    This is so funny: you move 1 letter in the character's name and they can no longer catch you, even if that character is OBVIOUSLY the same one. It's like a swift kick in the knees and it's hilarious

      I think the original story is that Herlock Sholmes was created by a Frenchman who tried to have a crossover with Sherlock Holmes was rejected went French courts and they accepted Sholmes out of British spite and every country outside of England accepted it.

      Yeah, the funniest part about it is that the only reason Sholmes was created was because Arsène Lupin's author Maurice Leblanc was a rejected collab fanboy. Mr. Leblanc read the French translations, fell in love with them, and asked Doyle personally for a collaboration and was promptly rejected. Since he took the letter to heart he decided to create a character called Herlock Sholmes/Herlock Sholmés in France and elsewhere outside of the UK that happened to be the world's greatest detective from London. In the UK however it didn't work and Doyle himself faught it to the point petty Mr. Leblanc decided that Holmlock Shears would work and that stayed until the UK copyright on Sherlock Holmes ran out and it reverted to Sherlock Holmes or the superior Herlock Sholmes determining which translation or version you prefer. Moral of the story is that if you have enough salt you have a way.

      the character itself is in the public domain, but that's the first iteration of him, the later iteration made to have a personality, is not, you can use the name Sherlock Holmes, as long as it's clearly the first version, but the version with a personality, no

      @@beowolf9480 but the game doesn't take place in those later years it takes place around the bakumatsu, you know a time during which Sherlock Holmes would be in his so-called original incarnation. The argument that him having a personality shift makes him a new character is absurd and any judge who takes that argument should be disbarred and thrown in prison

      I believe the case involving emotions was settled out of court and that there wasn’t a judge that ruled that emotions were copyrightable. I’m sure channels such as Leonard French and Legal Eagle would have had a video of such a judgement was made in a US court.

    Herlock Sholmes just feels like more of an ace attorney name. This is the same game series that gave us names like Larry Butz, Lotta Hart, and Ini Miney. Herlock Sholmes fits in perfectly

      It's enough to acknowledge that Disney messed with copyright law, which then affects every other IP, which the Doyle estate uses to milk Holmes media. The time for both of them, though, is running out. Get ready to make your Mickey Mouse fanfiction into a legal work!

      Good news, Herlock Sholmes actually *is* a public domain character. He's Arsene Lupin's legally distinct rival in the 1900's Arsene Lupin series. The Doyle estate has been greedy with the Sherlock character for over a century now.

      Good luck with that, current copyright law says that _all_ games are still not public domain, unless specifically created to be so. Only way that would change would be to rewrite the law to be more reasonable.
      Which, to be honest, isn't a bad idea on its own.

    I am not surprised that Herlock was the trick to avoid copywrite issues, although rather fascinating the whole deal with the "copyrighted works" is really just a trap at this point since technically, the whole point of public domain characters is that you can take them and CHANGE them, so emotional development shouldn't really be so easy as a trick to keep Sherlock out of public use.
    All well, I'm fine with Herlock Sholmes getting some extra recognition, especially with how sassy his very existence really is historically. X3c

      @@adv78 Honestly, it's up there with Mother 3's translation. OK, maybe not that good, but it's still very well done. The team went far beyond what they needed to do, not only translating all the text, but also localising the names (still love Jay Elbird), editing graphics to make the text English, and even recording new 'Objection!' voice clips. There is literally no Japanese left in the game.

      Yeah, it's a very close second to T&T for me. Easily beats the other two games in Phoenix's trilogy. Kinda surprising honestly since I found the first one to only just be decent

    What’s not mentioned in the video is that the US court ruling that declared Holmes to be in the public domain also called the Conan Doyle estate’s business model “extortion”. They enforced a copyright they didn’t have by intimidating creators with threats of lawsuits, and since no one wants to go to court the creators and producers would always pay what the estate wanted.

    The funny thing about the Doyle estate copyrighting the look of Holmes wearing a dearstalker hat is that in the original stories, he never really wore one. An illustrator actually put one on him when he wouldn't be wearing one in the scene, and it just stuck.

    Technically there are 3 or 4 stories of Holmes that are not public domain until 2023. So it's not completely copyright free.

