Police officers know a parent or guardian must be present when they question minors. All they can ask is their name and contact number to get ahold of a parent.
That's not the law. Minors, once arrested and questioned have the right to an attorney or a parent during questioning. That's the advisement they receive.
The officer is so proud of himself, when asked for his name he says his family name with his head hung low. What's wrong officer, not proud enough of your actions to own them like a man, say your name like you own it, like you're representing your family lineage.
Interfering is a physical act not questions something else for you to learn their kid meaning getting in between the officer and the person he's trying to interact with would be interfering and you can turn around and sue them with deformation of Rights through color of law that's when I get those three million dollar lawsuits from you know

The minor has to invoke their 5th. I have always been enraged by this and follow it closely. Any direction you can provide would be great. I followed a case where police went to a school to question a mino/student about some vandalism or something. The school allowed the police to take the student out of class for questioning there in a separate room. The school didn't even tell the parents. It caused outrage in the community and the public at large. The school immediately mobilized to create a policy. The new policy to "protect" kids in their care, simply notify the parents. That was their only new measure to "protect" kids.
@@hugoh.9694 That school should have been closed for that. As long as I can remember, cops can't question minors. I got in trouble as a minor and the judge had to throw the case out when he found out the cops wouldn't let me talk to my parents or a lawyer. This was in the early 80s.
@@chrisgerry9181 Even today under MY impression of the law, if you were to demand speaking with your lawyer as a minor (or as an adult) the case would be thrown out if they denied you your lawyer. There have been a LOT of Supreme Court cases since then (the 80's) that have changed the legal landscape on many of these issues. As I'm sure you have seen with Roe V. Wade, the Supreme Court is completely fine with turning any precedent entirely on it's head. The question is what cases have they heard and ruled on that deal/address these legal questions that may have set a clear established guideline. I'll have to dig a bit. I think the channel I saw this case on was Lehto's Law. He's a lawyer that reviews all types of odd current cases of interest.

Laws differ from one area to the next, while the application of those laws in court can wildly differ depending on the jury or even the judge. Just look at how many people are in jail and even death row when they’re innocent. My apology for using such an extreme example but it’s the first that came to mind. Also, just fir future knowledge the police talking to minors is extremely complicated, because different departments may have their own policies about it, but also whether they need a guardian to be present changes depending on if they’re being questioned as a victim, a witness, or a suspect. Anyway please just be safe and smart out there.
