Join me for a van life Halloween adventure, that turned out to be scarier than we'd hoped for! I took my Ducato self build campervan to some haunted woods for a scary movie night with friends. And scary is what we got!
Also in this video, we have a catch up, to let you guys know about the court case I have coming up, to do with a driving offence I was wrongly accused of. And I play some footage from the police officers body cam, from the incident in question.

Adam if you apply to your service supplier for your phone they can give you a break down of usage for the times you ask that's what they show in court
Never speak to the cops if you get pulled, give name and address then zip it. The more you talk the more you incriminate yourself, thats what hes trying to do by asking loads of questions. He has all the technology at his fingertips, let him work for his wage 👍 loving the vids ✌️

I had a similar thing, the police officer claimed that the in-car camera wasn’t working and that the mic was faulty on his body camera. The police summoned me, but put the wrong reg number on the summons. I went to Crewe magistrates court, and on the day the prosecution applied to the magistrates to change the reg number, which the magistrates granted and after a 1 hour hearing, I lost. Points and a £600 fine. There’s no justice in the magistrate’s courts, the magistrates are often very senior in their years and out of touch, they almost always believe the Police..

I was sure there was something about if it was wrong it on the summons they could not enforce it….
Similar situation here, ended up for 4 points and a £300 fine for something I didn't do. Absolutely fuck the UK!
It's so sad when you've been on the planet long enough to learn the POLICE are there to protect the Aristocracy from us should we ever get fed up with Government over reach, they are not constables who said an oath to protect the people any more, Police ( policy )enforcers swear an oath to the crown. It's all lies and deception by the rich on the poor, nothing changes.

As to the cop saying you were holding your phone, you should get a car cam like the one I have. It has 2 cameras..1 for the front of the car and the other films the entirety of the inside of the car. Next time you could prove just by showing the inside of the van vid and then tell the copper to jog on.
The fact the copper could not get your number plate correct seems to demonstrate that he is not very good at seeing what is around him anyway.
Just a point, ask them to produce the evidence of the data pings for your phone which will show you were not making or receiving a call or texting.
I agree with your sentiment, unfortunately it is now illegal to even touch a mobile phone let alone pick it up ! It's a new law. Where it is placed in this case the belligerent cop is to dumb to realise his mistake!

My point is producing evidence that he didn't use his phone for texting is making calls won't help! The cop didn't say that's what he was doing. The cop said he was holding it in his hand! He didn't have to be making recieving calls or texting. The pings you refer to will only tell you if the phone was in the vicinity. There are "other" things you can do with a mobile phone that do not use data or phone signal. Even if the phone is switched of and you chose to touch it or hold it in your hand that is considered breaking the law now that is my point! I don't agree with it but there are people either don't understand like you, or don't care so that's why they changed it. Minorities ruin it for the majority...
@@charvais we can’t use a mobile phone touch screen even if it’s in a static holder? I thought that was still acceptable. A lot of taxi drivers get their jobs through on their phones.

I’ve been there dude, we once got stopped for racing (yes young and stupid) it was 2 XR2s and it ended up with both of us in court at the same time answering to dangerous driving. Yes we were going faster than 30 and I would have accepted that but the 5’0 took us to court and were unprepared. It was a sting of inaccurate evidence given by them from the wrong car colours to seeing a driver with blacked out windows. They even said my mate had no insurance and he was in court for that and racing. They swore under oath that they had done a vehicle check and it turned out they had written the reg down wrong. He was insured and we were acquitted of any offence as some of it was made up.
FIGHT it, take it to court and discredit him as he clearly says the reg wrong, he is mistaken about the phone also as he can’t be relied upon to recall what happened if he can’t even read the registration on a vehicle!

Yes, fight it. I got ticketed for hitting a truck when I spun out due to the person in front who intentionally slammed on his breaks to harrass me. I went to court and was not charged.
Good luck with the cops, I stood my ground when i was stopped for going through a red light, that wasn't red, despite him telling me i might get a worse fine/points if i went to court. A lot more too it than that, but the court found in my favour and he stomped off in a huff, luckily I've not bumped in to him since!! 😂
The police officer owes you an apology and compensation for the distress and inconvenience

Don't worry about Johnny Law Adz, I'm already working on the campaign to 'Free the Vanlife 1'. I just need some artistic types to create banners, slogans, t'shirts and a campaign song. Can I suggest you sit in the van holding the steering wheel with the phone in the holder and get someone to take photos or video of how it might look like it was in your hand.

Hi,
take some advice from a 53yr old that has won against the police on many an occasion. The only way to win is to make the police look incompetent and or dishonest. One thing I would question is how he could be sure, when for instance you were both travelling at 30 in opposite directions in vehicles at differing heights. It would not be possible to know what if anything was in your hand in a split second view. The trick would be to question him on what else was in the cab etc as he had such a good view. I would also question him on what is a driving licence as he asked you to produce it. It is not possible to produce your licence, as in law it is the record that the DVLA have. Question everything, road speed, pedestrians, other vehicles, the weather etc. I would also ask him if your windows are tinted, they are but chances are he will say not. Honestly, I guarantee that the only way you will win is to make him look foolish or for him to lose his temper. The court will be preempting to believe him, they are not your friends. Hopefully he doesn't read my proven advice and good luck.

