Murder of Officer Justin Hare Illegal Search Commentary

  • I was traveling on old historic Route 66 adjacent to I-40 west of Tucumcari, New Mexico on 3/15/2024 when I came upon the scene of the shooting murder of officer Justin Hare at about mile 320. There was a police roadblock and I was stopped, removed from my vehicle, and my vehicle was allegedly illegally searched. I posted a short video about the event and the comments were unbelievable. They focused on my 4th amendment constitutional rights rather than the more important fact that a murderer was on the loose in the area and police were trying to locate him. The delusional fools who claim they would not have complied with the officers clearly have no understanding of Exigent Circumstances. This is my response to the reception/comments of the video, and an explanation of what happened and how convicted felon Jeremy Smith shot/murdered officer Hare on I-40 at mile 318, then took command of the police cruiser and crashed it at mile 320 and fled on foot. A manhunt for the dangerous murderer was underway and I became involved by happenstance. My deepest condolences to the friends and family of the Justin Hare. I am proud I assisted the officers in the investigation and am in no way bothered by the ignorant comments.

    Thank you sir, Justin Hare was my neighbor and our daughters are best friends. This has drastically changed our children's lives. Thank you for understanding.

      I am so sorry for your loss. It was a horrible incident and I’m really saddened by the some of the comments left here. I appreciate you taking the time to leave a comment while you are grieving. Again, my condolences to the friends and family of Justin Hare.

    I'm form the same town and was in the same class with Jeremy Smith as a kid. It's a shame that people make the decisions they make. I'm praying for the familys.

    Yes, exactly. Even the caselaw recognizes that police officers can do things that they would ordinarily not be able to do when there are exigent circumstances present, such as a suspected killer being on the loose, who could be holding an innocent person hostage, etc. In those circumstances, police have every right to do what they need to do to protect the public and themselves. In this neck of the woods, this is second incident in recent years in which a NMSP officer has been killed, and the public is getting sick of it. If they will fire on an officer with little or no hesitation, then they certainly wouldn't hesitate to hurt anyone else. In the first incident back in 2021, if memory serves, the criminal led police on a high speed chase for several miles endangering not only the officers but everyone else on the road at that time.

    Thanks for the report. We all support the LEO's and not the high-schoolish behind their screen commenters. But we would protect them same as we watch to protect the LEO's. Glad they got the punk stopped from his multi-state spree.

    THIS IS A FACT:
    Traffic tickets have statistically never changed any person's driving habits, ever!
    Extorting and pilfering incomes from taxpayers for PROFIT exposes police as evil volcanic habitual criminals profiteering from taxpayers!
    The Federal government forces the police to issue tickets on state highways. (It pays the Federal Government road debt!)

    If cops pull me over and ask to search my vehicle, they aren’t doing it because they want to put off going to lunch - something’s going on, and I’m cooperating.

    Cops shoot citizens "for no reason" I have seen many cases of that here on YT. Right, and that could have happened to you. If he was in your car then you would have welcomed the rights violation. But that was not the case.

    Don't let this video convince you that authority and it's cooked up policies and procedures triumph the U.S. Constitution in any way. Only, cowards comply. Nobody is gonna allow me to stay within bounds of a dangerous situation, regardless of what their pipedreams are.

I apologize in advance for being blunt, but those of you who claim you would have refused a search with two guns in your face in an emergency roadblock/check point are ignorant and delusional. There is something in the law called "exigent circumstances" which allows officers to remove an individual from a vehicle and search it without a warrant if they feel they are in danger and secondly have reason to believe the vehicle is involved in a crime. 1. Of course the officers feel in danger. A fellow offer is dead and the murderer is on the loose in the area. Check. 2. It's totally reasonable to assume that the killer could have flagged me down and forced his way into my vehicle at gunpoint. Check. So for you dillweeds who claim you would have refused a search I will tell you this. If you were not shot by the officers, you would have been pulled violently from your vehicle, slammed to the ground, cuffed, and likely arrested for obstructing an investigation. You'd go to court you say? Sorry to inform you, but any judge would throw out your case because exigent circumstances DEFINITELY apply here. There is no clearer application of the law with this serial murderer armed and on the loose in the area. If you still don't understand, feel free to Google it yourself and read the law that applies to the 4th amendment. This was not a routine traffic stop. It was an emergency roadblock checkpoint used for trying to locate a fugitive. The two situations are very different. Educate yourself before you make absurd claims that you would obstruct an investigation in this dire situation.

      Ser, the killer was nowhere near the search at the time. Just because you are willing to forego YOUR rights doesnt mean others are. This was amatuer hour from the jump. Thats not the fault of passersby. ​@fiestaadventures

      @@bradhuff256 his whereabouts at the time of the search were unknown. US case law has long recognized the authority of police to conduct searches when exigent circumstances are present. Everyone talks about rights in this country but no one talks about the corresponding responsibilities that accompany those rights. Even the framers of the Constitution recognized that this type of government would only be feasible with a responsible, moral people. The area where the shooting occurred was isolated and the fugitive's whereabouts were unknown. Under those limited circumstances the police acted reasonably. The shooting of another NMSP in 2021 occurred precisely because the officer wasn't taking enough precautions because he was unaware that the driver he was with was a dangerous criminal. The footage is available of the killing of Officer Jarrott. He was completely unprepared when the guy started shooting at him with an AR-15. These officials weren't violating anyone's rights and I hope the suspect gets everything he has coming to him now that he's been captured.

      Thanks for the comment. With all due to respect you are very mistaken. Please do educate yourself on exigent circumstances. In this case, it was important to help the officers with the murderer on the loose locally and my life in danger.
