    I think the problem for the police in this video is that they don't know who this is. For all anyone knows he's the homeowner shooting at someone who has broken into his house. Saying, "Drop the gun" and then shooting less than a second later doesn't seem justified. Especially if the gun isn't pointed in your direction. You don't know why the man is shooting. In a country that allows citizens to keep and bear arms, you can't just shoot someone who is shooting a gun without finding out who and what they're shooting at. If he's shooting at someone breaking and entering he's completely justified and the police just don't have enough information to take him down at the point they do.

Police were told by a neighbor on the phone that the homeowner was yelling seemingly at someone in his home and shooting. When officers arrived they did not announce themselves as police they gave him 1 second to drop his legal weapon he was defending his home with before they proceeded shoot him before he had a chance to react to th command. It was obvious the fact that information to the police over the phone was not given to officers who arrived on seen which led them to murder this man.

      @@parkaparid7549 If he was actually under the belief that he was being robbed and someone was in his home, he had all rights to arm himself. We will never know though because the cops managed to scream drop the gun while firing, and once he dropped the gun, to our one final shot in him proving lethal. It’s a fucked situation all around, but this in my opinion could’ve been legal for the homeowner.

    This guy was obviously (to us) a threat to the community but what if he wasn't. What if he was defending his home and cops roll up and see him holding a gun and never gave him a real chance to comply.

      Why would he be shooting from the time the call goes out to when cops get there. He’s even shooting as they roll up. Home defense situations don’t play out like that.

    Did the cops have any actionable information confirming that this was something other than a home owner actively defending himself against an intruder? If not then ASP has a HUGE blind spot when it comes to their assessment of this unannounced shooting.
    Hindsight doesn’t excuse the cops rolling up and shooting the guy unannounced.

      Homeowners would normally be inside the house when shooting an intruder, not outside shooting in.

      Police arrived on scene to a US homeowner on his property in possession of his firearm. All legal. Homeowner was not threatening with it. Why was he murdered again? How exactly does anyone justify this?

    I don’t like this one. The cops could have called out to him from cover. His rifle was at low ready when they first saw him and they didn’t know enough about the situation. They could have identified themselves from cover and told him to drop the weapon. If he didn’t immediately comply, ok to shoot.

      Also I don't know if dispatchers related info properly or the cops are just nervous always but I heard the 911 call the caller says he knows it's his neighbor and that he has an AR and there could be an intruder, dude was crazy yes but likely relieved when he saw police arrive

      Let's see you risk giving up your advantage of time and give the suspect an opportunity to draw on you with an AR. Personally I'd rather not risk a suspect shooting at me with a rifle. It's a big mistake to be shooting outside. If you're a defender you stay in your house.

      You’re right. I’m closely connected to multiple police officers. My father in law is a captain and even he knows that I do not trust the police. Bootlickers 👅 will say “ When you need help you’ll call them “. NOT going to happen. I have never called a police officer in my life. Even when our home was burglarized some yrs ago not even then did I call the police. I remember my uncle saying that he was gonna call other men to handle his problems

    The man who got shot could have easily been the victim of the man they were looking for, who might have broken into this guy's house, and he's fighting him in self-defense. The guy they shot could have been an off duty cop responding before they got there. You can't just shoot first and then figure out who is who, unless you have no choice. They had a choice.

      Yep, maybe you will get more commands (from the police) and maybe you won't. I'm an old guy and I was raised to do exactly what a police officer says when he says it. This case really doesn't illustrate that, since the homeowner had a mental illness. Poor guy, RIP.

    The disturbing thing here is the police never identified themselves, gave a command at so far away it probably could not be heard and shot milliseconds later. We all know the importance of not letting a dangerous person into someones home but this could have easily been a homeowner holding a rifle who came out after the man shot into the home

    John, I appreciate everything you do and I love the channel, but you missed on this one. The officers opened fire without identifying themselves. From verbal command to first shot was almost simultaneous. His AR was pointed at the ground when he came into the open and he was on his own property.

      The guy was having a mental episode and had a rifle that he was firing into the neighborhood. This is a situation where you react quickly and with deadly force. You don’t give the guy an opportunity to shoot back when he’s already shooting.
      Also, for those who think the situation would have played out differently if the police gave him time to give up his gun, again the guy was having a mental breakdown. This is a situation where everything would have turned out the same no matter how much officers were hesitant and identifying themselves. It’s a lunatic with a rifle shooting up a neighborhood.

