      What law makes it legal for cops to seize your personal property without physical evidence or no grounds? It certainly appears this law was designed to encourage crooked cops to not serve and protect citizens. I guess all citizens will have to become lawyers just to enjoy freedom. They didn't find anything in the phone or the car and the guy still got processed like a criminal. At least he was the lucky few that got back what was stolen

      Tennessee police are worse than any other police dept when it comes to seizing money and property from out of state drivers who pass through Tennessee, One elderly man coming from TX was stopped on I40 EAST and after he was searched and his auto ripped apart and nothing found he said the one cop told him to open his mouth to see if he had any gold, he said they got mad and told him to move his ass on which he did, he said he counted six cars and two big rigs being searched and families with kids sitting or standing in the cold while their autos were being searched and torn apart.

      Oh yeah the screwed up part is a lot of time they will intimidate you into taking less as well. Under Eric holder they were targeting gun stores with "asset forfeiture" remember one guy had six figures stolen from business account essentially stopping him from paying payroll or buying new inventory killing his business. Something along the lines of transactions around certain limits made it suspicious.
      Anyways when he showed up to court with a good lawyer immaculate records and book keeping. They essentially blackmailed him said we will give you half back if you fight us on it we will tie this money up in court for decades.

      As I'm traveling the interstates and byways of America as a trucker I'm still amazed at all the fools who consent to a search. They will call backup and completely toss your car. I see this every single day. Oh yeah, money can now be scanned and seen on a Rad scanner so protect your money.

      Don't consent? Sorry, but that's textbook law, not real life. Getting consent is just a formality. If he says no, they'll find a way to get a warrant... and then later they're pissed off and tearing his car apart because he didn't cooperate. If he's lucky, they won't find any drugs that "mysteriously weren't there when they stopped him".

      They do what they want. I had the police try to sell my car on police auction. A year later the court awarded me the car back. 6 months later the police finally gave me the car back. When i asked where it was, they claimed they didnt know.

      Dee-Jay Javi Exactly what I was thinking...he wound up losing over half of it because of lawyers fees. He needs to sue the cops individually, (but they probably have qualified immunity). Or the police department and state. This was so obviously asset forfeiture. The sad thing is this naieve kid and the driver had no clue about their rights and were honest and look where it got him! Cops don't care about citizens or our rights. We are viewed as criminals and revenue generators...that's it.

      They were fools to allow the police officer to search the car, He was a fool to allow them to open the back pack and he was a fool to give him the key to open up the lock box, He was a fool to allow him search his phone.
      Their should be a law, where cops have to tell you your rights, before they are allowed to speak with you. A law requiring Police to let you know you have the right to refuse a search, without predjudice or Vindicitveness. You have a right to remain silnet and not answer any of my ?'s.
      Suppose you say i came from "X" town, the Pokice officer then asks you where your coming from, and you reply, Ohh, I came from "X" town, Now a Robbery took place in "X" town and it was two Male Hispanics. Guess what? You came from "X", You are both male Hispanics. Now you are both going to be detained until they verify it wasn't you. That can take days, until they find the witness that cliamed it was two hispanics. That is why you never tell them where you are going to, or where you are coming from.
      It's non of their Buisness, what the hell does that have to do with a ticket? Nothing. They are fishing and looking for an Excuse to make a casd out of anything for any reason.
      Don't be fooled. The more ?'s you answer, the more they can detain you.
      Even if he ask's you where your coming from or where your going, tell him striaght out, none of your buisness or if you choose to be polite, just say i choose to excersise my right and remain silent, please issue me a warning or citation and let me go on my way. If he continues to ask ?'s You repeat , Am I under arrest? Am i Free to go. I wanylt my lawyer now and your cammanding Officer here to the scene as i do not feel safe with you at this time.
      Make sure your phone is on at all times and send it live, just incase they try to take your phone.
      Cop's only make money when they make arrests, "Overtime" and "Promotions" by Arrests.
      They law is an Evil Entity.

      @Bud Grimfield There is no law stating the maximum amount of money to legally carry on your person. I think you got it mixed up with the federal law regarding U.S. Custom Border and Protection. That law states you can carry any amount of cash on your person but if you are traveling in or out of the United States and it is more than $10,000 then you have to declare it. You can carry $100,000 on your person if you want and it still be legal. Just don't flaunt the cash to the police to raise some suspicious looks.

You have never heard over 100,000 news stories about individual cops killing innocent people. It happens occasionally. There are way more cops than news stories about cops. Most of the times you do hear about killer cops, they are shooting criminals who didn't follow orders. When you aim at a cop, he has the right to defend himself just like you have the right to defend yourself from a guy who comes into your home. We all have the right to defend ourselves, including cops.

