    HOA vs RV story: The RV should have been reported as STOLEN and the camera footage given to the police as evidence. Then a lawsuit filed against the HOA in general and Carrie Smith in particular.

      The towing company could also be up to losing their license. They should know if the CB property is within HOA jurisdiction. Even so once told that this wasn’t HOA coverage area that they should drop the towing fee now that they are possibly liable for a conspiracy to commit GTA.

      @@philvanderlaan5942, depending on where you're at, you may need consent of the parties involved on the call, to record phone calls. Not all states are single party consent states. You actually need to do a bit of a deep delve into the laws of the specific state in the U.S. Otherwise you could face prosecution for doing that.

    ha, the chain story is amusing to me, when the HOA president came out to scream at the fire department to claim credit for the chain the firefighter should have said "Oh great, now that we have a name and face we know who to press charges against for blocking emergency vehicles, thanks but we gotta go now"

    OP needs to get cameras and a restraining order against the HOA Karen that threatened him and his daughter at the river stating that you don't feel safe from a racist person. As well as taking it to the civil court too.

      I agree in the restraining order but do it in away that she can live where she's at. But to go to any place that would otherwise have her break the restraining order a violation. Then she's have to drive out of her way a bit, taking extra time to get to where ever it is she wanted to go. Evil maybe, petty yes, but completely legal t the same time.

    The fire department cutting the HOA’s chains: first time a patient dies from delayed response you tell the family of the decedent what happened. And who to sue. And the cops for a negligent homicide arrest.

    Story 1: All OP had to do was tell the towing company he is not a member of the HOA and his property falls outside of HOA boundaries and thus they are COMPLICIT in the theft of his vehicle. Most towing companies DO NOT want issues like this and likely would release without fees or charges as a means to keep OP from suing them/bring up a police report against them. But OP should also contact police to file a theft report and use both the camera footage and the towing company as proof of Karen's wrongdoing.
    Last Story: OP should have brought a civil case against the police department as they were racist themselves. Police were not really following proper protocol and had already decided OP was guilty and actively prevented him from proving the house was his. It took them AN HOUR just to let him grab his wallet and ID which would show the address of his home.

      As long as the Judicially created policy of 'qualified immunity' exists, it would be a waste of your money. Lehto's Law will have plenty of examples of police getting off for bad behavior because of qualified immunity.

      ​@@vernonharden I don't think most people understand qualified immunity at all and just think it's a "cops can do whatever they want without consequences". Qualified immunity covers intentional and unintentional breaking of the law in order for the officer to do his duty. An example would be: Car is on fire. Baby is trapped in the back seat. Cop opens the door and pulls the baby out and smacks it's head on the door frame and the baby dies. You can't sue to cop for killing your baby due to qualified immunity. That's a very extreme example though. A less extreme example would be something more common like breaking and entering and property damage such as: Suspect is fleeing from police and enters a house and locks the door. Cop breaks down the door and enters to arrest the suspect. Cop can't be arrested for breaking and entering or PERSONALLY sued for breaking down the door due to qualified immunity.
      Qualified immunity is a thing because it would be extremely difficult for police to do significant portions of their job without breaking some laws in the process. People would die because the police would rather stand next to the burning car with a baby in it rather than try to help the baby and end up accidently killing it and being held liable for the death. That's why we have qualified immunity. People who shout "eNd QuAlIfIeD iMmUnItY" from the rooftops simply don't understand next to anything about law enforcement.

    Imagine thinking that a gate secured by chain and pad lock would stop firefighters LOL. I can just picture the worlds biggest grin just before the chain and lock was cut while looking at her just when she thought she’d won LOL

      firefighters like to break things, the chain would be a feature of being called to the area. heck they would have gleefully driven through the gate if it had been week enough to do with out damaging the fire engine.

      It's also not a real race, the firefighter is simply getting their truck past the obstruction as fast as possible. It's the Karen trying to race them and always failing massively. The firefighters do not have time to wait for her, The fact that they can screw with the Karen risking the lives of her neighbours, just an infuriating bonus

    The racist neighbor should have had a restraining order taken out against her. Which would be just enough to let her stay where she lived, but kept her away from the property. But just enough also that she'd have to drive out of her way a bit, to go anywhere in the direction of the property. Which would also be petty, but be done legally.

    chain impeding fire department story: you dont understand the mind set of fire fighters, they like braking things, they would be getting a kick out of busting that chain up every time they had to respond in that area.

