This case is an example of using this system in a false manner and could result in a talented RUclipsr being removed off this platform. The only way copyright abuse will end is if we abolished copyright laws that are virtue signaled to help protect small creators from having ip stolen when in actuality court is pay to win and big collective corporations steal ip from creators and keep them from doing it on their own as a standard practice so intellectual property is just a way to control thought and the economy with only approved corporations just like what mussolini and hitler were doing with their country's corporations.

Seems like someone wants to get some likes on their meaningless comment.
It is the way MagnatesMedia's editing was so much more dynamic than Business Casual's as well. Color grading, dramatic effects setting a narrative tone. Wouldn't be surprised if Business Casual got jealous that someone out performed him with the same resources.

Case in point. Why is it that the Copyright section of RUclips only shows Removal requests that the creator themselves submit but doesn't show ANY information about requests that have been submitted on the entire catalog of a creator's own videos? ¬_¬

The parallax effect is a really easy trick and we see it done by fashion companies on social media posts all the time. Unbelievably deplorable that business casual is filing a copyright strike over this. He knows what he is doing, and it is malicious.
I suspect it can even be automated to a significant degree with neural networks (separate image into layers by guessing distance, which NNs can do really well IIRC, and fill in the gaps by extrapolating the image, which NNs can also do quite well)

Illuminaughtii did apologize for the Legal Eagle thing and a few other points, first in private then in public and publicly said she was wrong. Not a lot of tubers would do the right thing there. Legal Eagle of course, was a true gentleman and accepted her apology and never made a video about it so I tend to side with him.

There should be a three strike system for copyright abusers. If you are flat out using the tool in bad faith, and you can't show that you had a legitimate reason for submitting a claim, you get a Copyright Abuser strike. Three strikes and you are off the platform. That system should feel a bit more fair on both sides of the aisle.

Knowingly false (especially malicious) copyright strikes need to be treated like defamation and charged criminally. The most insane aspect is that you don’t even need to copystrike from the effected channels verified account or prove to any reasonable capacity whether you even have the authority to copystrike in the first place. Which is especially dangerous because even if RUclips flags an account for filing illegitimate strikes it doesn’t even matter they can just create new accounts

I watch Upper Echelon's coverage & thought It would be dope if you covered the story in support
RUclips never knew how to handle copyright infringement cases. Instead of proper investigation I bet they just look the video upload date and glance over videos to see what looks the same. RUclipsrs should be covering and fighting these cases to force RUclips to do more research on each case they get.
RUclips isn't involved in the process at all. It's between the claimant and the person being claimed since there not allowed to give legal advice

It's unrealistic. RUclips is *insanely* large now. It's thousands of videous each and every hour, you *never* will be able to afford proper amount of human reviewers for copyright claims.
And it's not about money! Every system that relies upon human resources in this scale unavoidably becomes corrupt. Look at some of twitch's moderation and how "fair" that is.
So you would need a veritable army of people, and smaller army to overwatch them, and some people to coordinate those.
You just won't get enough people for such positions, let alone make it all work and be affordable.
Oh, and considering INVOLVEMENT IN ANY LEGAL ACTIONS - this is basically a giant death flag for ANY corporation whos' product is a platform. It's like a suggestion to willingly cut your own finger with a kitchen knife because "well, that would be a right thing to do".

I mentioned this on business casuals original video comments back when he first uploaded that deceptive video. If you look at the copyright that he filed for those videos, he literally states in the form that he filed that he claims copyright over everything, but the public domain images & any versions of them featured in his videos. He KNEW he couldn't claim copyright over those yet still acted like RT "stole" from him.

RUclips needs to let us police ourselves a bit, but they need to do it the right way. RUclipsrs like you and Charlie would be perfect for this because you're generally just calling out problems you see and trying to protect the platform for everyone. But yeah, we need you guys and many many other RUclipsrs big and small to essentially become RUclips's moderators. Obviously RUclips has been having issues finding actual people to review these kinds of situations, so there's the fix.

@@gadisprettydum they can do a ton about it. A lot of it- like the strikes are basically prior to an actual full legal charge. Essentially if it isn't a serious issue YT/google handles it in house.
@@gadisprettydum fraudulent claims are a huge issue. They have finally charged a few folks for me t- like a serious legal case, and iirc he ended up having to pay like 20k per false report. One issue though is that larger channels have done the same but they don't get taken down or get a strike for it, they just seem to slide by and keep dmcs trolling. Well sometimes they hit a point or the wrong person and end up taken down.
Filing a false report like that is a serious legal act, it points out on the page how serious it is, although YT/goog isn't great about it, it's another of the many issue with the system.

I think a good solution is: process the copyright strike, but until it actually goes to court and settled, business as usual. That way, people won't lose their income.

That type of claim abuse should even be punished, you shouldn't be able to falsely accuse someone, legally threaten them, and when proven wrong get away with it like nothing happened.
Last time I heard of Upper Echelon, he wasn’t really liked all around (especially by DOOM fans), but to see him change so suddenly and exposing sacks of shite like this guy genuinally and pleasantly surprised me.

How does RUclips not have a system in place for this? How hard can it really be? I'll admit I don't know or understand how all the legal stuff here works, but why can't YT have a department of people that review these strikes and if it gets deemed as a false strike then the one that issued the original strike gets it reverted back to them as a consequence of the false strike? This, theoretically, would not only make it a much bigger decision whether you strike other creators but also shut down channels that abuse the system.
It is _extremely_ time consuming and expensive (wages.) Google does the _bare minimum_ by basically *avoiding the problem* instead of getting involved with he said, she said.
Could Google do better? YES!
1. BOTH sides should be able to upload images & videos in a “rebuttal” section.
2. Assumed guilty needs to go.
The current system that allows literally anyone to troll others with ZERO evidence, and the victim is ASSUMED to be guilty first and that they must prove their innocence is a HORRIBLE state because this allows for copyright trolls such as Alex to abuse the system by silencing critics.
3. Remove the 3 strikes.
4. Place penalties on those abusing the system.
But thus would all take “work” so Google won’t do it.

My original gaming channel was copyright claimed 3 times, manually by a no name (but good) rapper back in summer of 2020 and the channel was terminated. Yes, he gave me warning, but I bought his music and should know better not to attack his fanbase giving him money for his music. When it comes to the internet, most material can be used and reused over and over as a public domain under the Copyright Act of 1976 under the term "fair use." So, musicians should know better not to hunt down the user that bought the material and use it under that law (or laws). Good reporting on this similar situation, Mutahar.

A: Copyright takes into account how much of the original content is copied, and what the damages are: This claim would be thrown out in court even if the 7 seconds of footage used as example were directly lifted from the video.
B.Using the same script and re-creating the video yourself would not be covered in copyright, it doesn't even fall under fair use: its a completely new thing. Copyright is not a patent for ideas.
the problem is, it's prohibitively expensive. DMCA doesn't work , it gives the impression of working. the default case is to go to court. but no one wants to do that because it is insanely expensive. one party will admit fault, or both will be too afraid the other guy puts the better performance, bringing them financial ruin. or ofc, the lawsuit does happen and one party gets financially ruined, typically beyond recovery, regardless of if they were actually in the wrong.