    PSA: Never consent to a search without a warrant even if you are innocent. If the police are asking to search your vehicle they are already suspicious for whatever reason and you do not want to give them any grounds to abuse their power.     This happened to me 2 years ago in Mississippi, they pulled me over for swerving ( one of there bullshit reasons) they asked to search, i said no, they called for k9 and said the dog was alerted to drugs (bullshit) upon searching they found 15k in my briefcase and said they were gonna seize it, I responded by telling them i am not gonna fight with all of you on the side of this highway over this money, but i will fight you in court because i have a lot more money where that came from, and i am gonna go for the profits and interest that i would have made from that money, seeing that you are interfering with my business, they huddled together for 5 minutes, thought about what i said and returned my cash to me. I don't know when it became illegal to carry hard earned cash, but this road piracy needs to be stopped before someone reacts with violence to being robbed of what is rightfully and legally theirs.

      Yup!!! I agree. When those 5 cops in Texas got gunned down all I could think about was instances like what we just saw on this video.
      Most people would rather just do good and live their lives out in peace. But one of these days one of these cops are going to screw over the wrong individual and there will probably be many cops (who had absolutely nothing to do with the original incident) who lose their lives as revenge. They should stop pretending that this stuff doesn’t add up and creating diversions to cover up their atrocities such as saying “it’s the media’s fault people hate police” which is bullshit.

      If you have around $10,000 in cash or more then you should also have the documentation to show the source of those funds. If you don't then it is safe for them to assume that it came from illegal sources and confiscate it until you can prove otherwise. Just because you don't agree with it doesn't mean it's wrong.

    I had this happen to me traveling through Wisconsin. They took my money ($3700), computer, phone, impounded my car, etc. Found absolutely NOTHING illegal. Took me over two years to get the money back after I had spent nearly as much on lawyers. They denied ever taking my computer so I was not able to get it back. Needless to say I will not be going to Wisconsin again anytime soon.

    Well, the good news is that the court ordered the money to be returned to Michael Sachez-Ratliff. I sincerely hope that he will be compensated for the legal costs spent to get that money back (and for the officer(s) disciplined).

      David Hollingsworth they won’t reimburse that at all. No one has EVER successfully sued a department and won their case against wrongful seizure. He would’ve spent at least another $7k just to do THAT process as well.

      Great point. I just left a lengthy comment on this very issue. Many citizens, if not most are unaware that if the case is disposed of in your favor, you are entitled to an award of reasonable attorney's fees and costs for defending the case. This is codified in the state statutes of every state and supported by valid case law. After the disposition of the case there is generally a statute of limitations with which to file a motion for these fees and costs. Usually 14 days but varies by jurisdiction. As a rule of thumb, never trust anyone in the judiciary. The citizens are ignorant to the law and everyone within the judiciary preys upon that ignorance. I am currently researching cases from multiple jurisdictions to find out if counsel for the winning defendant has gone back after the dissolution of the case and filed the motion for costs and fees and if so, whether or not the defendants were aware and received compensation or the attorney double dipped. I do not trust attorneys and judges nor should anyone else.
      Be safe sir and as I inform everyone I speak with, study the law for at least 30 minutes a day. The world is controlled by laws and if you are not aware of them, you are controlled by both people who don't and people who do. Let's face it, if you are unaware of the law, how will you ever know if the person who is telling you the law is accurate or not.

      When he failed to tell the cops about the second bundle of $10,000 in the safety deposit box and told them he only had the first $10,000, he fucked himself. He could've refused to allow them to search his backpack, but then they would've detained him and gotten a warrant, making things even worse for him.
      If he had've just said "I have $10,000 in my backpack and another $10,000 in my deposit box", then tell them the reason why, they would've let him go. I know I've had to do it myself when buying cars.

    If I bring a unwarranted civil suit against someone and the court finds in their favor, then the court can order the plaintiff to pay legal fees for the respondent. Why don't we just pass a law that says when the departments seizing this money are found to be in the wrong that THE DEPARTMENT pays the legal fees for the plaintiff in their effort to get their property back. This way even if some innocent civilian is inconvenienced with the police putting their life savings on trial, at the end of the day it doesn't cost them to get it back. This would make it easier to get attorneys who would work on a contingency basis, and innocent people would not get monetarily punished for having done nothing wrong. It also by proxy would financially punish departments who abuse their sizing powers, thus negating the temptation to seize property without a good amount of evidence since it could cost them to be wrong.

So the police are forced to return the money and then our taxes will be used to pay the costs.       Yes and no because if you don't seize steal stuff without merit you wont get in trouble I know several police departments that it is policy to take any cash when pulling over out state people. Because they know people wont travel back to state and spend more money fighting it in court.
      So all they have to do "not to pay the penalty" stop taking peoples valuables. Seriously that easy in order to not lose money. Also not the careful wording "unwarranted/frivolous" if they just take any money they stumble across forcing you to fight them that is "unwarranted" if they found a pile of cash next to a pile of drugs that is warranted.
      But sad thing is yes some town places will get hurt by stuff like this but fact is they act in a way to keep locals ignorant. Like the "out of state policy" of just stealing whatever people you pull over have on them. It fluffs the department budget makes department look good to locals, who also don't know what is going on. Fact is without repercussions bad behavior will continue. Especially since this allows bad agencys to bypass oversight. We the people view cops negatively we don't vote for politicians looking to give cops huge increase in budget. Which makes them go maybe we should stop beating up minority's and gay people. However the biggest danger with seizing is fact they can grow budget far past what was given to them.
      Even if we do not go for the allowing people to recover damages such as legal fees for cases where seizure was unwarranted. I definitely think that no government agency should be able to go past budget period. Seizure money should go back to federal pot for "cooling" period if unclaimed it will go towards "debt". Same goes with fines. The only ONLY outside money beyond budget should be fee's IF the fee is comparable to the service rendered and is voluntary not punitive or compulsory.

