Registered USPTO patent attorney, J.D. Houvener from Bold Patents Law Firm, explains how much patents cost!
Below we have provided resources and timestamps with brief explanations for each aspect of this subject.
Quickly find what you are looking for by clicking on the timestamps below.
➡️2:43 The Patent Search
✔️Patent searches are not optional!
✔️Patent searches may cost money, but they prevent you from wasting substantially more on an invention that may end up not being patentable.
➡️4:24 The Application
✔️There are two types of applications, and you will likely file both: the provisional, and the in-depth non-provisional.
➡️5:16 Provisional Costs
✔️Provisional applications are informal compared to non-provisional applications.
✔️Typically, you can expect to pay between 5 and 10 thousand dollars.
➡️6:58 Non-Provisional Costs
✔️Expect another 5 to 20 thousand dollars for this important work, consisting largely of formalizing your claim set and drawings.
✔️The cost here depends largely on the complexity of your invention.
➡️8:34 Office Actions
✔️If your claim set is as broad as it should be, expect some office actions before your application is approved.
✔️The cost for this step can vary widely, depending what your examiner finds.

USPTO website outlines the schedule fee. The actual cost of a patent vs the fees for the lawyers is similar to auto parts vs labor cost. Learn to do the labor and you'll save a bunch of money
I like the analogy. If I may add some more color. There are of course a lot of choices of where to go get your auto repair. You've got the back-alley cash-only discount jobs, and then you've got certified technicians at dealerships. If you've got a old beat-up car that's not worth much 1975 Pacer (i.e. an "OK" idea), then yeah - maybe the back-alley is the best way to go. But, if you've got a one of a kind 2022 McLaren GT (i.e. a "Bold" idea), then you bet you are going to the highest end dealer for certified service.
@@boldpatents I noticed you redirect it from "learn to do the labor" to "pay the right people". A patent costs less than $1,000 barring extreme examples.
Learn to be your own mechanic and you only pay for parts. Learn to research and write patents and you only pay USPTO fees. Thousands, to tens of thousands saved.
If someone is making substantial money hourly, then they may wish to pay someone to do patent work. But to average joes who have an idea, your information, or lack of actual fee explanation, can be very discouraging. I understand you're trying to sell services.
@@nicholascurran1734 My Approach is more "Let me teach you what's involved in doing the labor the right way, so you'll realize its too hard to do it correctly on your own, and oh by the way, my law firm can help you do that."
man finally found some good info without having to register to a site or pay a fee. I have and idea for a golf training aid spoke to a couple of teaching pros and the think its a good idea i have a picture of it and i know how it would be used, in your opinion am i ready to move forward with the patent search and whoever i choose how can i make your my idea wont be stolen.
I can't tell from just this info - but if you are up for it, shoot over what you have (drawings, written description, pictures, etc.) over to me. If you have enough detail, then we can proceed. Email me directly: jd@boldip.com.
Thanks for the video. Great information.
You bet! Let me know if there are any other topics you need help with. Cheers!
Excellent video. Thanks for sharing your thoughts. Do patent attorneys do royalty deals or profit sharing deals? Could really help break that initial barrier.
Thanks! Some patent attorneys will do profit share/equity share - we do not. We want to stay unbiased in order to deliver clean legal deliverables.
Blue Iron IP run by Russ Krajac does these sorts of deals.
Thanks man!

Great video with tons of valuable Information. Inline with the I have a question, if you could help. I believe attorney would change if one their idea to them but sadly its already patented. Is there a quick way for to check if anything similar already patented? I know it'd need a deep search to find all related prior art but one should be able to find if something very obvious already out there that help save time and money.

We look forward in speaking with you soon!
I usually advise clients to conduct their own search engine query before coming to a Patent Attorney, so same advice for you. If after doing your own diligence, you still think your invention is one-of-a-kind, then let's have a talk!
Do you have a office in New York I like the way you explain the aspect of the patent step by step ?
Hi! Thank you so much :)
To answer your question, we have satellite locations across the country and serve clients nationwide. However, we are a 100% virtual office and rarely, if ever, meet our clients in person. Our attorneys work from home offices.

