Why is it almost always the drunk driver survives these horrific crashes? RIP
Because cars are made to protect the passengers mostly from head on collisions. Since the car that causes the crash is moving forward and the car it hits is often hit at an angle the safety systems and crumple zones in the victim vehicle aren’t optimized to protect the people in it. In this case it was a POS bus which likely had no seatbelts and wasn’t very safe anyway.
So they can sit in a cell all day and think about what they’ve done

What many people don't realize is that chronic, long term drinkers are often legally drunk ALL THE TIME. My step-dad used to drink nearly a case of "light" beer every night. He got into a single-vehicle accident on his way to work one morning and his doctor told him he was technically legally drunk, even though his last drink was at bedtime the night before. He quit drinking soon after.

Let me guess... he is a repeat offender for DUI. No license.. but still able to buy a car and drive. I think the law should be a lot tougher for repeat offenders. They always get out and do it again.

Yeah!!! My husband would wait until 6pm every day after work and after having to do any sort of driving (shopping, pick up kids, ect)!!! At squadron picnic parties (Navy), I was his designated driver!!!

Stop treating DUI’s as if it was just a mistake. These should all be bench trials as juries tend to put themselves in the place of the drunk and don’t want to set precedence for hard time for drunks.

Exactly right. I served on a jury that had a hard time convicting an obviously drunk driver -- BECAUSE several jurors admitted that THEY occasionally drove drunk. We argued for hours before we convinced those drunk-driving jurors to convict. Then the judge gave her a suspended sentence! So -- no punishment except a day in court. With sobriety test and breathalyzers and blood tests, DUI is cut-and-dried. There is no gray area. There are no excuses, no mitigating circumstances to drive drunk. Bench trial would work. It’s OBVIOUS when the defendant is guilty, no chance they arrested the wrong guy or he had a good excuse.
DWIs probably never go to trial unless they’re high profile. The DWI is pleaded down to something minor resulting in a slap on the wrist. Our justice system is broken.

I have one DUI on my record from several years back.
I just wanna go on record and say that the vast majority of us DUI arrests, at least 95% of us, are conpletely ashamed and came to terms with our problem, acknowledged we f*d up, and took steps and actions to make sure we got sqaured away on both the legal side and personal side of how alcohol destroyed our lives.
I'm sorry. I still kick myself for allowing my life to get that bad and that deep in the hole of depression and addiction.
I hope all my fellow ex-criminals find peace and NEVER drink and drive again!
I appreciate your disclosure…but 95% is absolutely not the correct statistic. The recidivism for DUI’s is much much higher! Minimum estimates come in at 25%. Others as high as 40% repeat offenders who get caught! As you know, only a small percent ever get pulled over! Another “sobering” statistic is that most people drive drunk 80 times before getting a ticket!!
Of all the laws broken, the recidivist of DUI’s is among the most common of all crimes!
Many of us have driven drunk before. I certainly did in my early 20's. Luckily, I never got a DUI, and changed my ways before it became a tragedy. You are not alone in shame, I certainly regret my driving habits. I'm just glad we both came out of it without hurting others or ourselves.

Because the middle and upper classes can trip up and get a DUI. It is treated differently so that the state's attorney can ease up on offenders that he can identify with. Why do we let bars have parking lots? We could have zero tolerance for any drinking and driving, but we want to have one with the guys after work on Friday, Uber every weekend gets expensive. Because of lenient judges. If everyone with his first DUI had to spend a minimum of 6 months in jail, people would be less likely to drive drunk. As it is, most DUI convictions result in SUSPENDED SENTENCE or TIME SERVED. So -- NO PUNISHMENT, NO PENALTY.

Driving while tipsy, very very light amount: ticket to community service.
Buzzed: community service and fine to probation or suspension of license.
Drunk: all of Buzzed + jail time increasing based on alcohol level.
At Buzzed and drunk: any damage done could be considered criminal reckless endangerment/abandonment and any lives lost considered to be atleast 3rd degree murder.

Where is he coming from? Probably on his way to the bar with vodka and his coffee, as there headed to a job for grueling work. He's probably had multiple duis. Anyone that's had 1 or more DUIS, should be FORCED to have a breathalyzer to start their car, for the rest of their lives. But he probably kind of suspended license anyways.

