doesn't even want the visitation, they want the control.

How is that in her best interests? I'm so sorry mama, it has to change. And yes, they use visitation as a form of control on their partner and the court basically helps them. They couldn't care less about their actual children.

i don't understand it. i really don't. why does a child's feelings not matter to these family courts? if a parent makes them uncomfortable to the point where they DO NOT WANT TO BE ALONE WITH THEM, then that is for a REASON. a child does not fear their parent out of nowhere, there is obviously something going on in the background. yet time and time again, there comes a case of infanticide due to the dumbassery of the family courts forcing children into the care of an obviously dangerous parent.

He isn’t bipolar. That’s just a very common misdiagnosis when people have undiagnosed ASPD. If you watch more true crime stuff, you’ll notice that “bipolar” comes up a lot as a diagnosis, but violence from people who are bipolar looks more like a psychotic break than sadistic murder. It puts a really bad stink on bipolar diagnoses. It’s not that people who are bipolar are never violent, but they are never violent like this unless they have some other condition either instead of or in addition to being bipolar. The NPD and undiagnosed ASPD are what actually caused him to do this. Honestly, if that dude is bipolar, I’m the Queen of France.

      1. The person never said they had the condition under this comment post, so stop throwing labels around because you're upset.
      2. Being borderline or bipolar does not automatically make you a bad person or someone not worth listening to, same for having antisocial personality disorder. There are many with the disorder that are aware of what they do and choose not to hurt others because they've learnt that it's wrong to do, while there are others that do not care and do hurt others, it does not mean you should judge them all. You are part of the stigma that leads to people avoiding help when it's needed.

Yep. Stay with the abuser to protect the kids from abuse? “She should have left, if your husband is abusing you then you are abusing your kids by staying”.
Leave your abuser and try to protect your kids? “Maam you have to send your kids to the abuser unsupervised or you will go to jail”.
Contact authorities for help? “Shes alienating the father and coaching the kids. She faked the bruises and told her kids what to say to get back at her ex”.
Escape with your children to try and stay alive? “You’re going to jail for 10 years for parental kidnapping Maam”.
Call the DV Hotline? “Sorry maam there are no DV shelters available”.
THERE IS NO HELP AND NO WAY OUT OF THIS SITUATION.
And people wonder why no one is having kids?? Its because the kids that went through this and survived never want the same thing to happen to them that happened to their Mother (and sometimes, to a MUCH lesser occurrence, their father)

Stay with the abuser to protect the kids from being targeted by abuse?

Courts need to start considering what the children want. If a child is scared to visit a parent, they should not be forced to see them. OR if anything, even just to have supervised visits.
Additionally, Courts need to start looking into a parent who has a history of abuse towards their spouse but no abuse to their children… that should be enough of a reason to have no visitation rights or supervised visits. Courts think as long as the parent didn’t abuse their children, but viciously abused their spouse- that it’s fine to allow visitation. Like wtf?!?
No child should be scared to visit their parent by court order