    The hoa board should have been found liable as an accessory to a crime for not doing shit to stop it, leading them behind bars as well, and preventing from ever running an hoa again in state lines. Start holding people accountable for their equals in business, especially when it's part of their job to prevent this situation.

    Regarding the chain, when the Karen says "thoroughfare", what she means is her neighbours driving past her property to get to theirs. That is a nightmare of an HOA forcing her neighbour to always take the long way to get to and from the main road. I could also expect it to be quite the annoyance if someone wanted to use their car to visit a neighbour down the street.

    A number of fire department have gotten HOAs to remove speed bumps by a threat to remove service and require the HOA’s provide their own emergency services. Most larger communities have taken back the authority over since roads must meet a minimum standards

    The ambulance company should have sent a legal warning letter stating that Karen will be held responsible for the wrongful death lawsuit by the family of those who were affected by her delaying response time to them.

    On the second HOA story if it would have been me I would have contacted a few of my friends to have constructed a gate that you can Bolt to a wooden frame and went up to her door and bolted shut right up on her doorstep that way she cannot leave the property and pound on the door until she opens the door after it's installed and also have a couple of officers there as well that way when she says I'm calling the police you can't do this have them walk up and inform her it's the same thing that she's doing with the road so why can't they do it now she can't go in and out just like the fire department can't go in and out does she see the difference and if she says no okay you can just stay there! If she says yes go ahead on both the damn thing load it back in the truck and take off with it before we leave fill the holes in with wood putty and have another friend paint the door frame you have to get in the gray matter of a crazy ass Karen and HOA personally I think hoa's should be illegal because they can steal your property from you and as my friend and I discussed a little while back I think that if an HOA president is someone misses two payments and they try to take their house I think that person should have the legal right to make a few molotile cocktails and be legally allowed to Chuck It Through the Windows I mean how far they're still in their house so they might as well burn their house too I mean I think that's fair! I mean somehow they got an illegal system and got this s*** legalized but all it is is legalized theft of property probably a bunch of damn lawyers at the beginning and judges didn't like a certain individual forced them to join an HOA then got together and started putting rules and regulations in place and that's how this s*** got started now it's going out of proportion to what it is now

    I agree legal action should have been taken after the first incidence with the padlocked chain. In emergencies seconds matters. Impeding emergency vehicles in the U.S. and most other countries is both a serious matter and a crime. A minute with a fire, can have a massive impact on how fast control is gained or negated. Minutes and even seconds can also make a difference between living and dying.

    I had an older karen neighbor that ask to take my Sequoia. She told me she needed it more than me. Well she had a car but was trying to take my ish. She would have parties when my daughter was over trying to sleep. I would turn my stereo all the way up when I when to work. 😂😅

    That last one, I've never been able to understand why people look down on someone just for the color of their skin.
    When I was a kid (1960s), there was a black woman that worked in the local school, Miss Bell, if I remember correctly. She was well liked.
    For awhile, she lived next door to me and I thought I was the luckiest kid in the school. 😂

    Story 2: In my state interfering with emergency services is a Class B misdemeanor. The sentence is up to six months in jail and a fine of up to $3,000 for the 1st offense.
    Story 3: Karen committed: 1) Trespassing 2) Three counts of Harassment 3) Three counts of a Hate Crime. Not to mention lying to the cops about "knowing" the homeowners.
    Once she is arrested go get a Restraining Order against her sighting the charges and especially how she chased OP's young daughter into their house!
    The cops committed three counts of US CODE TITLE 18 PART I CHAPTER 13 STATUTE 242: Deprivation Of Rights Under Color Of Law. They lose Qualified Immunity for that.

    I live in a rural resort area. People give their driveways road names and use it as their address. You cannot find them with a GPS. I work for the telco and you can spend hours trying to find these places. After searching all morning one of my coworkers was a little irritated when he finally found the house. He told the homeowner it was hard to find the place since it was not on any maps. They told him they liked it that way so people would have a hard time finding them. My coworker told them if they had a medical emergency someone would die before EMS could find them. Of course they complained. Also if you put a chain across a road and someone rides a bike or vehicle into it even if it is on your property you could be liable. Being in a rural area there have been more than a few lawsuits by dirt bikers and snowmobiles when people are injured.

