  • The conviction review team looked over this case, and will ask a judge next week to dismiss the charges.

      Don’t think any amount of $ will be able to pay for what he lost, happened to 3 women in U.K. by experts opinion in court that was completely wrong. One women became heavy drinker after being released & died, others had to fight to get their children back even though their cases & prison time was dismissed & taken off any record….not sure if they ever got their children back.

    What is scary is she said the appeal goes in front of the same judge who already did his first two trials. That judge should recuse himself and let a new judge see this evidence through new eyes.

    I will never understand how these doctors, lawyers, and judges get zero penalty after being proven wrong for something as serious as sending a person to prison for life. At the very least they should be forced to pay a hefty fine to the victim without having to go through the process of suing. It's beyond unconscionable that they don't have to suffer any consequences while the victim literally loses their life to the prison sentence they are forced to endure.

      I would say I disagree based on the general way you phrased your comment. Respectfully, I feel like that’s kind of one dimensional. You have to think about cause and effect. If judges are worried about losing their life savings because they presided over trial that happened to be proven wrong because all the expert said one thing and later or proven wrong, then people would want to do the job. Or they would do the job but they would be perfectly fine letting tons of innocent people go free because they don’t want one innocent person to go to prison. Or maybe if an innocent person is found out later to be innocent they will do everything they can to not allow the person to prove they are innocent because if that happens they know they will be soon.
      And I think some people will kind of flinch at the idea that that’s some innocent people will go to prison. But we all have to understand that will happen. No system will ever be perfect. So if you want a system that never lets anybody innocent go to prison it’s gonna have to be such a weak system the thousands of people who are guilty will go free in order for one and as a person not to go free. And that sounds good as some personal quote or some thing, but it’s not practical. Imagine how the world would be if we all knew there was a 90% + Chance that if we murdered someone we would not be found guilty. How many more murders would happen. And same thing with every other type of crime.
      As for this case, the expert said that he shipped the baby so you have to do the best you can. In this case it failed. And of course when you think about living his life it’s pretty horrible. It’s easy to sit back and understand abstractly that the system is going to send innocent people in prison and there’s no way around that, it’s much different to actually think about a specific individual.

      @@iMatti00 Your comment is just as flawed as your opinion. A person is supposed to be presumed innocent until proven guilty beyond a reasonable doubt. It is better that a guilty person go free than an innocent person spend one day in prison for something that they didn't do. Multiple people failed to do their jobs based on one person's assumptions. And that person didn't even do their job properly. To accept the notion that innocent people will be sent to prison with the attitude that the system isn't perfect is completely asinine.

      @@southerngent716- With all due respect, you’re not even saying the phrase right it is presumed innocent UNLESS found guilty beyond a reasonable doubt. “Until“ presumes that it will happen, “unless” does not.
      But no reasonable person can say that any system in the world can operate with a 0% flow rate. And that’s also why we don’t say that someone is presumed innocent unless they are proven guilty beyond a shadow of a doubt. If all you had to do was give an itty-bitty unreasonable doubt to a jury/judge and be found not guilty then crime would be rampant in our country like we’ve never seen before. Because people would not be concerned about being found guilty because it would be so difficult.
      And I don’t need that, all you have to do is look at history and see how the jury system worked closer to when it was founded over the last 250 years. And of course nobody thanks there any itty-bitty doubt would lead to someone being found not guilty.
      And please God do not try to come back and act like this response is not torpedoing your comment. Because your comment is that it’s better for guilty people to go free than one innocent person go to prison. And if the standard is one single innocent person, then everything I said is 100% relevant. So nobody actually believe that. It’s similar to people saying life is precious and no value could be put on it, yep we sure wouldn’t spend $1 billion to save a homeless person’s life with some expensive medical treatment. We wouldn’t even spend $1 million. And if a child needed $1 billion treatment, the taxpayers wouldn’t pay for that. Not $1 billion. So it’s cute to claim that no innocent person should go to prison, that’s a fairytale.

    The whole country was so quick to jump at shaken baby charges and now science has shown other causes, its so horrible. I can't imagine having the world judge you for killing your own child when you did nothing wrong 💔

    My baby had failure to thrive. The authorities accused me of child abuse! They took her and i never saw her again. This country sucks!

      Its not just the justice system, its all the people. Everyone gets it in their head that someone is guilty without any evidence at all and they destroy people. They always have (example Ramsey family). People are going after Jennifer Soto, the family of Sebastian Rogers, Summer Wells family and on and on and on. I am not saying they are innocent but they haven't been proven guilty but the public is not concerned with that.