      Plus, something we cut from this video for time, the Conan Doyle Estate also sues over any works that were started *before* the copyright expired, even if they weren't published until afterwards. Even after 2023, they're going to claim a three year grace period on those last few stories, so this isn't going to end for another half a decade or so. Even then, they own the Sherlock Holmes trademark, so they'll no doubt keep going.

      @@PrincessFelicie None of our videos are copyrighted. They're published under creative commons instead, so anyone can remix them however they see fit. I'm not wholly opposed to all forms of copyright, but the laws we have at the moment just don't hold water.

    I actually read up about Lupin meeting Sherlock Holmes a few months ago and thought the whole exchange was hilarious from the legal end. So glad that the goofy story was used to free Ace Attorney from copyright jail.

    So the Great Ace Attorney is using how a property that was using an blatant Copyright dodging name ended up in the Public domain freeing up both itself and the mock name. Said mock-name already being pretty much iron-clad from scrutiny due to its age. All to avoid having to deal with the Conan Doyle Estate. That is just deviously clever.

    I knew the Origin of Herlock Sholmes because Arsene Lupin is one of my favorite books. Great to see that Leblanc's exploit now works towards one of my favorite videogames as well XD

    it's worth noting that there are plenty of flat out usage of not only Sherlock Holmes as a Character but many plots and allusions to scenarios and stories from the Sherlock Holmes stories ie. the Red-Headed League, some of which may have still been under Copyright Law, which is why even if they used Herlock Sholmes in 2016, other names of peoples and events may have still gotten them sued, and may still.

      An excellent point, we didn't get into it in this video but those last few stories slowly slipping out of copyright may have impacted why the game can be released now, but couldn't be released earlier. That said we didn't want to speculate too much on this in the video, as we're in all honesty not experts on the Sherlock Holmes canon.

      If you go on Ebay sometimes people sell unofficial AAI2 english translated physical cartridges! Thats how I got to play the game and it works 100%.
      The only thing you need is a DS specifically (not DSi or 3DS, those don't work). The translators did a great job and it really feels official/on-brand!

Another possible reason why it took Capcom up to 2021 to adapt The Great Ace Attorney by using Lupin's Herlock Sholmes may be how they wanted to see other adaptations that uses the intellectual properties of Lupin in recent years such as Netflix Lupin or the new Lupin the Third movies in order to truly confirm that the names can be used freely. Furthermore, I figured that they needed to twist a lot of the chapter names from the game's cases too in order to pass the copyright gate.

      I agree! I haven’t thought about this before, but you’re right, the knock-off-ness makes his character more bearable!
      Truth be told, this version of Sherlock/Herlock is still a genius, but instead of being a logical master of deduction, he’s intuitive - he just KNOWS that the clue is OVER HERE, but fails to identify it correctly until Ryuunosuke (or Iris, I suppose) corrects him.

      So, weirdly enough, Iris Wilson is actually Lolicon _Conan Doyle._

      Sherlock Holmes has been their cash cow for generations. Once Sherlock Holmes falls into public domain, they basically lose almost, if not all, of their income. Naturally they're going to be brutal about making sure that doesn't happen, they want that cash money.

    The problem was finally solved, Sherlock Holmes is now 100% in the public domain, all of the original Arthur Conan Doyle's stories are no longer under copyright.

      It's possible that Capcom's developers only just discovered the story involving Lupin and Holmes recently, and upon reading over it, they discovered that simply moving the S in his name would allow them to dodge copyright issues. Basically, the recently found out that history has proven that works, so they ran with it and also made it a cool reference to a hilarious copyright battle.

    Fun fact: if I’m not mistaken, capcom is also part of the reason that weird localized jojo stand names exist. When they released their part 5 game, there was apparently some problems with the Prince song references which may have contributed to the cancellation of the international release. But this is kind of speculation so maybe I shouldn’t call it a “fun fact” lol

    Sorry that I am 2 years late with this comment, but since you did this video, I think I would like to see a video of Why Gyakuten Kenji 2 or Ace Attorney Investigations Miles Edgeworth 2 Prosecutor’s Path never got Localized out of Japan, like ever. Since the Great Ace Attorney came to America 2 years ago, the only Ace Attorney game left that was never brought to America or any other country out of Japan is Gyakuten Kenji 2 or Ace Attorney Investigations Miles Edgeworth 2 Prosecutor’s path.
