FMCSA Changes Personal Conveyance rules! PC While Loaded!

  • The FMCSA changed how you can use personal conveyance. Now, you can use it to go find parking when leaving a shipper or receiver even if you are loaded! Even if you have not run out of hours! This is big news I tell you. In just 2 months of ELD the rules are already changing. You still won't get paid for all that sitting but you won't have to worry about the DOT writing you up because you had to leave where you were loading to find somewhere to park. It is a step in the right direction but personal conveyance is not the final answer.

    Two years later, and shippers and receivers dock workers still delay us drivers 4 to 5 hours. UNACCEPTABLE !

    That is great news for the trucking industry I knew it would eventually have to come to this sooner or later because with the elog Mandate in the 14-hour rule and place at the same time I'm sure once the elog went into effect there was more and more truckers parking on exit ramps and insured ramps of Highways because they were stuck in traffic or stuck at a shipper receiver and was told to leave the premises so this is a alternative to fix the problem since the shippers and receivers refused to cave in 2 allowing truckers to park this is something that should have came out long time ago at the same time the 14 hour rule came out regardless of ELD mandate or not

    Great video! I had thought this was bad news from the first quick reports I read, but it's actually quite reasonable and helpful. I was caught in this exact bind last week. I couldn't find a place to park. Nowhere! Kept driving toward the pick up location. Crowded or not, there was nothing in sight. Finally I was at the shipper so I slept there. I was sweating it the whole time I was driving, just hoping I didn't get pulled over while that bright red light was blinking so strongly.

    What happens if I just say screw this noise and just Retire?
    They’re not doing us any favors; all they do is find ways to get more work out of you.
    As long as the SHIPPERS AND RECEIVERS run the industry, trucking will always SUCK, for O/OPS AND COMPANY DRIVERS.

    I think its headed in the right direction but we still need to keep a careful eye on whats goin on to make sure they dont pass something that will screw the driver

    I would prefer the paper logs but I agree with you. I do think they will start changing more things up in favor of drivers.

    I give 15 minutes to shipper or reciever for doing paper work. The rest is off duty or sleeper birth.

      I thought so to 15 loading or cheack in then I log off duty, some Shipper gets us waiting up to 4hrs or more does this mean all this time am supposed to be on duty loading? Please advise

    I think it all still comes back to interpretation of the law, like a lot of the vague laws out there. If you get a DOT violation, you will have to prove your case. Each instance will be a test case, just like the "stand your ground" laws. ANYONE can get on here and have their own interpretation of the vague law changes, but ultimately you will always be a test case in the end. I would like to see actual fines for this and how it played out in a particular State, County, Jurisdiction, etc.

    I remember when I worked for eagle transport LLC, out of Tucson Arizona, for the uninitiated they are a owner operator that pulls for Warner they would have me go off duty a shipper and receivers, have me pickup and drop-off loads on personal drive time, had to run short days, so I could have recaps because they wouldn't let us take 34 resets without their permission.

    My company doesn't allow that line 5 but when I have to move when I'm out of hours to find a safe location I just write it in the notes and never had an issue.

    I think all of us should focus on what matters. How will liability be assessed in the event of an incident? PC and these laws won’t save you. As usual it’s just another driver trying to avoid a ticket because it gives him another law to manipulate.
    What’s worse is this law gives shippers and receivers the ability to ignore the HOS because it doesn’t matter how long they take... you can leave when done!

      Ok, liability won't change because you will be driving legally. I agree about this not helping the sitting because shippers know you can leave. We should be PAID for sitting.

      It would be nice to get paid for all we invest into our work day, which should be a much bigger focus in this industry over the use of PC which is going to do little more than get a lot of drivers in trouble.
      Driving legally has never removed liability from the trucking industry! Which is why a law such as the use of PC will ultimately benefit shippers and place even more liability on drivers. It’s not a good law in any way.

