Cop Arrested in Full Uniform Before Shift

  • ‪@Copwatchtv‬ obtained body camera footage from an incident involving a uniformed Albuquerque Police Officer who was on his way to work in his fully marked police unit.
    While he was driving to work, according to NM State Police the officer was apparently going well over 100MPH and swerving within lanes of traffic. A New Mexico State Police officer observed these driving behaviors and pulled the APD officer over. The New Mexico State Police officer soon could smell alcohol on the officers person.
    APD Officer Jordan Hernandez has been with the department for 3 years and is currently being investigated within his department for this incident and his trial is pending.

      To be honest, alcoholism in policing is rampant. You see a lot of s**t , can't talk about it with anyone, your relationships get strained and the shift pattern can screw your sleep and mind up. Not an excuse and dude needs to answer for it, officers gotta get better about getting help for their drinking before something like this happens.

      There's small things that make this a "failure," but with the conditions the test was done in (windy highway, test done in full police gear), I doubt it would be hard to fight in court.

      The eyes. The eyes are a dead giveaway. When you follow his finger back and forth your eyes will jump if you are intoxicated on anything. The second he did the eye test the cop was going to jail. He just did the other tests to seal it in court. My uncle got a DUI for weed and on the ticket it even says " Eyes jumping".

    I'm an RN who works in the ER. a few years ago a State Trooper brought in a Sheriff's Deputy for a blood draw for suspicion of DUI. Long story short, the Deputy wasn't drunk, he was in ketoacidosis due to diabetes

      A VERY important point and when you couple that with the wild inaccuracies of breathalyzers, the secrecy around how breathalyzers work (deemed corporate secrets and proprietary and therefore immune from discovery by lawyers) it's no wonder he refused.

      not to mention he totally bombed administering the SFST. not asking if the subject wants to submit to the tests, not asking the preliminary questions, giving incomplete instructions, hgn movements not timed correctly, not putting the subject in correct starting position for walk and turn during the instructional phase...the list goes on. That was like Phase 2 FTO bad. This would get tossed out of court so quick

      I don’t know about the judgement of the arresting officer but… If the cop who was pulled over ended up failing the breathalyzer… Don’t imagine it matters much. If the arrested cop passes a breathalyzer then- different story.
      I’m not a cop nor ever been one but I am willing to give the arresting officer a break; might have come off that way cause he was stressed and maybe angry another cop appears to have been drunk as he heads for a shift… Cops are only human & subject to such things. But I didn’t feel it was approached in any bad way… The other cop, with the straight line bit WAS acting before instructed to… And with that counting backwards… I am wondering how a “sober” man can be left to think so hard as he goes… Even stumbling.. As a cop, he is highly educated, it seems to me and shouldn’t be having such a hard time with something so simple.
      Are you sure part of what you are feeling is just anger towards the idea of a cop arresting his own kind?
      Was a woman cop who arrested another cop and other cops were nothing short of in an uproar… She got harassed at her own home even- was a terrible story. Other cop was speeding off shift heading somewhere after work, she did her job and got punished for it- more or less…

      @@timb7775 Where I live, it's legal as long as it's only being used as a navigation aid, is already pre-programmed, and not being touched or manipulated by the driver. The only difference is the police get an exemption to be able to use the computer for official business at their discretion. Most departments further restrict this discretion to being stationary.

      yeah when I was in the military there were troops who were depressed and alcoholics. Used to try to conceal their intoxication at work. NCOs were trained to look for this. In the military there is no leniency. If you come to work intoxicated once they might send you to counseling but ultimately they start trying to get you out of the military at that point.

      @@jasond869 Both. They will send the troop to "counseling" to get them out of the work place while they begin processing them for discharge. That's usually what happens to these troops. But if its for actual drugs (not alcohol), the troop will immediately be discharged as soon as possible. Like if a troop tests positive for a random marijuana UA they are immediately out processed.

      @@SonoftheWars yeah its crazy you can get drunk at work now in the military and then they retire you out 100 percent disabled. Whereas the troops who did all the work get ZERO disability. I don't mean to be offensive but for normal troops it is extremely difficult to get disabilities service connected. They really need to redesign how they do disability in the military. Its really not a fair process at all.

      Almost guaranteed he wouldn't do the same to a superior officer in that department. Maybe he would, but I STRONGLY doubt it. The issue isn't with the senior officers protecting the junior ones (though they do), its with the junior refusing to enforce the law on the senior department members. The 5 or so times in my life I've seen this occur it's literally made the national news.

