The judge did her job perfectly (and this is what you WANT, folks, because if she shows judicial bias it could result in ANOTHER case). She reprimanded him (pretty mildly) because, for the 2nd time, he was 100% indulging in hearsay, because he was recounting what he'd been told by Johnny rather than what he'd personally witnessed. And yeah, being a cop doesn't make you an expert on substance abuse even if you encounter quite a bit of it. My point is, the judge was fair and that's GOOD. ...because Heard's case is swiss cheese and we don't want it all being thrown out later on because of judicial bias.

To those saying “You can’t unhear what he said”: It wasn’t a big deal. He said “other than when he told me she threw a broken bottle and sliced his finger”. That was all confirmed through the hospital, doctors, house manager, and the cops. There’s even audio of her admitting multiple times that she severed his finger to Dr. kipper and her nurse at the aftermath.

This judge have been very fair all the way. People might not agree with her due to preference or bias opinions but I think she's doing her best or this might just be how she is. She's neutral.
One witness testified she saw her pulling his hair and was trying to drag him back into the house. There was also a recording where she said, “I didn’t hit you Jonny I slapped you, but I didn’t hit you Jonny.” He said, “But it hurt” she said, “Well yeah, I hit you, but I slapped you, stop being a baby Johnny.” That was in day 3 and 4 of the trials... With her own words she admitted to “slapping him” and also with an eyewitness testimony... her physical abuse of him was substantiated.

I don't think it was overblown, dude went into something he heard about that was pretty serious in the case. Since he wasn't present for that incident and that he never witnessed that incident it is hearsay so judge was correct to step in quickly, stop the testimony, and strike the comments from the record and instruct the jury to ignore that statement. Did she maybe go a bit overboard with telling buddy to stop speaking when an objection was called? Maybe. Even I didn't hear that objection in the video all that well the first time either. I'll also say that I am a loud person and even when someone is speaking to me while I am speaking it is very hard to hear them unless they do so when I'm paused or finished. So can't fault the dude but you also can't allow hearsay.

Tbh I don't understand the hearsay thing much to begin with. I don't quite understand how it's ok to tell events of what "I did, they did", but it's not ok to tell what "I said, they said". Isn't it all under the same oath? Isn't telling what someone did potentially more drastic than what they said? Isn't it a key element to know what has been heard said in a case like this? Because the jury are asked to weigh up evidence, and saying 'I said' is not evidence that you said it. There are very strict rules around the admission of evidence. It's a headmelt.

This is why the court system fails a lot of innocent pple in this country! They treat it like a chess game of who can win with best strategy vs what is right and what is wrong even if the evidence are right in front of our eyes! I lost my court case to someone who rare ended me in a car accident that total my car and left me with PTSD, neck, body pain etc. Yet, the jurors found the guy who rare ended me not guilty just because they must have felt guilty that he died of natural death about 1-2 yrs after into our on going case claim to court. Im assuming maybe the jurors didn't want the crumpy old man to take his guilty verdict with him to his death grave. Although, his insurance company told my insurance company that he was non compliance and very hard to deal with. Since then, I lost all hope for the justice system.

They don't just say "oh yea we find her/him guilty" they have to present to the judge the *specific areas/pieces of evidence* they used to back up their findings and ultimate verdict. So yeah obviously they'll remember this guy's testimony, but they won't be able to deliberate and come up with a justified reason for using struck pieces of testimonies or evidence as part of their verdict.
Quite disheartening watching her bring an introverted person to his “knees”. I’m sure he has alcohol and drug issues, but to exasperate these issues is terrible. His drugs of choice seem too also be all downers. Her choices seem to be uppers. Her evidence has yet to be shown, but introverts don’t have a tendency for violence. Rottenborn objects every other sentence, they need to cut the witnesses some slack. The judge is most likely on edge because of this. He was in the middle of a sentence when the objection was made and 1 second later the judge asked him not to speak, he complied and apologized. This should never have been necessary in the first place. This is turning into kangaroo court.

Yes because they’re defending amber not Johnny, they’re not going to object to something that helps their case in any way. Same way as Johnny’s team did not object to any hearsay for their own witnesses, but did for amber’s team’s witnesses. Yes and as the others have said, since amber is in court and is testifying, it’s not considered hearsay.
Hearsay is applied if the statement is outside the party or someone said something that is not at the present or not part of the case. So if youre telling a story the hell if its true or not as long as the involve is within the case its up for the f@ckin attorney and its their work to match the statements and whoever lies will get caught....the strike and all rules wasnt made up by attorneys or what ever judge....its BASIC STANDARD RULE OF LAW.

I have a problem with sustaining the objection where he is testifying about being under the influence. If he can't testify in this case about it then he can't testify to that affect ever in court. Yet they let police do this in dui cases all the time as well as others. But other than that, I don't see a problem here. I couldn't help but notice the judge seemed much more patient with amber heard and her lawyers repeatedly using shady techniques meant to feed amber what she's supposed to be talking about which is leading the witness.

