I have used local tax advisors - one with whom I connected on bigger pockets, and another local CPA (like, real office you walk into- they have a few associates and was able to collaborate a bit on experience). For what it's worth, they gave me different responses to my questions, so I'm sure there's some level of gray area too..
i'd consider those as 2 separate questions- 1. Legal question of LLC (yes/no)- think through legal, liability, assets kind of lens. (From a tax angle it doesnt matter LLC or not). 2. Tax question. From IRS angle- If LLC, you can file as an S-corp or as a partnership or as sole proprietor (disregarded entity). I personally do not utilize an S-corp because it wouldn't make financial sense.
Either way- would ask the right professional- legal advice for #1 or either a CPA or tax advisor for #2. This is just what I know and am doing for myself!