    The doctor that made the diagnosis should have their medical license revoked as well as sued for having caused so much pain to the parents as well as not getting the baby a treatment that might have helped the condition.

    I took my son in for a rash when he was a baby. It was in a circular pattern. The doctor asked me if I had a vacuum and said she suspected it was child abuse. She asked me who watched him since the day before, which was me. She even went and got another doctor to look at him. He said it was just a rash. I used the ointment that was prescribed, and it went away in about a day. I was so scared because I was pregnant with my daughter.

      Once they decide it was abuse you have to ask THEM for permission to get a second opinion. They never let you get one.

    This is infuriating! You can see the wear on that poor man's face in his later mugshot. What a cruel fate he was handed in his life. It makes me wonder if there were other parent's dealt the same hand.
    And, like other folks in the comments, it's great to see Ms Demetria. I don't live in the area anymore, but I did hear she got dealt a bad hand from her previous employer. Growing older shouldn't mean not employable. A lot of us love our old familiar news and weather people, a lot like we love and respect our grandparents. Thanks Channel 5 for bringing her aboard.

      I know two people that this happened to. One never got her daughter back until she was grown, married and on her own. Then she got to see her. The other one is stiff fighting to get her daughter back. Neither one caused any abuse.

    I pray he is released and is able to successfully sue everyone responsible for his initial conviction! This couple lost their baby and their lives. They were not able to have more children if they wanted to, they were not able to grieve their son. They weren’t able to do any of the things a young married couple dreams of doing. All because of one “expert’s” opinion.

    How terrible to be accused of inflicting harm on your baby, when you loved and nurtured that child. The case of taking care of Maya, comes to mind. The trauma of losing all your rights, because the ‘authorities’, have deemed it necessary, when they were really just out to get you. This seems to happen too often, and those people should be investigated, and then put in jail, for falsely accusing the parents, who had no time to grieve the loss of their child. As someone said, no amount of money, can ever compensate, for what this couple has had to go through. So sad.

    We have handed doctors way too much power way too much. There are 2 smart for their own good and they need to learn to stay in their lane, which is treating the patient not diagnosing abuse.

    Around the same time this occurred a young man near me (who I did not know) was arrested and found guilty of injuring his girlfriends child by shaking. I saw him right before he was sentenced and he looked terrified. Everybody turned on this guy. I felt really bad for him. He was trying to get letters of support to hopefully reduce his sentence and my hairdresser who I assumed had known him for sometime gave some flimsy excuse for not giving him one. My own opinion is that these types of charges like "shaken baby syndrome" are the injury or medical condition of the month and everybody starts looking for it and accusing people without seriously investigating it. This is not unlike was is going on today with all the diagnosis of trans people. Just my opinion. And no consequences for the doctors that mutilate or sterilize these kids today either. My question - How do these doctors sleep at night after ruining someone's life?

    This is why I was so happy for forensics. I am so sorry. This is so horrible. I said DCS destroyed my dreams.. and yours. Bless you both for staying together. These doctors can make mistakes, but you have to be 100%. My heart just aches for them. RIP Alex. Hugs for Mommy and Daddy. May you make a future and fight for others. DCS needs to be looked over by the Feds. I know I sent them an email and they denied me... Even tho I didn't do a damn thing. My sin has Autism. He was beating me.. Disabled woman Veteran.... It was so appalling. I adopted my son, brought him from a state that locked him in a closet... To DCS making up lies. I am a college graduate. Law.... So they meet their match. Unfortunately where they put him.. No one knew how to care for him. Now, his behaviors are so bad that he can't come home. They didn't care for him. He is mostly nonverbal and they couldn't figure out what to feed him... His new Aug Comm device was thought to be an Ipad... The Hell that they put good parents through... The system is broken. Bless you both. Never give up!! Strong parents!! 🫡

    Happened to a relative. Made her falsely confess to murdering her child who in actuality died from SIDS. She was never the same; couldn’t get decent jobs, etc. She died, her record never cleared; they never admitted their error.

    We have a baby in the family with brittle bone disease. The mother was accused of child abuse before it was even looked into. Take the baby and keep them safe, fine, but you don't throw life-altering accusations out there without any evidence whatsoever. (A kid being sick or injured is by far NOT always abuse.)

    This reminds me of a case with a relative. They got their baby taken away for neglect. They claimed that the mom wasn't feeding her. She tried explaining to them that she kept throwing up after feeding. They found out that it indeed was a medical problem. They put her on a feeding tube but still refused to give her the child. She got her like 10 or 13 years later. I dont remember which exactly..

    I stopped breathing when i was a baby. I was blue and cold. My mum shooking me in a panic and threw me back in the cot. She thought i was dead. The shock made my breath again.