If I tried to witness to something I said or personally heard or was personally told, I would first give them an earful for implying that I'm a liar after I had to go and take the stupid oath, and then I would refuse to give any more testimony. I don't care if they walked me downstairs to a cell because of contempt. What is the point of taking that dingbat oath and getting on the stand at all when people aren't allowed to say anything? I understand that just because someone said that's what they heard or what they were told or that's what they said themselves, doesn't mean they are telling the truth. When the question is repeated in court, that's when a judge makes a decision as to allowing or sustaining it. Sometimes I want to yell at the computer as I'm simultaneously listening to the audio and reading the transcript; I want to tell the attorneys to shut up and quit being such babies. Their objections tend to get silly. Often, when I send the transcript back to the court reporter, I'll comment on the contents and say, "Can you believe that moron ? Or, "What a weenie!" She has the hard part of a job, constantly having to remind people to speak one at a time. I agree with you that their system needs to be revamped.
I sort of agree, but the lawyer asked if he had seen AH throw anything other than what he had previously testified, and his answer was that JD told him about the finger incident, which is not something he had seen
Suddenly this lawyer has onjections about trying to pin drinking on someone other then Johnny. Where as hours on their side never shut up about it with every witness.
Striking things from the record helps the jury during their deliberations. The jury won’t remember exact details or phrases after the fact. When they look it up, the allowed information will be there to remind them. They might end up remembering it but the jury will primarily recall only the closing in great detail.
The judge did her job perfectly (and this is what you WANT, folks, because if she shows judicial bias it could result in ANOTHER case). She reprimanded him (pretty mildly) because, for the 2nd time, he was 100% indulging in hearsay, because he was recounting what he'd been told by Johnny rather than what he'd personally witnessed. And yeah, being a cop doesn't make you an expert on substance abuse even if you encounter quite a bit of it.
My point is, the judge was fair and that's GOOD. ...because Heard's case is swiss cheese and we don't want it all being thrown out later on because of judicial bias.

This judge have been very fair all the way. People might not agree with her due to preference or bias opinions but I think she's doing her best or this might just be how she is. She's neutral.

That was in day 3 and 4 of the trials... With her own words she admitted to “slapping him” and also with an eyewitness testimony... her physical abuse of him was substantiated.

I don't think it was overblown, dude went into something he heard about that was pretty serious in the case. Since he wasn't present for that incident and that he never witnessed that incident it is hearsay so judge was correct to step in quickly, stop the testimony, and strike the comments from the record and instruct the jury to ignore that statement. Did she maybe go a bit overboard with telling buddy to stop speaking when an objection was called? Maybe. Even I didn't hear that objection in the video all that well the first time either. I'll also say that I am a loud person and even when someone is speaking to me while I am speaking it is very hard to hear them unless they do so when I'm paused or finished. So can't fault the dude but you also can't allow hearsay.

Which is positive sign.

Don't use the word you're defining in your translation of the word. Vague means the question is unclear and could be asking more than one thing. Leading means you're trying to guide the witness to one specific answer. It makes it easier to understand your definition. Because the jury are asked to weigh up evidence, and saying 'I said' is not evidence that you said it. There are very strict rules around the admission of evidence. It's a headmelt.

This is why the court system fails a lot of innocent pple in this country! They treat it like a chess game of who can win with best strategy vs what is right and what is wrong even if the evidence are right in front of our eyes! I lost my court case to someone who rare ended me in a car accident that total my car and left me with PTSD, neck, body pain etc. Yet, the jurors found the guy who rare ended me not guilty just because they must have felt guilty that he died of natural death about 1-2 yrs after into our on going case claim to court. Im assuming maybe the jurors didn't want the crumpy old man to take his guilty verdict with him to his death grave. Although, his insurance company told my insurance company that he was non compliance and very hard to deal with. Since then, I lost all hope for the justice system.

It has been over 33 years, and no matter how hard I worked, I was never able to get out of the hole. I used to be bitter about it, but years later, after joining the Church and taking Bible study classes and making many, many friends, I realized I would rather be poor, and do all I can to help those who are worse off than I, than have the money, houses and cars my ex does, and know I "screwed" my partner and mother of his children out of what rightfully should have been mine. Hang on a min doesn't a law enforcement officer get training on how to identify people who are intoxicated. They do it at traffic stops don't they ? So he is in a position to judge wether or not she was drunk. His lawyer should have jumped on that one !

