- Hello guys and gals, it's me Mutahar again! This time we take a look at Adin Ross and a fellow group of streamers who have been using the Content ID system to harm this platform. RUclips claims to have actual consequences but I've yet to see them enacted. Thanks for watching!

Honestly, I would use the clip in the video and hardcore sue Adin. The person would likely easily get $100k out of the suit.
Then, they might even be able to move onto suing RUclips as well, but RUclips can hire more/better lawyers than any creator. Not to mention, they'd get kicked off the platform if they did sue YT. Wouldn't be worth it if they didn't make enough from the lawsuit to make ends meet or something.

That's super funny that I was mentioned in this video. Yes. I absolutely did have to ultimately create my own game as a way to not get copyright striked by malicious developers. The fact that creators like myself have to resort to such extreme measures to avoid such absurd exploitation is insane lol but on a positive note, I do appreciate that it pushed me to get into game development. However, I think the main thing these malicious developers need to understand... is that they can and will be replaced if they continue doing this to creators.

I still don't understand what people see in that scum.
The most infuriating thing is that there's no repercussions or penalties for false claims, unless it gets dragged to court (which oftentimes is financially out of reach of the small guy). If there's no penalty or risk hanging over submitting false claims, it leaves the door open for abuse.
unfortunately that's a consequence of the ground rules. This system is a trade-off, a way for RUclips to exist without any big rights management company or music label suing them to kingdom come. If they start messing with it, a company might get fed up and go to court, and RUclips might well lose. That's how the current copyright system works, and in a way they're absolutely right, thry might be assholes but they're right
The copyright system definitely needs reworking, not because it's unfair in what you can do, I think that's completely ok, the problem is it's so expensive that youccan bully people into settlements unless it's at the level of Disney vs Jukin Media. Small claims kind of seal would be great, just that people on RUclips especially have an incredible sense of entitlement regarding copyright law. I, for one, think fair use as it is is enough, react content is absolutely in the red if it's a watch party, less so it's carefully scripted and cut and doesn't use more of the original than necessary, weighing if you're replacing the market product you're using fairly, etc. Since that's not black and white, you need courts, and we do desperately need a less financially detrimental way to rule these things the way they're intended (in court or something similar)

I like how you're addressing why the copyright system is the way it is, because I notice a lot of people don't understand that part about it. It *has* to be this way for RUclips to exist at all. There definitely needs to be better moderation however and less threatening warnings about how us creators can receive a channel strike for falsely disputing claims. Lots of room for improvement still, but the current groundwork is unfortunately mandatory.
just like you said, the problem with moderating what is essentially copyright court lite is that this is all an agreement that keeps the big dogs happy by giving them what they want, and in return they abstain from suing RUclips into the 7th dimension. So, when you start encroaching on these systems, as right as you might be, as a platform you face the very real possibility of at least one of these companies saying they're done, and suing you into narnia with the rightful argument that RUclips was not taking sufficient precautions as to prevent their content getting uploaded without licensing.
It's just like a youngling making a website and getting some mail from pixsy: they might be right, they might not be, but that doesn't matter, because paying the (in a way) bully $500 to keep the lawyers away is much cheaper than even thinking about going to court, where you also face the possibility of losing and squeezing your wallet even further
I'm very thankful that you always write in the description. A lot of RUclipsrs don't do that and it's really annoying.

@@bluedreamchicago9319it's not necessarily RUclips being evil; these systems are a compromise between them and big media companies so that said companies don't bury them in copyright court. It sucks, but if they cut into the system these companies might have enough and sue, and in a way they'd be completely right: RUclips wouldn't be doing much, definitely not enough, to prevent their content getting illegally redistributed on the platform

RUclips should rework their copyright claims system into a double edged sword. If you make a claim, and your claim turns out to be invalid, YOUR channel recieves a strike; and if you're doing a claim through a third party, YOU are still held culpable and will recieve a strike.
We're on a platform where what people say about you and your work can ruin your career and you need protections in place that can stop and/or remove malicious threats to your livelihood.
The thing is, you don't need a channel to claim a copyright, at least for the big companies that do own those specific movies, shows, etc. I feel like if you copyright and it's invalid or false, you don't deserve to have the ability to claim copyright on anything ever again or for a significant period of time and the more invalid or false claims you do, the more sever punishments/restrictions you get.

Fake copyright strikes is against the copyright law, it’s illegal to do so, RUclips could very well check videos and determine if a strike is rightful or not, specially since it’s a system that they placed but didn’t correctly modify it, literally anyone on RUclips can copyright strike even a brand new account, it’s stupid and very easily abused and for a company as massive as google it’s very stupid that this is a hill that they’ve been dying on since around 15 years ago

Nearly every time I post public domain classical music as the soundtrack for one of my videos, it gets a copyright flag from RUclips and I have to disupute it. When I've used genuine public domain music, I've won the dispute every time. There are some copyright trolls out there who've put in copyrights for every single piece of classical music ever made, regardless of whether it was written in the 20th century or the 16th century.
Mutahar's content is very refreshing. Puts my faith back in humanity.

I got to this channel through a video talking about censorship legislation pending approval in the Brazilian Congress. I have to say that I hope that RUclips does NOT get consored here in BR, but I feel the reality shown in your video is much closer to what I believe is right. BTW, I completely agree with this perspective. RUclips allowing strikes, intelligent, but without analysis, automutilation or even suicide for the whole platform. Instead of copyright claims being automatic as soon as they're submitted it should be that a corporation or whoever should have to submit a request to youtube to copyright claim the video and a human being should review the request before determining if its legitimate or not so stuff like this doesn't happen
Everytime I hear about more copyright strike problems on youtube I get flashbacks to my original channel, over 500 subs back around 2012 and a magazine company copyrighted a single frame (all black load screen with nothing but my face in the corner) on my first face cam video. Channel was perma banned and I still get sad all those videos are lost forever

I think that youtube should permanently ban any user from the account who has been confirmed to abuse the system. This would stop at least the most blatant problems with this system.

RUclips needs to wake up and grow a pair. They’ve become so disgusting with their “rules” it’s a genuine shame.
this all is an unfortunate consequence of how copyright law was set up and how it fails to accomodate changes in the modern landscape. RUclips still existing is a miracle, and almost solely down to them making these systems to appease companies that would absolutely be in the right to sue them into the ground. this happened to me too dude. Posted a youtube short of a fish drinking water, people reported it for no reason thinking it was animal abuse, except that it was a fish casually drinking water. Then they strike me for that. After that I went to youtube and searched for my video and there were literally 20 other videos that were the same from mine. RUclips needs to change there reporting platform and how they handle these types of things