    The HOA my boat sits at for the lake was good then they moved the gate and are looking at different locks and a bunch of BS rules so now I made my own path no gravel or anything and because it’s on private property they can’t do anything but watch

    I was born in Tulare Corruptifornia & grew up between there & Fresno, in the farm country in the San Joaquin valley. I lived there 44 years watching the state going farther & farther down the toilet. I escaped the communist state & moved to Oregon 24 years ago & have never regretted the move. We have no sales tax, our vehicle registration is $ 128 for TWO years no mater what type of vehicle it is, and only TWO counties require smog check.

    In Poland fire engine probably would ram that obstacle. It has strong bumpers. Then she would have to pay for any damages (if any) plus hefty fine for whole incydent. Here firemen do not tolerate such bs.

    Last Story: Officers were annoyed they had to arrest someone? The first ones were so enthusiastic when it was the owner's family who was the target. Thankfully the late arrival had common sense or at least fairness to allow then to get their IDs.

    There's a saying that cops need for ID is on the level on a crackhead some do ask children for ID. This is one of the few situations where asking for ID is relevant to this call.

    Cop story: yeah unfortunately that is standard procedure for a cop. Reason being, if they go in alone, it opens them up to a better possibility of an ambush and could potentially allow for destruction of evidence. There's a chance that someone could have left a gun in there, or that there are more people in the house that didn't come out. Having backup allows for that risk to be mitigated by having multiple eyes on the situation, and cover, in the event of an incident.

      BULLSHIT! That is utter bullshit and you know it! It is NOT standard procedure anywhere. No decent cop is going to detain a person from entering their own home without reasonable cause. Someone accusing you of breaking and entering when you are clearly OUTSIDE is NOT a reason to detain you. Unless the cop sees you in the act of committing a crime, they cannot legally detain you simply at the word of another person. They can reasonably ask you to provide ID, but they cannot prevent you from entering a residence without probable cause. If you tell the officer that your ID is in the house, they are obligated to escort you inside to get said ID. The cops were racist just as much as the Karen for not permitting the family to enter the home with an escort in order to retrieve their IDs.

      @protoborg I don't know where you live, but yes they can and will prevent you from going into a residence when a breaking and entering is reported and people have come out of the house. With multiple people there, it is also standard to wait for backup for the reason stated.

    The last story I would have asked for the cops supervisor since they seemed to take the Karen's side from the start. Afterwards if the supervisor didn't do anything I would have filed a complaint at the station. The Copa were in the wrong for how they treated the owners of that property as well

    I have lived in HOAs for more'n 20 years...never had a problem. Not all HOAs are bad. Just a few are evil. Most are just there to keep that guy across the street from growing weeds 6 foot high.😊

    2nd story: I've heard this story before. This chain makes no sense. How did she keep her job as president?
    3rd story: This is the major problem with gentrification, as far as America goes anyway, and probably elsewhere as well, while most people who move into a predominately black are white and decent people, rabid racist move in as well.

      Some I love doing a bit of a read along with Ripe, as I've found it helps me with the impulse anger issue I have at times when online.
      The reason so any gets way with it, is that to many places doesn't have the needed restrictions in place. Which allows them to get away with what they do, or people don't realize that the board is overstepping it's power.

    Fire Department vs. HOA Story: The Views are fortunate they're not in my City...
    ALL Emergency Services (Ambulance/EMT/Fire/Police) Vehicles are outfitted with Ramming Bumpers (big, reinforced steel tubing bolted directly to the frames to protect the front of the vehicle from impacts) and they wouldn't even slow down for a chain...they'd slam straight through it and snap it or rip the post it's attached to right out of the ground as they go past...and if breaking the chain (or smashing a vehicle out of the way) damages the Emergency Services Vehicle, the person responsible for whatever was in the Emergency Services Vehicle's way is Legally Liable for the repairs to the Emergency Services Vehicle...
    That person would also be visited by the Police with a Ticket for Interfering with an Emergency Service Response and if their interference caused someone severe harm/death due to the slow Response Time, they can and will be Sued for it...

    Story 1: ALWAY, ALWAYS, ALWAYS CALL THE POLICE IMMEDIATELY! Report the RV as being stolen and who stole it (towing company) and currently have possession of it illegally.
    You meet the police at the tow yard...you show them the paperwork and force the company to release your stolen RV for free. You could also have the driver charged with the theft.
    Since the HOA "authorized" it but as they have no authority over your property...the person who lied (HOA president) will be arrested for Conspiracy to Commit Grand Larceny.
    Then make sure you get a TRO against that person...and the entire HOA board...by siting the above crimes. After that you hit the HOA and the president with massive civil suits.