Cops do not determine if someone is drunk, they only make the determination if there is enough probable cause for a test to be conducted.
Yes, but not an expert. Also, without testing it is subjective, especially when talking about mild intoxication. It will not even be seen as an educated guess.
Be honest right. Lets say the judge says stike that or jury will ignore that response. Your brain still remembers it. Thats how our mind works. So even if we're told to ignore it wouldn't you still remember it & hold it in your own private thoughts on summing up of a guilty or not guilty ?

They don't just say "oh yea we find her/him guilty" they have to present to the judge the *specific areas/pieces of evidence* they used to back up their findings and ultimate verdict. So yeah obviously they'll remember this guy's testimony, but they won't be able to deliberate and come up with a justified reason for using struck pieces of testimonies or evidence as part of their verdict.
It's a bit harrowing listening to all this detail of such a destructive relationship. AH caused so much unhappiness & destruction.
Quite disheartening watching her bring an introverted person to his “knees”. I’m sure he has alcohol and drug issues, but to exasperate these issues is terrible. His drugs of choice seem too also be all downers. Her choices seem to be uppers. Her evidence has yet to be shown, but introverts don’t have a tendency for violence. Extroverts do tend to be more aggressive. I’m going to listen to her evidence, but after her testimony so far, I’m leaning towards his view of the relationship dynamics.

Rottenborn objects every other sentence, they need to cut the witnesses some slack. The judge is most likely on edge because of this. He was in the middle of a sentence when the objection was made and 1 second later the judge asked him not to speak, he complied and apologized. This should never have been necessary in the first place. This is turning into kangaroo court.
What I see is a regiment of lawyers much, much wealthier than they were a couple of months ago.
This trial will not end.
Even if Ms Turd loses, her team will appeal.

I’m really confused about that too. Ambers wasn’t allowed to testify on what she herself said on account of it being hearsay, but how can it be hearsay when she’s the one that said it? It’s so odd.
It can certainly be confusing to fully understand heresay. There are a number of good Lawyers following this case, and they have posted videos on YT explaining exactly this point.

It's highly doubtful. Their illness (personality disorder) allows them to function without mistakes. The denial is very real. Should you challenge that denial, expect full blow-back or rage.

So, he can tell a whole story about driving Amber to the downtown penthouse to cool off and he said things that she said to him and he said to here and there was no “hearsay” objection. But if he he talks about something Johnny said to him about their relationship they object and say “hearsay”. This “trial” is all over the place with these attorneys and this judge. It’s like they’re just making up rules as they go along.

Yes because they’re defending amber not Johnny, they’re not going to object to something that helps their case in any way. Same way as Johnny’s team did not object to any hearsay for their own witnesses, but did for amber’s team’s witnesses.

It’s actually quite simple, as a “whiteness” you have to whiteness something to be able to testify in court, all else is hearsay.
Hearsay is applied if the statement is outside the party or someone said something that is not at the present or not part of the case. So if youre telling a story the hell if its true or not as long as the involve is within the case its up for the f@ckin attorney and its their work to match the statements and whoever lies will get caught....the strike and all rules wasnt made up by attorneys or what ever judge....its BASIC STANDARD RULE OF LAW.

I have a problem with sustaining the objection where he is testifying about being under the influence. If he can't testify in this case about it then he can't testify to that affect ever in court. Yet they let police do this in dui cases all the time as well as others. But other than that, I don't see a problem here. I couldn't help but notice the judge seemed much more patient with amber heard and her lawyers repeatedly using shady techniques meant to feed amber what she's supposed to be talking about which is leading the witness.

The constant cry of 'hearsay' is really getting on my nerves. If I tried to witness to something I said or personally heard or was personally told, I would first give them an earful for implying that I'm a liar after I had to go and take the stupid oath, and then I would refuse to give any more testimony. I don't care if they walked me downstairs to a cell because of contempt. What is the point of taking that dingbat oath and getting on the stand at all when people aren't allowed to say anything? I understand that just because someone said that's what they heard or what they were told or that's what they said themselves, doesn't mean they are telling the truth. Amber proved it by sitting up there and lying her face off. Still, what is the point of testimony if everything is being labeled as hearsay?

@@Alphacentauri819 I edit depositions for a living. The attorneys are allowed to make objections for the record, but the witness is still allowed to answer the question. When the question is repeated in court, that's when a judge makes a decision as to allowing or sustaining it. Sometimes I want to yell at the computer as I'm simultaneously listening to the audio and reading the transcript; I want to tell the attorneys to shut up and quit being such babies. Their objections tend to get silly. Often, when I send the transcript back to the court reporter, I'll comment on the contents and say, "Can you believe that moron ? Or, "What a weenie!" She has the hard part of a job, constantly having to remind people to speak one at a time.

She is very unsure and not confident in asking questions.
Striking things from the record helps the jury during their deliberations. The jury won’t remember exact details or phrases after the fact. When they look it up, the allowed information will be there to remind them. They might end up remembering it but the jury will primarily recall only the closing in great detail.