That's for both checking and saving, so basically you can't use hundreds of dollars so they can make money off of it or you'll be taxed. Also they will bill you at every possibility. Charged me 10 dollars for a cashiers check that likely cost them less than 5 cents.

      They are right about this. It happened to me once already. They had a k-9 search my car. And the k-9 had a so called signal.... They took like one hour and a half searching no car a taking it apart and found nothing.... We had bought a 🍔 and they blamed it on that. That he had probably smell food. So no matter what you do. They will always have a excuse. Trust me when I say that.
      That shet was funny to me cause they ain't feeding there k-9 that well them.

    And here's the problem, we're expected to remain civil. His family went through great lengths to get him started in life, and he was ready to not disappoint them. Yet *this* is what the government did to him. I cannot convey the amount of hate that watching this video engendered. Yet, we're expected to remain civil. "Oh, it's OK, that's how we catch the bad guys. We need CF to fight traffickers and cartels."
    The pattern is obvious. All police departments, across all states are corrupt. Police are the physical arm of the government. Incrementally, their jackboots squeeze down on our throats.
    I am leaving. My level of awareness on these issues has increased to an extent that it is better that I go away. I am not a citizen, so the United States government will have no leverage over me. Wherever I go I will teach people the depths of failure that exist here. I will preach divestiture from the United States. I don't wish to do the people of the United States harm, but this is insane. Collectively, the citizens of the United States are sheep.

      he was a valet so he cant physicaly show how he got the money and his grandmas half she would have to show proof of the income as well via receipt bank transaction or something. been thru this multiple times with the laws. first time as a teenager with only 1600 on me and the last time as an adult with only 13000 on me witch was for for traveling expenses and money to gamble in vegas. the officer had his own story and tried to make us agree to doing something illegal. so I went to jail for money laundering because I didn't agree to his story and had to pay 11000 to get out on bond since I was not from that state smh. ruined my life for 3 yrs trying to get back on my feet.bottom line if your making money u cant trace go and pay your taxes on it so its legally counted for. even if its illegally made pay them taxes to make it traceable.

    This is an example of getting laws for one reason and than misused/used for another reason.
    That some police departments use this to fund slash funds has also surfaced.
    This law most likely ushered in to "combat" gangs/drug crimes.
    That it now often costs people thousands of dollars in legal fees to get their hard earned wages returned is truly not just.

      Not in the US, I test drive cars and we have a laser trap that shows the exact mph of a car to test for speedo inaccuracies and US cars show the exact speed they're doing. The only cars that read high are Euro spec, where kmh shows 3kmh higher and mph cars show 2 mph higher.

I told him I replaced my flate tire a few minutes ago and hand were all dirty. So I told your going to shoot me for replacing my tire? He let me go with a warning.

      QargZer you must be a cop. Once the traffic stop was completed he should have been free to go assuming he provided identification to inquire about warrants. You’re not obligated to answer questions to a cop about where you’re going, where you just came from, or any of that. And you don’t have to let a police officer search your car unless they have probable cause as in smelling drugs, etc and a cop cannot make you wait to call a K-9 unit technically. Now with that being said a cop will say or do anything to say he has “probable cause” to search someone’s vehicle, and cops are legally allowed to lie to you without repercussions. Now the fact that he had 10,000 dollars might raise suspicion because of the Bank Secrecy Act passed in 10/26/1970 enacted by the 91st United States congress and signed by president Richard Nixon to fight against money laundering, tax evasion, and criminal suspicion. In this situation yes he should have been compliant as in providing identification and complying with the traffic stop but that’s where it should have ended. They didn’t need to answer any questions asked by the officers about anything else other than the traffic stop and are not required to do so unless on probation or parole, and they definitely shouldn’t have given consent to have the vehicle searched because there was no reason for it other than they were 2 young Hispanic males in the city of Chicago which is known for criminal activity. I don’t want to play the race card but In this instance they were profiled simply because of this. If it were a middle aged Caucasian woman with a nice suit on or medical scrubs the officer wouldn’t even have asked to search the car. Plain and simple. I love my country . I respect military 100% but I cannot say the same about more than 50% of police officers. They are supposed to protect and serve but unfortunately they abuse their power and harass and profile. Unfortunately this is supposed to be the land of the free but we have more people incarcerated in America than any other country in the world, and it’s not likely to change anytime soon because the U.S economy thrives off the criminal justice system. The people of this great nation is overly policed and overly incarcerated. It’s a shame really. There are some good cops out there but the rotten apples gives them all a bad name. My uncle is a cop In the FPD and I love him to death and I’m thankful he’s one of the good ones. God bless America. Even with the tragedy of what’s going on with the abuse and profiling of police on minorities and people of low income. I still wouldn’t want to live anywhere else but my America! God bless the good police that are out there.