      Trucking Answers in this same guidance the fmcsa specifically said that a ruling on liability is out of their wheel house. It will be up to employers and insurance companies. I have to have permission to use pc in order for the companies insurance to cover me in the event of an incident.

      because shippers and receivers are dealing with drivers, maybe there should be a law that forces them to get the drivers in and out asap. And if they can't they should have to allow drivers to stay on the property. I was at a meat shipper once, they allowed drivers to stay, and they had showers and food available as well. ( wish I could remember the name)

    This has always been the case, just because they actually put it in writing doesn't make it new. If the shipper or receiver won't let you stay or wherever you thought you were going to park for the night tells you to leave, you can drive to the nearest safe haven without penalty to you or your logs. Once you leave and get to your "safe haven" put in the notation that you were "mandated to leave the property."
    Nearest safe haven is the one that is closest to you en route. In other words you are not required to drive out of route to go to a safe haven.

    My Qualcomm is not flashed to allow off-duty driving. So I simply log out.
    In Canada we have 75? miles to go find a parking place.
    Actually I refused at a supermarket in Rochester NY to leave at 3 AM. Refused. There was plenty of parking. Security was pissed. I simply told him as long as he argued he was extending my 10 hours. I was seriously detained "detention" that night.

    Personally I think they should just completely do way with the logbook. Just write down your odometer at the beginning of the week and give the driver 5,000 miles that week. As long as the driver stays within the 5,000 mile limit he's automatically legal. If he runs over the 5,000 mile limit, he gets a ticket of $100 for every mile over. That's it. Very simple.

    The FMSCA should require all shippers/require to issue directions to an available parking area or areas within close proximity.

      Trucking Answers fmcsa should institute/mandate reasonable safe haven for drivers out of HOS to remain at shipper/receivers based on square footage of property and said # of drivers on property at a time seeking 10 rest break as an addendum under personal conveyance regulations to be adhered to by shippers and receivers

    There for a while, we were being punished by the Qualcomm for moving the truck around a shipper or receiver during a drop and hook. That nonsense seems to have stopped. Dropped trailers usually are no where near the trailers we are hooking. As for the loading I put myself off duty or sleeper, since i am not on the dock.

      There is little you can do and that's the problem. It's why I want drivers to get paid for all their time. Your company needs to be very proactive to getting their trucks in and out if these places and keeping you moving.

    Well, the long and short of the deal, is how to get more hours to be able to work in a day!!
    Well, for one thing, I don't need to work 26 hours a day!! I can do that at home!!
    I also don't need it works seven days a week, at 8.75 hours a day! I'm limited to working 70 hours a week, and I want to work more time??? How much money do you make?? How much time do you put in?? How much could you make making fries, or mopping a floor for 70 hours a week, and be at home every night, not spending a fortune eating at truck stops, and paying to park your truck???
    The trucking industry is bad at best!! And FUBARed at worst, and getting worse with every bureaucrat that tries to change more regulations!! Seen the NO SMOKING IN THE WORK PLACE crap, yet?? Wait til it gets into your truck, while you're driving!! Still need white sheets on your bunk, JUST IN CASE???
    Now everyone is praising the govt for letting someone drive more, for free, and not getting any kind of reimbursement for the time that you are twittlephuched out of, by every shipper and every receiver, all because the company wants to make a half penny a mile more, for kissing the pickle for the business!! Some folks call them people LOT LIZARDS!! Doing something for money?? Ass kissing is only illegal if the man isn't getting a piece of the action!!
    Go ahead and cry for more hours to work, more hours to move their truck, with their freight, some where that you can rest, FOR FREE THIS TIME!

    According to the DOT you can be off duty at a shipper or receiver.
    A break room or walking your dog is off-duty time not sleeper berth

    The DOT had to be dragged kicking and screaming to allow us to use PC to parking. The DOT had to admit the reality of customers taking forever to unload or load us. The main issue I have now believe it or not is dispatch and ops not letting me sleep during my 10hr break. What should be illegal is dispatch/ops being on some form of commission for getting the max work/productivity out of us. The 10hr break was intended to let us get good sleep and have time to get showered. Drivers need to be able to be healthy and keep that blood pressure down which is actually being safe. Yet here I am being forced to do multiple trailer swaps during my 10hr break which gets me back to NO SLEEP, unhealthy, and stressed out all the time which is not safe!