      HE had the privilege of putting his gun (still loaded) in his own car.
      He got to walk back to his car and put his mags up.
      He explained himself and asked if the officer agreed. WTF No search of his person? thats what would happen next with any of us
      then he allows him a speaker phone call. we dont get that.
      Not gonna tow the car? special treatment like a mug.
      3 charges .. I can think of 7 that no doubt would have been slapped on anyone else.
      Probably more charges after the car search or my bad "vehicle inventory" that NEVER HAPPENED.

      yeah, that is the point people have failed the FST totally sober. ALWAYS ask for a blood or breath test if you're not drunk. The field test is meant to be failed.

      If an officer has already decided that you are under the influence, it doesn't matter how well you perform on the FST's. In this video, the other cop's eyes didn't display nystagmus, he had no trouble following instructions (when he was able to understand them due to the wind), and he did fine on the heel-toe walking. The only test that can clear you in the field is the breathalyzer, or blood draw done after a trip back to the station, booking, and securing a warrant. I suspect this cop submitted to the FSTs in order to gain some extra time for his body to metabolize the alcohol before they force a blood test on him back at the station.

I did witness some nystagmus on the video so its not unreasonable to think that the nystagmus was highly visible to the officer in the moment. The HGN is the most accurate out of all those tests, and failing it alone is an excellent indication of impairment.

      I also observed several clues of impairment during the walk and turn. He attempted to start the test before it being instructed to, he missed heel to toe several times while walking, stepped off the line, and stopped after completing the turn after the first set of 9 steps. He is 100% impaired.

      I was dead sober, passed alll the test with flying colors. Did one of the tests better than the officer could demonstrate. Still pulled the breathalyzer. He had it the whole time! Point is, there is no passing. Everyone will tell you that. Anyhow, he failed the only real tests that DO matter. The own officers sight and smell test.

      I think most people would be surprised how many functioning alcoholics there are. So many people have to drink everyday, they literally drink right when they wake up, before they get out of bed. They are teachers and cops and everyone else. Alcoholism doesn't discriminate.

      When you become an alcoholic or physically dependent on a substance, you worry more about keeping the withdrawals at bay than any other possible consequences that could result from being caught being under the influence. The withdrawals will definitely make you feel horrible 100% of the time eventually given enough time. The chance that you’ll be arrested, fired, etc. is small in comparison. It’s still stupid and irrational, I’m not defending their actions. Merely giving reasons why alcoholics and addicts put their lives and others in danger in order to continue to fuel their dependence.

      Lot of places where this would not happem today. You can tell the arresting officer was pained by having to do this to another cop. Kinda sad, but good he did the right thing. The Sgt. seemed unsympathetic. All parties were professional. Hopefully Hernandez had a long suspension without pay at the very least.

    WoW! This APD cop was so compliant and polite, this encounter should be used to train other police officers. He never once tried to use his position or asked to turn off the camera. His attitude and demeanor is definitely a plus in his favor. The only thing left on this traffic stop is the sniffer dog!

      @@jasonzwack8342 well for a host of reasons. First would be public perception of law enforcement. "Why is that cop in uniform and a patrol car being made to take fst's?" A lot of the public already has a bad enough view of law enforcement. That certainly wouldn't help. Then there's the safety factor. The side of the road is an extremely dangerous place. Especially now with everyone messing with their phones and not looking out the windshield. Lots of people veering off the road way more than ever before. But I understand what you're saying. Real life scenario training is often quite valuable. I just don't think it would be good to train an officer on fst stuff on the side of a road is all.

      Plausible deniability.
      He can say “I wouldn’t agree with you” and then in court he can say that he never said he disagreed. Because in fact and indeed the phrase is vague enough for the person to later back out by saying that’s not what they meant. It’s a word play that is very common in law. That’s why you’ll see anyone conducting any type of investigation ask for clear direct answers. Like when they ask you the question again and tell you they want a ‘yes or no’ answer. So you won’t try to say “that’s not what I meant” when you’re in court.
      Plausible deniability.
      Look it up , it a good trick to learn in general. 🎉.

      If you are taking field sobriety tests you are already going to jail. No one has ever taken one and been let go, the whole point is to “collect evidence” for an arrest, they’ll tell you to argue it in court

      He basically squeaked by the test so why was he arrested that's the question and he probably will be acquitted and will file a lawsuit

      ​@@alexanderkvitrovn9828Not true I got pulled over and did a field sobriety test and they let me go. I wasn't doing anything wrong though not drinking or under any influence I was coming back from work. It was a weird interaction.

      No, how effective … HGN was positive … other than this it simply showed minimal impairment there, but he had enough evidence any way.

    If that was a civilian, armed while DUI...they would also charge you with negligent use of a weapon, maybe more.

      Totally depends on the prosecutor, I’ve seen it both ways with everyone.