    @activeselfprotection I tend to agree with you on 99% of videos, but this no. These cops gave this man zero chance at survival. Couldn’t even provide ONE clear command. There was a video recently of an actual home invasion where the suspect had an AR and the cop gave him a crazy amount of chances to drop his gun before they eventually lit him up.

      @@bryanb3352 So if someone is shooting at you and you draw your weapon to defend yourself, then a cop comes around the corner, that cop can open fire on you because they heard shots and then saw you with a gun? Circumstances matters. They didn't know what the circumstances were. Watch this video again and imagine someone inside with a gun threatening to kill him. Then imagine they raise their gun at him just before he fires. His shots would then be completely justified. And the cops have no way of knowing whether or not this is the case. The police should never fire at someone who fired a gun unless they know what that person was shooting at.

    If this is considered a good shoot then virtually anyone not wearing a police uniform is in danger if they are armed. Do not go to anyone's aid, do not clear your property of intruders, hell don't even carry a gun out to your truck if you are going hunting or to the range because you could be shot without even knowing an officer was within shooting distance.

      This was his own house and he thought there was an unknown intruder inside. They gave him zero time to react to their commands.
      On November 15, 2022, Raj Moonesinghe was shot and killed by the Austin Police Department. After informing both a neighbor and a local private security guard about a possible intruder, Raj sought to protect his home with his licensed firearm. The police snuck up on him with no lights or sirens and hid behind a neighboring fence. They said "drop you gun" and opened fire before finishing the word "gun", he stood no chance. They didn't give him the opportunity to explain that he was the homeowner, not the intruder. They shot first, asked questions later.

    Cop started firing as soon as he said drop the gun. Homeowner had no chance to comply. Homeowner wasn't pointing the gun at PD. I'm generally pro PD but this is a bad shoot.

      @@hampboogie I agree that it probably would not have helped here, but given the information the officer knew at that moment, it doesn't seem like a perfect decision. My guess is the crazy guy would have aimed the rifle at police, assuming they were the bad guys or whatever. It's very likely. In the video, the suspect really did not have a chance to comply with the verbal commands, which were clearly a mere formality. The officer did not *really* try verbal commands. Maybe that was the right decision.

    Brother of the man shot and killed said this in the linked article: "Yesterday, I had the opportunity to view the police footage and security footage of the last minutes of my brother’s life. As difficult as that was, it was an incredibly important step towards finding out the truth of the events leading up to his murder by police on November 15, 2022. The video clearly shows that Raj never threatened the officers, he didn’t even know they were there. I’d encourage everyone to watch the videos being released today to make their own judgments. Thank goodness Raj had his Ring security camera on his porch because, without it, the police would have continued to lie about what happened that night.
    “After watching the video, it is evident that the officer who shot Raj did this without identifying himself, without thinking, and before giving my brother a chance to explain who he was and why he was outside. Instead, he arrived without flashing lights or sirens, pulled out an assault rifle, took a hidden defensive position behind a fence 25 yards away, and killed my brother. He began firing before finishing his command to ‘drop your gun’ and continued to fire once Raj had dropped his gun and put his hands up and continued to fire once Raj had dropped his gun and put his hands up. It’s clear from the security footage that Raj didn’t even know the police officer was there. His last words as he lay on the ground were ‘it wasn’t me.’
    “Instead of getting justice for Raj, the Austin Police Department continues with its attempts to cover up what happened. The security footage they released today is an edited version that intentionally removes the interaction that Raj had with his neighbor one minute beforehand where he told her there was someone in his house and yelled into his home, ‘I’m calling the police, get out of my house.’
    “It is beyond comprehension that the police acted this way. The police knew he was the homeowner concerned with a potential intruder. They shot first and asked questions later. As an Austinite myself, I’m outraged to think that these are the people tasked with protecting our community."

    I definitely have an issue with how quickly the officer shot after giving the command to drop the weapon! Especially seeing the person didn't start raising it. I think in the same situation a civilian would be facing charges.

    I would have to say the lack of time given for the supposed suspect to drop the firearm is a serious piece of evidence to either convict or clear of charges. The officer had cover and there were two of them. They have no idea who that person is and firing blind just with seeing anyone with a long gun is ridiculous given rights were supposedly have.

