Here's the definition of simple assault: Simple assault is usually defined as an ACT that causes someone to fear physical harm or injury. An example of simple assault could be an individual threatening to punch someone in the face, even if they never carry out the threat.
So when he reached out his hand and walked towards him, that could be construed as simple assault, especially since he verbally threatened him afterwards, i.e. "wait until I get off work, I'll beat your a$$" or whatever he said.