      How are you being forced??? Your phone and or Qualcomm if you have one should be silenced once you start your 10 hour break. It is illegal for any company or dispatchers to interrupt you while you are on your 10 off. If they keep it up, turn them in. If you get harrassed or threatened for your job, you have an instant lawsuit. Im amazed at all of the drivers these days that don't know there rights, driver here of 25 years plus.

      No., 50 miles is not true., the fmcsa uses a ( reasonable ) time and distance formula., however, in paragragh 1 of the fmcsa guidance, it states ( the cairier ) may set a distance or ban personal conveyonce altogether.
      An example., i drove from portland to boise on p.c., thats 8+ hours, was stoped at lagrande scale and had logs check., i was ladden and on p.c., it was a friday and i was 3hrs past my 14 when stopped.
      I was not in violation because i was getting 36hrs off and the opperational readyness of the truck was not enhanced. My use was to have 2 days of instead of 1....
      This is classified acceptable undwr all 12 rules..
      Now im not saying you should try what i did, every dot guy is different, this is were knowing the rules come into play.

    I have a question I was in SC picking a load at one of those huge companies that has stupids and exaggerated safety policy first i had to wait in line to the shipping office after they check your info for the pickup they have to make sure you have safety equipment like glasses boots and safety vest, then you have to go to another part of the facility so they can inspect your trailer it is dirty you to go to another part of the facility clean the trailer and come back so he clears you out and proceed to the next step, after that i had to drop the trailer in specific spot and go to another spot to park my truck keep in mind that that process took me approximately 1 hour or more to do now this is my question can i use personal conveying for that situation to move around a facility without affecting my hours of service????

      Not legally. You were working for sure. PC could be used to travel from the facility to the nearest safe parking but what you describe is work. That kind of stuff wastes our time. It's infuriating.

Something that I need to say I always when i go to the shipper or receiver while I’m getting offloaded I always put myself off duty and i never have any problem the DOT check my logs and i have never been put out service or penalize for that.. and also if you don’t put yourself off duty aren’t you wasting hours from your 72???

      Many people do go off duty there. It helps your 70 hours but I never try to work more I'd rather make more.

    Oh and BTW you DO NOT have to log all time at shipper or receiver as on duty! Once your truck bumps the dock and brakes are set you can go off duty unless you are required to assist in the loading/unloading process.
    If I show up and they tell me go wait in your truck we'll come get you when we're done, that's off duty time. I'll be in my sleeper eating or watching Netflix, "off duty."

    "Nearest reasonable" so if there is a truck stop 5 miles out but you keep going that extra hour to the next in route truck stop after it to make a little extra$$ that's not gonna fly with any DOT that know the area.

      That's correct. BUT, if there is no parking, like it's full, you can continue to the nearest safe parking. Proving it was full after the fact is another matter.

    Ok heres my problem today i was at the delivery lot they woke me up to unload me 7 am after they were done i had to drive only 2 miles to pepsi checked in and parked withe the other trucks now i clicked on home on my gps which is my work yard it said 8 1/2 hrs to get there i said cool ok now 3 hrs i get called to a dock 2 hrs later im loaded ready to roll so 5 hr and 15 minutes at shipper in st louis to run out just north of Columbus 2 hrs from the yard i had 10 1/2 hr drive time 12 1/2 hr 14 hr clock was supposed to be home and leave back out sat now cause my 14 killed my clock because of shipper i cant leave untill Sunday now and lose 550 bucks pay on Saturday cause i have to do 34 hr reset what can i do

    Last week: I started driving at 0300. Got to receiver at 0700. On duty on dock counting product for 3.25 hours. 30 minute break. Then had to drive 2 hours to first shipper on next load. Was on duty on docks for 30 minutes. Drove 3 hours to last shipper. It took 5.25 hours to load. Had to count product. So was on duty on dock the whole time. That makes a total of 18 hours working and awake. 4 hours past the 14 hour clock. I was not allowed to stay at shipper. My company told me to use the PC to drive to nearest safe haven. Which just happened to be an hour away. I actually had to go 1 minute over the PC 50 minutes allowed. That makes me driving an 80,000 lb weapon fatigued after 18 hours. That is NOT the intention of the new regulation. It is not meant as a free ride for the company to abuse. Similar situations have happened 2 more times since.
    What’s happening is this is being used to completely negate the 11/14 hour rules. And those rules are there for a very good reason: to help prevent fatigued driving. Companies are too greedy and too willing to sacrifice drivers.

