Bodycam: High School Band Director Tased By Cops For Refusing to Stop Performance

  • An Alabama band director was arrested for disorderly conduct and resisting arrest after he refused to stop his band’s performance at a football game on September 14. Johnny Mims and his more than 140 student ensemble were almost done with their last song when Birmingham officers approached Mims asking him to stop their performance and exit the stadium. When he refused, Mims was tased. The Law&Crime Network’s Elizabeth Millner explains what happened next.

      He disobeyed the officer’s orders in front of the students so he got arrested in front of the students. The set a bad example that it's ok to be disrespectful and disobey an officer. He should be suspended or fired for his actions.

      @@ihatesmurfs84 The cops were just trying to enforce that stadiums policy about no 5th quarter preforming, the band is supposed to leave at the same time as the football players leave the field for safety reasons and the band director chose not to follow the rules and it ended up like this....

      This is commonplace in this style of band, it’s what the kids and parents sign up for. If you don’t like it don’t put your kids there. The band director had permission to be there with the other band who was there at the time.

    The Director should never have put those students in that position. I had been involved in every level of Marching Band from High School Varsity to All American and the one thing I appreciated about all of the Directors is they cared about the students safety and were responsible for them. When the Police say you need to leave and you say "What you gonna do?" His ego superseded the responsibility he had to his students and his position. The Director made the decision and got stuck with the consequences. A failure to put on that display in front of those kids.

    I used to be in a HS marching band. We NEVER stayed rehearsing music afterwards. We were off the stands and into the buses once the game ended. At most we used to play the "alma matter" song as the football team cleared the sidelines. This band director asked for trouble. Bad example.

      He stood up for himself and showed his kids they don't have to back down, and he will win in court big time. The civil suit give it a week or 2 and the prosecutor will drop the charges, bet. They violated the constitution without any legit cause. This one is a slam dunk, bet that lawyer is working for free till the city of Birmingham settles.

      Here's hoping it quick. Very obvious this band director is a passionate one, these kids worked hard to get that kind of sound and they deserve, and were alotted, that time. Cops need a job, can't even handle non-violent situations. On top of the fact that they idiotically yelled they're gonna call the superintendant, should have shut up and called them. There may have been other circumstances behind it all but if the police were involved there’s likely a legal or potential legal reason they continued to get them to leave. It’s likely a property issue. They can’t just stay there because they’re faculty and students. It’s not their property.

    Whether the guy thought he was in the right, if they tell you that you assaulted a police officer, don't resist. Much better to have your day in court than get tased or a potentially much worse outcome.

      Yea you’re right. At the point the officer decided to arrest him he should have complied. The second he put his hands on them is resisting arrest and makes the taser a reasonable means to control the situation. He is lucky they didn’t decide to use the baton which would also be a reasonable option.

      If you have never been in a marching band you don't know the kind of relationship the members have with the director ( an no it's not That Kind of a relationship). Yes this was a clash of personalities, but the students seeing their director surrounded then Tazed is because of the officers bad choices and the police could have avoided it with some patience.

      There was no reasonable expectation of harm if the noise continued. There was no violent crime being committed, there was no violent action that was necessary from the police.     He knew when he needs to stop the band - the lights were about to be turned off, as per schedule. He decided to push, push, push. It's what belligerent jerks do.
    Refuse a lawful order, get arrested. This jerk refused a lawful order. And was deliberately and childishly belligerent, encouraging the students to "screw the cops". Great life lesson there.
    Oh, and he resisted arrest and struck an officer in the process. A belligerent Ratchet is still a Ratchet. His 50,000 volts were well deserved.

    Speaking as someone who lives right next to a high school with a huge stadium and competitive color guard and marching band, there are reasons why bands are not allowed to play after a certain time. It's hugely disruptive, especially to families with small children. These band instructors were willfully and carelessly disregarding that.

Are they just supposed to deal with excess noise late at night because they chose to have kids that legally have to attend school? Many towns also have a curfew and by continuing to let the band play they may have surpassed that curfew, which is disruptive to everyone in the area.

    Here in South Florida, the bands play a few songs after the game ends. Cops and instructor should have collaborated. Cops were also wrong, they just walk to an adult and demand things. It could have went..Mr. instructor you have x amount of minutes, then could you please call it a night. Sometimes, we adults like to be spoken like adults.

    Teaching kids to be disrespectful and not follow laws. This example could potentially put a lot of these kids in future danger if they learn to immediate be defiant for no reason. There are noise ordinance laws. Pack up and leave. Why can’t people just be normal to one another.

At the very least, the director could have tried to communicate with officers and possibly get them to let the last song go through. But nope he decided to make a bigger deal.     I've worked in security for a very long time, we always give leeway of at least 30 minutes as clearing people is often time-consuming. We've never had to physically assault anyone. Using police as security is not a good move as they resort to things most security staff wouldn't consider.

      You're right the officer should lose his job. It was a school administrator on school grounds who has every right to be there playing with his band in the dark. It is not a lawful order from a police officer telling a school administrator to leave when he has every right to be there.

      As a matter of fact that the cops are the ones that didn't have the right to be giving those commands. Officers enforce the LAW not requests of random employees. If the officers are not enforcing the law theb they can't tell you what to do. Learn your rights.
      The only way the cops could have got the legal right to remove him was if they called the superintendent and got permission to trespass him from the property.
      That would have been the legal route.
      You just watch all charges will be dropped and he will file a civil rights lawsuit against these Karen cops and easily win.
      It's an open and shut EZ clap case.
      No laws were being broken and therefore no reasonable articulable suspicion of a crime and no probable cause for an arrest exists.
      Definitely not enough to justify a violent apprehension and triple taser deployment not to mention all of the bogus charges they tacked on just out of spite. That is called retaliatory charges and a malicious prosecution.

He wasn’t breaking any laws and didn’t have to leave just because they told him to. The cops aren’t your dad man. You don’t have to just do whatever they say.       law enforcement in this video are bad examples because they don’t know their laws.. noise rule is between 10pm-7am they were told to stop playing at 9:55 (not 10) also let me remind you they’re allowed to stay for fifth quarter that’s when both bands play that goes for every school high school to college fyi, which also if i remember correctly they get 20 mins and they were told to stop 10 mins after the game was done.. now tell me what law that violates…