    Even when the child is in foster care, the parents still have legal rights to medical decisions and have to sign to take the baby off life support. Whoever judge signed this should be sued as well.

    I think that when new forensics are introduced there is a tendency to place everything in that category whether it fits or not. Its only years later after newer forensics are introduced that we can separate the actual cases from those placed into the category erroneously. Sadly innocent people can get caught up in this process. Thats why its important to reassess questionable evidence after several years!

    👨‍⚖️ ~ I understand why mistakes are made, but situations like these are good example of why these so-called “progressive prosecutor’s“ have been elected throughout the country so many times. What a lot of people don’t understand is that so many prosecutors across his country would actually refuse to ever open this case. Or when DNA would be requested to be tested because there was advancements in technology, the prosecutor would fight to not retest it. There are all kinds of answers like this. It’s often based on the doctrine of “verdict finality“ where the system prioritizes moving on with whatever decision was made over relitigating yet when do evidence comes to our attention.
    But thankfully now even traditional prosecutors are doing stuff like this less than they were in the past. But this is why so many people have turned against traditional prosecutors and wanted massive reform. Often times in society we go from one extreme to the other instead of trying to take time and slowly calibrate correctly.

    Shaken baby syndrome is not an actual diagnosis. It is only labeled a syndrome as there may be a correlation.

    For those folks who were not parents or caregivers of young children during the 80's and 90's, let me tell you that it was very frightening! It was during these decades that society as a whole, and the legal system, were transforming from a relatively casual approach to how children were disciplined and generally cared for, to a harsh opinion of absolutely no physical punishments, like spanking, which was a good thing in many ways, but at the same time did not provide any reasonable solutions to discipline or any behaviour. At the same time, the 'shaken baby syndrome' was sweeping across society like a tornado! People became quick to judge the actions of parents, teachers, daycare workers, coaches, etc. It became so diabolical that teachers stopped hugging or even touching students for fear of being accused of abuse. Many people who wanted to make a career out of working with children in some way, simply refused to go there. All because of the dangers of being accused of something that they didn't do. And the children were the ones who suffered because of this. No longer were children's environments filled with love, kindness, and support. Instead everywhere they went, their environments were completely sterilized of basic human connection. No touching whatsoever, no pats on the back for encouragement, no contact at all. It was awful.
    I was a caregiver at the time. Early in my career as a childcare worker. It was so frustrating that I moved from daycare work to private childcare. In hindsight, we did need to move away from some of the disciplinary and general care practices. But that transition took so long and so many parents, caregivers, teachers, and coaches, have been accused of terrible things that they did not do. It forced many to go rather 'underground' to avoid accusations. And that itself had repercussions that are still being felt today. Because many people, like sports coaches, scout leaders, and the like, who were actually abusing children, got away with it for a long time.
    It is a sad thing to know that ordinary people today do not know how to handle or judge these situations to the extent that they either turn a blind eye entirely, or fiercely accuse. Once someone even accuses you of abuse, even if you are proven innocent or not brought to court at all, your career is over. Parents could easily all of their children could be taken from them. Just through someone's general assessment. Even a stranger. Parents would create lies about abuse to gain custody of children in a divorce. And they still do. We as people need to learn to use common sense before we judge others. So much damage has been done. Like in this case.

    This is so heartbreaking for the family. To have their child and lives ripped away when they did nothing wrong! How does the justice system make that up to them, or give then back the 25 years they've lost? Sickening!

    They should have to pay him for everything he lost with interest.I will never understand how these doctors, lawyers, and judges get zero penalty after being proven wrong for something as serious as sending a person to prison for life. The doctor that made the diagnosis should have their medical license revoked as well as sued for having caused so much pain to the parents as well as not getting the baby a treatment that might have helped the condition.This is absolutely heartbreaking!

    Dr Starling, and I use the word "Doctor" very loosely should lose her medical license and should serve the same amount of time In Prison along with The DA, The Judge and everyone else evolved in this poor mans case as much time as he did PLUS a Life Sentence to be served concurrent. And The Father should receive $1,000,000,000 plus all of the property and monies of everyone that put him in prison as noted above. Doing that to them will set a precedence to Stop Being Idiots With People's Lives OR THEY LOSE EVERYTHING!

    So his defense attorney never presented alternative medical expertise as evidence? Where was all this stuff when this guy was on trial fighting for his life? There is no humanly way to make up for what they took from him, his entire youth, his family, his ability to love and bury his son, fear of living with actual psycho criminals in prison. My heart breaks for all the innocent people wrongly accused.