    I am so sick of racist Karen's. This is disgusting to me. I do not understand how skin color can make somebody a bad person or a good person. I am a Latina Cherokee woman but I look very white. It is so sad how I can enter places without a second look but my cousins come towards the door and they want to identify them and tell them they are not welcome. My family in Columbia are the nicest most honest people. But they are treated so badly when they come to visit me here in the United States. It makes me furious

      It is horrible. I’m in Canada and I imagine as everywhere there are racists. But the US being called a “melting pot” seems to say everyone should lose, and be embarrassed
      by their heritage. In Canada we call ourselves a “mosaic” and provide grants to groups that have festivals to celebrate their country of origin. Makes things much more fun and colourful ( and yummy with the opportunity to try food from all over the world!)

    Title Story I would report it stolen show up with officers and say release RV for free immediately or be I would press charges on the driver for theft if you need your fees charge not the HOA but the HOA president 3x the amount for towing and storage. The story about the gate blocking emergency vehicle access if a family member needed an ambulance and the delay caused the death of my family member I would sue that person for millions in a wrongful death lawsuit.

      Until the owner could prove it was an illegal tow, they can't. It would have to sit there. Calling the cops would do nothing. It's a civil matter. If you tried taking it, you would be slapped in cuffs in an instant. Play the tough guy online all you like, but for the towing company it was 100% legal.

      @@TheWeakMinded 1) No it isn't a civil matter as permission to tow it was given by a person who had no authority to give permission to tow the vehicle.
      2) No they would NOT end up in cuffs, stupid. See reason 1.
      3) The cops WOULD do something about it. They would require the tow company either release the vehicle or arrest the tow truck driver for felony vehicle theft.
      4) It was not even remotely legal to tow it. As permission to tow the RV was given by an unauthorized person, it was fully and 100% illegal.

    I would imagine that such offences would result in a double conviction with a heavt fine, dismissal from the Office of President of the HOA. Possible disbanding of the HOA.
    Then a possible civil law suit against the woman by the person or persons who required the assistance of the Fire Department.
    If a persons situation or injury worsened because of her actions, she could lose her house plus have to pay lots of money to any civil plaintiffs.

    Fire department story is too fishy. How many times can you have emergencies on the same street, so that you cut the chain over 20+ times???

      When you have a lot of seniors in an area, it's not actually unrealistic to see emergency vehicles showing up. Or in an area where you have fights a couple times a week. I know with the latter being the case from where I'd lived before I moved to where I'm at now. It was nothing to see the ambulance at least once a week, and sometimes four times within a week.
      Which it was mentioned during the pandemic and the fact that there were a large number of seniors living within that gated community.
      Also there are a couple of senior apartment complexes where I live, and it's not unusual to see with the one, that the emergency squad shows up two or more times within a week. I only know that as it's part of my walking route if I go out playing Pokemon Go. If course no matter how bad the weather is, I can spin at least two stops from inside my home.

    Title story: Paid? AUTOMATIC reaction should have been to bring the police to the tow yard, inform them that they towed illegally without proper authorization as it was outside HOA boundaries, extract the RV for free, have the tow charged back to the HOA, and have the HOA fined for theft/exceeding their authority/operating outside their jurisdiction! (If it can be called that) People should NEVER pay for an illegal tow, it's STOLEN! Karen didn't have the authority to enact that tow. I don't and can't feel sorry for the OP for that part, he was stupid.
    The Views: THIS story I've heard before, :) Maybe 6 months ago? Seems like the fire department should have put anonymous flyers in the mailboxes of everyone on that road, particularly those after The Chain, PARTICULARLY anyone they attended to, saying "It seems likely that your HOA President might be illegally misusing HOA funds for her personal vendetta to install and replace an illegal chain blocking the road that impedes access to your homes for emergency vehicles and endangering your lives. In case you want to look into that."
    Last story: I feel like the officers should have been reported for their incompetence and unprofessionalism. Their behaviour and the way they handled things was VERY wrong and stupid. They can't recognize Karen behaviour as suspicious? Also, it seems like this is enough reason to get a restraining order against Karen, a further black mark against her, and ensures she's forced to keep away under penalty of law.