The courts are not there for justice, they are there to make money, why else do they threaten witnesses if they do not turn up , I will never be a witness again when you learn first hand how you are treated.They can only make money based on the evidence you provide hence the bullying tactics they serve you,
Go to court. Its word against word. Remember the prosecution have to prove beyond all reasonable doubt you were on your phone. I think they will drop it before it gets to court. The copper didn't caution you when he pointed out the offence yet he still questioned you about it. Yet he then cautions you and asks questions. He doesn't tell you that you're not under arrest and you're free to leave at anytime. He doesn't explain your rights to a legal entitlement, and he doesn't explain the caution to you. All a breach of code C of PACE

If the officer didn't have the observational skills to correctly read your registration plate when it was stationary just a few feet from him how can his ability to swear on oath that he saw you on your 'phone from a distance whilst moving be trusted? The burden of proof is beyond all reasonable doubt and I would say there is reasonable doubt.
Cool projector. I've got the same one and I've watched your vid on it, great for portability. I've even had movie nights. 20 of us watched The Conjuring 2 and used the who side of the house as a screen. Fantastic.

Since the Covid war and the dark lockdown days of gov lies and over reach many people are looking for a simpler life , sadly no surprise I guess the powers that councils now have make it almost impossible to buy a bit of land and build a tiny home static caravan etc, they dont want us to be free of their system.

The audio was cut because that’s how body cams work. They’re always recording and when turned on the audio for the first 30-60secs will be muted. It then kicks in and you’ve got audio and video
I’m glad yr still going to fight this all the way Adam, I personally know someone that got in the same predicament as you with there mobile and got taken to court and they won so don’t give up the police don’t always win. PS that end clip with the skull 💀 was hilarious. Maxx

your face during the copper convo - gold! i would suggest you put a 'no case to answer' plea into the court prior and submit a written statement that you present prior to the hearing to ensure the magistrates understand your position up front. good luck!

If you get a good solicitor you'll win hands down. Do you have legal cover on your insurance? If so use it! Did the police officer follow all the correct procedures? Did he tell you that he's body cam was recording when he stopped you? You can say no and they haven't got the evidence that he said otherwise. Little things like this will all add up to say that he didn't do he's job correctly and that he is incompetent and needs further training. 👍 Good luck

If you are coming to Norway or Sweden in January, make sure you have winter tyres on your van

I do most of my camping on my own and I still enjoy it. But my favourite things are the van life events because that’s where I’ve met everyone. Maybe if you haven’t done a build by next summer you could hire a van for a weekend and go to an event to see what you think. And yeah that hob nob detection is smart! 😂

I don't think it was muted - police bodycams record constantly and when the officer presses a button it then starts logging audio and video, but it includes the previous 30 or so seconds video as a buffer, that's why there's no audio to start with - you'll notice the audio kicks in when he appears to fidget with the bodycam which is almost certainly the point he manually started it
PC dyslexic also appears “blind” to criticism of his opinion regarding you using your phone whilst driving.
With no video evidence it is his word against yours, and remember that he has to prove beyond REASONABLE doubt that you were using it, and surprisingly his in car video wasn’t working - remember to ask why this was during your court case.
Make sure you also ask for your expenses for attending court when found not guilty!
That's the big disadvantage of being in England. Here in Scotland the policeman's evidence needs to be corroborated - one officer's word against you won't be accepted by the court as proof, in fact the Fiscal wouldn't consider a prosecution for one second.

glad you got his body cam. even tho edited. re submit and ask for the missing info. see what they say. use that the cop makes simple mistakes and now he also made a mistake about the phone use. you create doubt for the judge to only rely on a cops word.

Adz the Axon body worn cameras records video on a loop so when it’s activated the previous 30 seconds video is viewable but no audio during this time. Your word against his with no video footage I would think it would get thrown out

Ooo so they just happened to have muted the sound at the beginning of the video but not the visuals. At least we’ve got the footage at 14:30 where he distinctly says “ I saw you coming the other way….. holidng your VAN in your hand”.
Sorry fella but I have to correct you. Radio signals was my job in the military. You can be stood 100 yds away from your oppo and not be able to speak to him on the radio due to the terrain. Radio signals find it hard to pass through solid objects. So yes your radio signal could be crap while in a woods.

I got stopped years ago for being on my phone whilst driving when i was actually sat still in traffic and was just resting my head on my hand.
Copper was really aggressive about me being on my phone, so i tried to be as polite as i could which seemed to be winding him up even more. Even when i pointed out that it was physically impossible for me to have been on it because my phone was in my bag which was in the boot, he carried on and only stopped when another unit arrived and took over.
I was given a produce so when i turned up at the station with my documents i pointed out that the officer had recorded the car as manual transmission but i was actually driving my girlfriends automatic so i wanted to make a complaint about how the stop was handled and the incorrect details being recorded. Never heard back from the complaint but nothing went further either. Hope you manage to sort it