Some of the FHP troopers take extensive accident reconstruction training. If that defendant goes to trial, he will have an expert witness with an engineering degree to put the fault on the bus driver. Evidence gathering at the scene and studying the crash damage of each vehicle are critical in making an analysis today's "CSI viewing" jury will believe beyond a reasonable doubt. Most crash investigating troopers get training, but that doesn't make them engineers who understand physics and get paid $25k or more per trial to persuade a jury.
No matter how horiffic the crime, every American is Constitutionally guaranteed the right to the presumption of innocence until proven guilty beyond a reasonable doubt by a jury of their peers in a court of law. The purpose of the lengthy investigation is to ensure that that happens.
It's very difficult to request a 15% revenue increase for your police force every year if you don't have legions of cops roaming around a crime scene as well as a spokesman repeating the words "safety" and "investigation" while the news cameras are running.

Keep the victims families in your thoughts. Most of those workers are usually the main breadwinner in their households. Now they lost their loved one due to a drunk with no regard for human life.
And there was no need to report on their legal status, place of work or origin. These were just regular people on their way to work like the rest of us.
Considering all the people who never use the words migrant or alien without the word illegal attached, I think someone does have to remind people that legal migrants do exist. The survivors and the families of the victims have enough to deal with; maybe they could use a little less of "they would be fine if they hadn't invaded" comments.

I work for a major package delivery service provider, and we have several employees that arrive to work prior to 530am under the influence of drugs and marijuana ... technically a DUI.

Thirty years of don't drink and drive campaigns in America, millions charged with DUI and worse..... still some choose to do it regardless of circumstances.... So much available now not to drink and drive...get a ride... it's not worth hurting, killing and ruining your own life and others because you want to be drunk and go somewhere...makes no sense...

I am old enough to recall the days when nobody thought much about driving drunk, I had a boyfriend who regularly ran his car off the road driving hback to college from a weekend at home partying---he'd just fall asleep. I'm SO glad we have got more aware of how dangerous & foolish it is---well, at least some of us!! Apparently not this guy, hope he never gets out on the road or anywhere else again.

Many years back my neighbors adult son was a sheriff speeding for no reason without his lights on and killed a migrant worked driving a tractor. His parents stated “ that migrant shouldn’t even be here”. They didn’t care that their son murdered someone.

Buses should have seatbelts too. Often in bus crashes, seat belts will save lives by keeping people from flying around during the crash. The NTSB has been pushing for years for that change.

Buses that are 30 years old or more should not be on the road unless maintained to good condition... I have seen these buses and wonder how they are legal to be on the road... bad tires to start... the farmer company doesn't care enough to keep things maintained... so lots of wrongs here..

The crash happened at 6:30 AM, and the driver of the pick-up was charged with "DUI" manslaughter. Most of us would be on the way to work, but sober, even if we had a couple the night before. So, my question is: "Where was this guy coming from, and what was he going to do when he got to where he was going??? As for the rest, I would expect him to plead the usual not guilty. Even at 8-10 years per death, that is the rest of his life, and any and all time in local jail up to that is better than future prison time. JUST SAYING...

Alcoholism is an addiction. My brother was an alcoholic who lost his license 4 times for DUI. I was very frequently mad at him, but I knew it wasn't as easy as "well, stop drinking". It was easier for him to stop driving.

@@akinpaws I realize that and know all too well what that entails and certainly have friends who've struggled with it over the years, mostly during their youth/teens but once they acknowledged a problem existed and suffered the consequences i.e. losing jobs, friends, relationships, money, etc.. they did something about it, thankfully.
It wasn't easy and did take time, but again, they did something about it nonetheless.
But, at least in my experience with the people in my life who've struggled with it, none of them ever even considered getting behind the wheel whilst completely obliterated.
Perhaps after a couple of drinks, but never blatantly drunk and they were always functional and able to drive just fine i.e. they knew their limitations.
That's why they have taxis and what friends & family are for (a ride home)
And of course, having things like UBER, etc.. these days, makes it ridiculously easy, in fact, completely drunk proof..Again, there's really no excuse.
I feel for the addict, but I feel much more for the innocent people who've had their lives completely extinguished by someone who completely neglected their own responsibilities and made the most horrible choices imaginable.
Having said all that, I hope your brother was able to overcome his addiction and is in a much better place these days. If not, I truly wish him all the best.. Take care..

Dui charges need to be stricter. He was driving drunk on a suspended license because of prior duis. It seems like it is only when a drunk driver kills someone that the courts take charges seriously. Prior to that drunk drivers get fines and fees and told not to drive but they continue to drive because they know driving on suspended license rarely gets jail time.