Have you watch cop videos where they try to sneak up on criminals to catch them so they don't have a chance to flee or arrive at a domestic abuse call without making the situation worse with sirens?? The homeowners rifle was pointing at the ground. If he raised his rifle fine you gotta shoot butv that didn't happen.       Pretty sure this was a tech guy who was seemingly defending his home from what he thought were intruders. Police were told by a neighbor on the phone that the homeowner was yelling seemingly at someone in his home and shooting. When officers arrived they did not announce themselves as police they gave him 1 second to drop his legal weapon he was defending his home with before they proceeded shoot him before he had a chance to react to th command. It was obvious the fact that information to the police over the phone was not given to officers who arrived on seen which led them to murder this man.

    Typically I don’t mind shoots like these (compromised thinking individual armed with a gun) but the officers in this one really came in too hot and didn’t even try to give the guy time to react to commands before they started opening fire.

    I disagree on this one. Fact is the police didn’t have enough information on the scene to start shooting at anyone as soon as they arrive on scene. Secondly how long was it from when the officer said drop the gun an a bang ❗️ it was probably less then a second not actually giving him time to drop the gun honestly. I just don’t agree with there actions based on the information they had arriving on scene plus shooting him again while he’s down an hands are up. It seemed like they wanted to shoot him as soon as they seen a weapon and that’s a problem for me.

      because there have been "war zones" with better equipped criminals that have killed cops. the shooter seemed to be pointing the gun away from the home when the cops showed up. he is the one shooting so the cops shot him to save any innocents not involved. cops did the right thing given the immediate threat. he might have shot at the officers so i think its totally justified, and i would say that in court. the cops dont know the exact parameters of the situation but they were called to diffuse it.

This is dangerous behavior that could have consequences for anyone trying to defend their own life and property. the officer gave no time to react, the homeowners rifle was at low ready and was never raised or pointed at police, and the neighbor had already told them that he was potentially defending himself. This was a bad shoot, no matter how hard you guys try to overanalyze it.

    Can you spare us the bizarre "leaps of logic" type arguments and red herrings to justify bad shoots like this. The actual facts are that the officer sees a guy with a rifle NOT at a high ready (it was clearly down, pointing at the ground), orders him to put the rifle down, and less than a second later -- without the guy having made any sudden movements, showing any signs of aggression, or giving any sign that he won't comply -- lights him up. That's the problem. This isn't Hollywood, where cops jump out of their vehicles guns blazing. In what bizarre alternate reality was that a good shoot?
    Why in the military were we held to a standard not to just light civilians up even when they had a weapon, but cops continuously get passes from apologists?
    The best that these apologists can come up with is that a homeowner discharged a weapon within city limits. But, since it was not in furtherance of a felony, in most US jurisdictions it is basically a misdemeanor, punished by a fine, certainly not punishable by death.
    The mere presence of a firearm does not a threat make in a 2A country. And, the officers apparently knew this because their initial statements about the shooting (before they knew there was security camera footage) did not match up to what the actual video showed. The lie is mens rea evidence of a guilty mind.

    I disagree. The uni(n)formed rolled up upon a situation too fast. They yelled 'dropped the gun' and fired at the same time. No time observed between the command and the shots. The officers had their guns pointed and the victim did not. The office had an eotech. 2.5 mag right? You said the cop couldn't see. Not sure how you conclude that. Why did he shoot if he couldn't see? The cops had the drop, and as professionals should have used the disparity to give the guy a chance. They did not, and I believe the family will win at trial if they file a claim since it will be jury and preponderance. Its an odd sequence of events for sure. This strikes me as, if I sayeth the words then I will not be liable for shooting someone.

    From the video, what the cops knew:
    Shots were fired by someone.
    There is a man holding a firearm in a manner that would not justify a brandishing charge.
    That is all they know from the video
    What the cops may have known if 911 passed on the information:
    Some guy was shooting into his own home.
    Some guy believed there was an intruder in his own home.
    What we know from the video:.
    The police did not announce themselves with their lights and sirens.
    The police did not announce themselves verbally.
    The police did not issue a command in a loud enough voice to be heard by the person holding the firearm.
    The police did not give the person enough time to process the command before firing on him.
    The police were standing in the dark behind concealment.
    Only one officer fired.
    This is a bad call by ASP. The totality of the KNOWN facts needs to be taken into account, not the facts that are uncovered after the use of force. If an officer is going to issue a command, 1) he doesn't perceive an immediate threat to his life 2) he needs to insure that the victim heard the command, understands the command, has time to process and obey the command and the command doesn't conflict with other commands being issued.

