This is probably the most terrifying and upsetting Cycliq video we've ever seen. Rest assured the husband and wife in this video are alive and recovering.
A note from them:
"Charged with 2 counts of assault, 1 count of reckless driving and driving without a license. He will serve 45 days in county jail and a year parole. This is thanks to the video. Had there been no video chances are nothing would have been done".

"He will serve 45 days in county jail and a year parole." Part of me understands that events such as this involving vehicles generally provide for less severe penalties than someone using, say, a bat or a knife or a gun, and often fall into the legal category of "accident". Part of me even understands why. But most of me wants this man's license revoked for life, and the legal definition of accident permanently discarded entirely.
I reject that accidents include carelessness, unawareness, and ignorance. Those are conditions that are entirely preventable. In this case, he was apparently a "unlicensed, distracted, legally blind driver". There's nothing "accidental" about this. This is gross criminal negligence resulting in grievous bodily harm.
I agree with you for how you see these episodes. In this incident I see a purpose, thinking badly makes you sin but often you guess
fuck 45 days he sure get longer time for 2 counts of attempt murder & or murder charges ASAP also get sued by this 2 bikers.... also that kind of drivers sure be banned from driving for life & also get hit the same way to see how they like it

They were using a vehicle irresponsibly, rather than a bat or a knife or a gun. So that makes it an oops! You only get a slap on the wrist for an oops.

@@jimbob3030 it seems that all too often, vehicular collisions are treated differently to other crimes that result in harm .
Absent evidence of animosity, or drink and drug use, it is assumed to be an accident. Everything from there is charged and sentenced at lower levels.
Absent the video this driver could probably have claimed the cyclist wobbled in front of him, and avoided charges.
Just look at your local road collision killed and serious injuries stats, then look up how many drivers are charged with your local equivalent of causing death or serious injuries by careless or dangerous driving. Every one that isn't charged is basically written up as, Ooops!
The current process (in many countries) sees road deaths as inevitable, rather than avoidable.

Yup...three of my wifes friends have been killed by cars in two years...one was killed by a woman who had just got her licence back after killing someone else.

I used to cycle on the road for about 4 years , I finally quit road cycling because I had many close calls . These bastards don't give a fuck about your life , will pass very close to save a few seconds . Even if you ride at the side of the road ! By the way I ride a motorcycle everyday and I would say road cycling is at least 10 times more dangerous . Because bicycle it's a slow moving vehicle it's considered dangerous because you will be overtaken by many vehicles .
I know it sounds a lot but she runs a large fitness group and they were women she knew very well.
In fact she has dropped the cycling part because of it.
I take them out on offroad rides only and they love it.
My worst fear while cycling -almost got killed a couple days ago on a ride. Absolutely terrifying...

This is why a lot of the cyclists drivers meet on the road can be quite highly strung.

The consequences have to be much higher for drivers when hitting pedestrians and cyclists... we are seen as less than human it seems to the legal system. If the driver caused those injuries with a gun it would have been a much bigger sentence. Why is a car not considered a lethal weapon???
That is a very hard question. A gun is used exclusively to hurt someone. A car is a necessity to get somewhere. If you take part of the traffic you by default accept a risk. The other person in that car wasn’t out to get you. If he was, then a full criminal sentencing should be done. But I think distracted by cellphone. And that is the criminal thing to me. We all accept some risk when going in to traffic. But not getting rundown because someone is apping their GF, boss, neighbor, vague aquaintance. There really should be some way to enforce people have their full concentration on driving.

Well...No. Like many other tools it can be used for number of different purposes. Overwhelming majority of gun holders though keeps their guns not to hurt anybody but to protect themselves. That's a huge difference.

Since I ride mtb, when I’m in the car I respect all cyclists. I would want the same for me.

@Zayd Noor Some folks in the comments are complaining about there being no "graphic warning" to the video. They were apparently jarred by the video, as I was. The graphic part is the video capturing very plainly the vehicle smashing into the rider from behind.
Assault? He tried to kill them! Just glad they are ok. That would put me off for life.

F's Sake you need to put a trigger warning on clips of this nature. That was heart breaking. 6 weeks ago I was very nearly killed on the road, captured the event on my Cycliq Fly12, but the police took the card and all my enquiries to get it back are coming to nothing at the moment. Either which way I'm having appalling flashbacks, and after 6 years of daily adventures and journeys on my bike, I know I will never ride again. I sincerely hope the riders in this clip were compensated for the devastating injuries this must've caused and I hope the driver is doing jail time.

@@ledzeppelin1212 thanks for the kindness. It's weird, but I know there's both cctv and my onboard camera footage available of the collision, and yet I haven't seen either. I don't know why but I feel that I have to see it before I can move past this certain phase and trauma.

Just fucking wow. If there was no video evidence the guy on the wheel probably would have gotten away with it. Thank god the 2 cyclist survived. Had a few moments like these in UK. I always have a rear and front camera. Point at the camera when I hear the car behind is being impatient. Then they usually slow down or wait until the other side of the road is clear for them to safely overtake.

I commute daily in NYC, and even I would never do those along-the-highway rides that you guys do in the suburbs. Those cars are going way too fast, and people suck at paying attention. Hope those two are recovering well.

Driver claims to be mostly blind. Didn't have a license. Still deserves years in jail, not days. Article says the driver has to pay medical bills. But that's meaningless, the man who was hit will never ever be the same. Article also didn't state if the driver had insurance. I'm doubtful. Beyond the jail time, the driver should have to sell all his vehicles, his house, and cash out his retirement to pay the guy that got hit.
I just feel for the couple. The crash is just outrageous.

@@timgreen1835 when I hear the phrase "terrifying crash", I think of a cyclist induced crash. Not someone getting ran down and plowed by a vehicle. Maybe a title of "Cyclist hit my motorist" would be more fitting :)

Let's not forget that while the driver got away with attempted vehicular homicide, the civil engineers got away with reckless endangerment. Such road design is clearly hazardous for shared use.
May I suggest stopping blaming anyone other than the operator of the vehicle? If the road is unsafe, why was the operator on the road? Why are cyclists/victims blamed when they are where they are permitted. BTW, this shows the challenge of the take the lane argument. I not able to tell if a taillight is on either of the cyclists. While I agree there is no need for a taillight in this situation, I am a firm believer is being overly visible. I say if they hit me, they were aiming for me because they had to see me.
@@mitchellsewell275 I'm pretty sure they weren't victim blaming the cyclists, but saying that having the road designed like that and expecting it to be safe for all users, cyclists included, is insane on the part of the traffic engineers.

However, I think most of the time the perception is it was unsafe for the cyclist and the cyclist should therefore not be using the road vs. it was unsafe for the vehicle and therefore the vehicle operator should not have been on the road. Or, the road is unsafe for all users and no one should use it.
I am always conscious of the light or sound shadow i.e. I'm looking for shadow going from 12 o'clock to 10 o'clock if the car is passing on my right. I was wiped out like this only from the front so I'm hyper vigilant. I hate the pain of broken bones.

Should have known it was in the USA, the land of cars. For driving legally blind I am sure the punishment would have been far worse than this in the UK. Although our punishments need to be worse.