      Is it your company giving that 50 minutes limit? Mine prohibits PC time. Anyway, I agree. Companies always find a way to abuse these exceptions.

      Trucking Answers the ELD is set to only allow 50 minutes. So I’m only assuming that it’s a company thing.

      Spot on! OPS and Dispatch need to be regulated much more than the driver. It should be illegal for them to be on some form of commission for working the driver to the max productivity. I have dispatch almost constantly editing my logs in order to give more work time. I do however like being able to PC to the nearest safe haven.

    Ok but I think everyone should read it for your self and understand it to the best of your knowledge. Please don't bite my head off if I'm wrong with what my next comment, but I believe we are not able to forward advance on personal conveyance. So if I did forward advance on personal conveyance I'd have to go back to were I logged in to restart after 10 hrs beak. That's just how I have all ways understood personal conveyance. To me the only difference is that before we couldn't use it if we were loaded. Now we can use it loaded. That is my understanding on it. Please understand I'm not trying to start a comment war between my follow driver's I just disagree with what he says, but I'll also accept it if I'm wrong. At the end of the day we all need to be on the right page regardless of who is right. We don't need to be placed off duty at a chicken coop with a big fine. DOT would love that. I don't wish that on anyone. Keep the rubber side down.

      This new rule allows personal conveyance from a shipper or receiver to the nearest safe parking. This allows drivers to drive legally to get their rest break.

      most of the wrecks happen in the last drive hour....go an extra hour and more fatal wrecks will occur...do not listen to truckers advice...they have poor social skills!

    You can go off duty at a shipper/receiver if you ask them if you can eat your lunch. Get the first name of the person you asked. Log off duty comment took lunch as per Pedro.

    You can log off duty at a shipper or receiver when you're not performing any duties pertaining to your job. If I'm twiddling my thumbs in the break room, that's off duty. Also, if a driver is in the sleeper, waiting or sleeping while in a dock, guess what? That's line 2, sleeper birth time.

      I appreciate you watching and subscribing. If I'm wrong, I'll admit it. Let's talk about this: From time to time the DOT puts out guidance on questions about regulations. Here is a quote from guidance about this topic. “All time loading or unloading a commercial motor vehicle, supervising, or assisting in the loading or unloading, attending a commercial motor vehicle being loaded or unloaded, remaining in a state of readiness to operate the commercial motor vehicle, or in giving or receiving receipts for shipments loaded or unloaded.”
      If any of these apply, you are on duty and not driving.
      Auditors and inspectors determine whether a driver had the ability to leave the facility when judging whether he or she could have been off duty.
      So, if you need to be there, you are considered on duty.
      So it seems that just because you are there does not mean necessarily you are off duty. You must be able to pursue activities of your own choosing which includes at another location. I know drivers DO log off duty but they in reality are on duty. What are your thoughts on this?

      Roger Maglaris not that familiar with different ELDs. The one I used had an option for personal conveyance that logged driving as off duty. Not sure if all are the same

      Roger Maglaris some ELDs have an option to select off-duty personal conveyance. Your driving will be recorded as off-duty and will not interrupt your break.

      Some ELDs should have an option for personal conveyance (PC or personal use) that stops the vehicle from automatically being out into drive when the vehicle goes above 5mph.

      Hirald Joseph pre trip is the only thing dot requires. There is no requirements to do a post trip

      Dot doesn't specify this, you are required to log 2 daily inspections one of those being a simple walk around.

      Also not required 15 minutes either. Your are required to log as much time as it took. The 15 minutes is from the paper logs that were in 15 minute increments. If it only takes you 12 minutes, and elog work to the minute, why would you log extra time? If it takes you 37 minutes to do it, then log it that way. This isn't rocket science. Pretty simple. If you run a 7 1/2 minute mile you don't tell people you run a 9 minute mile do you?