Police were told by a neighbor on the phone that the homeowner was yelling seemingly at someone in his home and shooting. When officers arrived they did not announce themselves as police they gave him 1 second to drop his legal weapon he was defending his home with before they proceeded shoot him before he had a chance to react to th command. It was obvious the fact that information to the police over the phone was not given to officers who arrived on seen which led them to murder this man.

    Umm the news coverage I found for this was a bit different. This guy came home and was convinced that there was someone in his house. He was trying to clear his house, and he fired warning shots to see if he could scare off whoever he thought was inside the home. Dispatch was told that he was the home owner...I will see if I can find the original video.
    His name was Raj Moonesinghe, he was a relatively wealthy tech entrepreneur. The guy who called in to police was apparently the local security guard hence why he isn't sure where he is on the 911 call. Raj had apparently asked him if he had seen anyone around his home earlier, and he was convinced that there was someone inside. Officers didn't give him any time to respond to the commands, the officer exits the vehicle, and puts Raj down immediately.
    He definitely fucked up, but he never even had a chance to unfuck himself.

They don't know what this guy was doing before they arrive. They don't know what he was shooting at as they arrived. We see 911 calls that mischaracterize what is happening all the time; therefore, 911 calls are not and should not be the only basis for use of lethal force. Finally, this guy has his gun in the low position when he was shot and in the moments before, with no furtive movements. They had the luxury of announcing themselves in that particular moment.

    When I watched this I saw that as myself defending my home and making sure the dude that came in has left. THEN getting shot dead by a cop that shot first and didn't confirm I was the defender or threat... That would have pissed me off if I lived. If I died I would expect my little baby girl to be set for life after my wife sued the hell out of the city and police.

    The reason the comments are mostly disagreeing with you guys is because police were called to a break-in, and shot the first person they saw with a gun without announcing themselves. There are a lot of situations where someone could be defending their home and end up outside holding a gun like this and be completely justified in doing so. It looks like he was having a mental breakdown in hindsight, but what the cops rolled up on looked almost exactly like some actively defending their home. He's even in a bathrobe which is exactly what you would expect the defender to be wearing in a home invasion. Makes me wonder if I should get a fake police uniform to wear after a home invasion just so they hesitate a little longer before shooting at me

    Tough one. The police had no way of knowing what he was shooting at or why he was carrying the rifle. They engaged the individual in what appears from looking at google maps to be an area that is fairly densely populated, was this individual a deadly threat and if so what made him a deadly threat to those officers? This sort of plays into the other case in Austin recently as well, but is a person carrying a rifle in the low ready a deadly threat just because of the positioning of the rifle? I get the talk about a sling, but if you have a rifle slung in front of you with your hands at your sides I seriously doubt the officer could tell in that type of lighting situation that you were not actually in the low ready. So I guess I do back to the question, if I am standing on my porch with a rifle in the low ready is that a deadly threat? Would the police be justified in rolling up and just shooting me? If not, why was this shooting justified? I don't have the answers here, just lots of questions about a tough situation.

    *As a cop myself, I don’t feel like this was justified without announcing their presence, issuing loud verbal commands, and actually giving the guy a chance to comply. He also never pointed the gun at them and instead immediately dropped the gun and put his hands up. Why the officer continued to shoot is beyond me. I’ve seen other officers get indicted for way less over shoots that actually seemed justified. Hell, if I would’ve made a shoot like the officer in this incident did, they would’ve put my black ass under the jail, cop or not.🤦🏾‍♀️*

      Then, persuade me that it's reasonable to default to the assumption that the guy shooting into a house is actually the homeowner, and to proceed under that assumption until proven otherwise.

Also I'm going to guess they didn't just deal with the threat then leave afterwards. They must have done follow up on the inside of the home to see if anyone was hurt.

    This is a bad shot by far. The officer said drop the gun a then shot immediately not even giving the guy a chance to comply with the order and as far as I could tell the guy wasn't even pointing the gun in their direction. Yes the guy was tripping out shooting into his own home but dam they didn't even give him a chance to comply.

      @@abellius66 yes, it says in the news articles that he was yelling at what he thought was an intruder. We'll never know though, because the police shot the homeowner, and gave the intruder (assuming there was one) plenty of time to flee the scene.
