I think Gibson got away with the lawsuit because the ESP explorers shape are actually closer to Gibsons 76 explorer, the epiphone you have here is the 58 body which is a bit thicker and wider than the 76. Also, the “80s” explorer that Gibson offers now isn’t really a reissue more like a tribute. It has a slightly different shape and has different woods than the actual explorers from the 80s different pickups too etc.
This is correct. The body shape of the Epiphone is based on the 58 Explorer and isn't true to the Gibson's from the 80's like James played. Those are closer to the 76 Explorer body shape that isn't as round. The EET FUK body shape is the MX-220 body shape which is close if not identical to the 58 body but with a wider headstock. The EXP and MX 250 body shape are closer to the 76 but they have sharper edges like the EXP in the video.

Also the 84 EXplorer had that control layout to and had one more pot on top of the furthest one though
The Gibson 80’s tribute pickups in those new 80’s explorers/V’s sound really good for high gain imho.
