Yep. He's let hundreds if not thousands die just because he didn't want to kill him. A cop would have killed him by now for sure if nothing else, if the story was more realistic.
No he wouldn’t. He proved that at the end of the Joker War. He saves the Joker when he does out of responsibility and to not give himself the satisfaction of convenience or ease. If he watches somebody, not just the Joker or any villain, jump off a ledge and lets them fall to the floor, he’s technically at fault for letting them if he could prevent it, which Bats absolutely can. When Harley gave Batman an ultimatum to save her or the Joker, he didn’t hesitate to let the Joker die, and it would have been the Joker’s fault for not escaping because he expected Bats to help him instead, a thing Batman has done which the Joker apparent misunderstood the reason behind all this time.

Why doesn’t Batman just snap Jokers spine? He wouldn’t be killing the Joker, so he wouldn’t break his moral code, and in breaking the clowns spine he would be preventing the Joker from ever getting out of Arkham asylum or committing crime any crime.
He is a broken man. In a sick way, in his unconscious, he needs this. But the easier explanation is, that you can't kill or paralyze your main villain and expect the readers to still buy it.

They can bring him back at a later date, but he needs to go away for a while. I reeealy hope that his broken back sticks around for a while.
@aceloco817 Nightwing was the first, they had to jump start Joker's heart to bring him back. Jason has too if you count the Three Jokers comic (which I still don't know if it is concrete canon or not)

Batman should pull out the "I won't kill you, but I don't have to save you" on Joker just like the way he did with Ra's Al Ghul.
