Pom had also sent his name and clearnet email address in a private chat to the owner of Raid forums at the time. The Feds acquired all the information they needed from his Gmail account as well as a subpoena to relevant crypto exchanges with his suspected wallet information at hand. The FBI could have simply made it up. The US legal system has a horrid history of falsified evidence, fake criminal charges, and forced plea deals. The FBI itself was created to harass and threaten civil rights leaders; and the US justice system has an even worse history of corruption. It's just as likely that they added that charge on so that the overall charges are more damning and that fighting it in court would be potentially damaging. Without the CP charge, his crimes arent too damning in the eyes of most people and the guy might try to fight it in court. With this tacked on charge, his best option is to just do what he is told. All footage used comes from youtube so i thought it would follow that my video would also be allowed. I myself do not participate in any meeting of confrontation of any party, I'm simply reviewing the details of the case in a detailed manner. Other videos on the same subject are still live on the platform mine is just the most updated version. Before making the video I extensively studied other channels and videos that are similar in structure and subject matter even up to the naming scheme. It was not my intention at all to harm anyone though my video I'm simply documenting what i thought was a notable chapter in the online world. Upon receiving the strike i took youtube's guidelines training and within it they give an example that coincides with my video almost exactly, their conclusion is that that video does not break the guidelines and is permitted. They explicitly state that my video is allowed. When I tried to appeal it was immediately rejected by what i assume was a bot as its a 30 minute video and there's no way a human could have reviewed it in that time. They gave me no specifics as to what part violated the rule either. I just wanted to share something I worked hard on, I hope that they'll treat my channel fairly and not restrict me just because I'm smaller. I don't really know what to do here, thanks for your time. Ill try and upload the documentary on a different platform, im honestly too scared to reupload on the main channel

Here's the thing with a guilty plea deal. You don't make the rules, nor do you fight it. You just accept those charges. So let's say there's a charge that's technically false or not something you're actually guilty of. You can decide to not take that deal, but with what he was already facing, they probably could have just taken him to trial after that. He may win the case against some of the charges like the CP, but he'd be basically looking at hundreds of years in prison for the rest of the charges. This is why plea deals should be taken with a grain of salt for what the charges are.

A prosecutor is under no obligation to drop something and can instead just threaten with a trial, which would easily be a loss for him and significantly more time. You can say you won't take the deal and they could make it worse. They might also make it better. This isn't like you're haggling at the flea market or something. The prosecutor is making a full deal with you that is already agreed upon and printed/typed up. It's not like you go "Well, I disagree with this part of this" and they go "Oh, my bad. You right. Let me just touch this up real quick". A prosecutor has to have an agreement on all parties. And in most cases have to have approval from their supervisors. His options were limited to begin with. They could even drop a charge he asks for them to drop and they bring up more charges elsewhere and increase the time.

How does that work exactly? If a hacker breaches your data and the FBI takes them down. Does that mean that breached data is now fine for the FBI to use, even from the people who got hacked? They didn't actually do the collecting of your data so technically they didn't invade your privacy to get it. I always wondered about that.

If you mean they find out someone is committing tax fraud after looking through the stolen data, I think they still have to get some sort of legal approval to use it as evidence and even then it could be difficult.

I made a video documentary detailing a recent edp situation that occurred on the platform a few months ago, within a day of uploading it the video was removed for violating the harassment and cyberbullying guidelines. The video is expressly informative and in it there is no comedic aspect or making light of the incident. All footage used comes from youtube so i thought it would follow that my video would also be allowed. I myself do not participate in any meeting of confrontation of any party, I'm simply reviewing the details of the case in a detailed manner. Other videos on the same subject are still live on the platform mine is just the most updated version. Before making the video I extensively studied other channels and videos that are similar in structure and subject matter even up to the naming scheme. It was not my intention at all to harm anyone though my video I'm simply documenting what i thought was a notable chapter in the online world. Upon receiving the strike i took youtube's guidelines training and within it they give an example that coincides with my video almost exactly, their conclusion is that that video does not break the guidelines and is permitted. They explicitly state that my video is allowed. When I tried to appeal it was immediately rejected by what i assume was a bot as its a 30 minute video and there's no way a human could have reviewed it in that time. They gave me no specifics as to what part violated the rule either. I just wanted to share something I worked hard on, I hope that they'll treat my channel fairly and not restrict me just because I'm smaller. I don't really know what to do here, thanks for your time.

Here's the thing with a guilty plea deal. You don't make the rules, nor do you fight it. You just accept those charges. So let's say there's a charge that's technically false or not something you're actually guilty of. You can decide to not take that deal, but with what he was already facing, they probably could have just taken him to trial after that. He may win the case against some of the charges like the CP, but he'd be basically looking at hundreds of years in prison for the rest of the charges. This is why plea deals should be taken with a grain of salt for what the charges are.
You can definitely negotiate charges being dropped as part of the deal, it happens all the time

A prosecutor is under no obligation to drop something and can instead just threaten with a trial, which would easily be a loss for him and significantly more time. You can say you won't take the deal and they could make it worse. They might also make it better.
This isn't like you're haggling at the flea market or something. The prosecutor is making a full deal with you that is already agreed upon and printed/typed up. It's not like you go "Well, I disagree with this part of this" and they go "Oh, my bad. You right. Let me just touch this up real quick". A prosecutor has to have an agreement on all parties. And in most cases have to have approval from their supervisors. His options were limited to begin with. They could even drop a charge he asks for them to drop and they bring up more charges elsewhere and increase the time.