Although it is reasonable and a step by step cost , by the out come it’s really quite a big cost, for someone with no solid foundation it’s almost an unaffordable service . Someway to look at it it’s blocking innovations
It is a lot of money, which is why we recommend people get partners and investors, or you could do it yourself. But it does take a lot of time. The reason it costs so much is because of the time and expertise it takes.
@@boldpatents it is reasonable that look at value of the time , and right to look at this process this way . time is the only asset that everyone has obsolute limit, still , it is a lot of money , and time , i just think that this system seem to be over complicated and not promoting inovation.
So if I had a machine that is based on another already in existence, but has 2 or 3 new attachments that are improvements and not yet in existence, would I need to file for different patents for each improvement, and would those be all separate fees like they were independent of each other?
If your improvements share a common core functionality, then yes, it’s feasible to have one patent filing cover multiple embodiments/versions of the machine improvement.
@@j.d.houvener6868 ok. Good to know. Thank you.
Should I go to a designer first or protect IP 1st it’s like asking what came 1st the chicken or the Egg it feels like. What are the advantages of protecting IP first verse doing Product development
I feel ya. I say that as long as you as the inventor are confident that the invention will work if it were built, and you can describe it in such detail (even if its not built yet), then seek patent protection first, and file a provisional application (after performing a search of course). Then work with a designer to work the invention into a final design that will be received best by the market. And, if done well, then you can roll the final design/tweaks/changes/improvements into your nonprovisional. I know that's a lot to digest. Give us a call to chat more using this link: calendly.com/business-consultations/am06-youtube
Thank you for the reply I’ll be contacting you as soon as I make that decision.
I heard it could be done for free on another video. The guys actually did it but idk he's in usa I'm in Canada
I have a big idea but I found a patent that is very broad that could create some problems with my product, what should i do? the patent is about a stuffed animal communicating through a smartphone to a server to another smartphone to another stuffed animal i think it’s by JoyMotion
Thanks for your question. I think we're going to need a confidential discussion to help you here. We often work with clients that are seeking to make improvements over and above prior art (previous patents/publications), and in your case, we could help you understand the likelihood of success in achieving a patent and knowing whether your invention is novel enough and sufficiently differentiated.
Send an email to info@boldip.com and tell them you chatted with JD on RUclips, we'll get you set up.
Question for Bold Patents: Would this post serve as having been publicly shared and disqualified from patent?
I have an invention I brought to the attention of my company. They want to patent it. Do i ask that I should be listed as the applicant and inventor for the patent. It's a medical device that treats diabetic nerve pain and circulation issues. I'm concerned they want to be the applicant instead of me? That might take away my rights of ownership. However they will be funding it. So I don't know how to proceed and not get screwed. Any advice would help.
If you are the inventor, then you should be named as the inventor, regardless of who the applicant is. It's quite common for companies to be the applicant and the assignee (owner), but there is an obligation to list any/all inventors who contributed to the claimed invention. So, I'd get with your company's in-house or outside patent counsel. Email me with any specific followup: jd@boldip.com.
My wife and I have an idea for an app. We have the IT team ready to develope it. I have some investors with deep pockets that are interested in funding it. It is an app to save lives. But I dont have 40,000. right now to do this. I was thingking of filling for a provisional patent myself just until I get funded then file for the non provisional when I get the funds from investor. Is this a good strategy?
$40,000 is the upper limit on how much it may take to go from patent search, provisional, nonprovisional, 3-4 USPTO office actions, and through to issuance (typically takes 2-3 years for complex software/method claims). So, its not going to be due all at once. It's a process. To learn more, book a screening session and learn more: www.boldip.com/contact
Don't be idiot to give 40.000$ to crooks crooked business Company.
How much would a digital online (platform) service typically Cost to Patent..and are u allowed to pay in installments?
$30K is ballpark estimate. And of course - that’s the cost of over 2-3+ years, the first set of research and initial filings are $5-10k in the first year or so. Even that can be split up into payments.
Don't trust this crooks crooked business ripping off people...

Hmm that’s weird it only cost me $1,200 for a design patent, in the US. I’m confused JD. One year time period. Where all the fee coming from Sir?? I need some clarity JD. Thanks 🙏 u the man 🎮 love your shark tank vids!
Congrats on your patent, first of all. What's your patent number? Did you have a search performed first? Or just roll the dice and hope no one had done it before? Did you just protect one version of your design? Or did you submit several? If you "saved money" on your design patent filing, then you likely "shaved service", and your protection is limited.
So basically I just tell you what the idea is and you guys do the search? If you do the search and you find a similar invention do you then advise what to change, so you can make a new patent?
Yes, you bring the invention, we will help you flesh the invention out (think about all the versions and applications and make sure its fully defined). We do that in the invention disclosure document. Then we do a world-wide search to confirm novelty and nonobviousness. If we find that there is "prior art" that seems to cover all or most of your invention, we will give you the hard truth that you should not file as it is currently described. While we will not co-invent with you - we do have resources/referrals to designers who can help you go back to the drawing board (with the prior art knowledge) and redesign/change/improve your invention so that it will have patentability - then we help you get a patent on it!
@@boldpatents Oh, well that's helpful.
How safe is it to trust a lawyer with your idea , can he take your idea and give it to someone and claim someone else had it before you
Very safe.
I don’t think lawyers will have the time and interest to take your idea and PT it and find a investment and make your product. That time is over too many ideas not so many money making ideas
make sure to review the contract you sign with your attorney there should be something in the paper preventing them from engaging in that activity
It's like going to the doctor and speak about your health problems they have to keep it secret they took the Hippocratic oath, I guess!
Don't trust nobody , lawyers are crooked business.
What constitutes a $40,000 price?
Great question, Nathan! It really does depend on a lot of factors, like the complexity of the invention and the patent attorney you choose to work with. Generally speaking, a "complex invention" would be something along the lines of automated systems, analytical business software, etc.

If you are the inventor, and no one else has invented it (independently) and filed before you, you can still have ownership. However, the best way to go is to file a patent application first, then have a discussion with a company who may way to commercialize it and pay you a royalty or flat sale.