    I own the truck and trailer. I've delivered, haven't been given a dispatch for the next load. I can't go home unless I have enough hours. Why? Because I live in the same town as I would be picking up my new dispatch. Well how come the restaurant cook can work 15 hours. Get in their personal vehicle and Drive home? If safety is the reason The human body will reach natural fatigue status. At 12 hours of non stop activity. (Any activity that is) And so the cook gets home. And sleep for 4 to 5 hours. And has to be back at the restaurant for breakfast. How safe is your meal? Come on big brother how many people get food poison every minute. I think the cook needs a 10 hour mandatory off duty. As well driving or cooking. A lot more people put their lives in a cook's ✋ than mine. Let me go home

      L.M. Malcolm reasonable location. A pitch black empty lot in the ghetto 1 mile from the shipper is not reasonable. Must be a well lit facility with accommodations. Source of food, bathrooms and showers. Proper diet and hygene are part of proper rest. I'm not in the middle East anymore. A jury would side with me.

    I hope people stop listening after u read what the rule change was. You are wrong and and misinformed. U can be off duty at a shipper just as u said u can log sleeper birth. It is a 10 hour break first. Not a combination of a 2 and 8. And no u can not traveling direction of next load for 10 mile if there was a truck stop 1 mile in the opposite direction. It says nearest. Not most convenient.

      The FMCSA was very clear in guidance they issued a few years ago about off duty at dock. Their own example is that unless you can take a cab to the theater and watch a movie, you aren't off duty. You have to be able to "pursue activities of you own choosing even at another location". Off duty and sleeper berth can be combined in any continuous combination to total 10 hours for a break, this is not split sleeper we are talking about. As for the direction of travel, I'm being practical not legal and I say nearest several time but how far out of your way would you go? Maybe the nearest had no parking? If it's a huge difference I agree but realistically most drivers will go the direction they are going.

      Practical wont get you out of that violation nor will it get those valuable csa score points forgotten. If you are gonna use facts. Then use them. Your opinion is useless unless it is backed by facts. As far as the off duty at a facility is possible. You think that in order to be off duty you actually need to be able to leave. Nothing say you have to be able to leave. It says you have to be able to pursue your own activities. Well sitting in the drivers lounge watching tv is your own activity. The on duty rule is for when you have to do something for the company u work for or the company you are at or the work being performed on or for the truck. So If u can get the lady truck driver in the truck next to you to let you come over and bang her. You can not log sleeper aw you are not in your sleeper. You log it off duty.

      Steven Roberts,I'm new to to trucking just 3 years in with mega company and on training they told me you need to be on duty when arrival at shippers or receiver then you go off duty, and sleeper if your in sleeper.
      Am interested to see how this new change will affect pocket and I agree bang the lady driver next you if she looks good and clean just saying

    You certainly be off duty at a shipper/reciever as long as your check-in time is on duty and as long as you are not loading/unloading yourself. It's a little exasperating to listen to disguntled o/o's whine about non-issues they aren't even knowledable about. You can also use p/c for commuting to and from terminals as long as it is merely 'commuting' and not furthering commerce. There are NO limits on any distance unless set by a company etc.. Read the reg.s before blathering baloney.

    Thankfully I don't have to deal with this ELD garbage cause my truck is a 99. I don't know how you company guys do it. Sleeping 10 hours is way to much time. I can sleep 4-6 hours and drive 15 before needing some sleep.

    You're giving bad advice if you drive a half hour to a location with safe parking you still need it 10 hour break do not tell people but it's okay to then start driving in nine and a half hours it's not true if they find out but you only got nine and a half hours of non driving time and you get an accident and kill somebody you're going to jail you always always always need to tell hours off from driving even off of personal conveyance if you don't understand the law to not give advice on it

      The half hour drive under PC is included in the ten hours off duty!! That’s why it’s listed as off-duty driving.

    Thanks to all the driver's who use 2 or 3 log books is why eld are around and you're telling people to not obey the laws. A new law should be if not running log books right CDL gone for 10 years!!! Hope someone finds you and you get yours pulled for this!!!
