I got rear ended a while back and the insurance company (State Farm) of the guy who rear ended me said they were going pay for the damages to my truck as well as a rental car for the time while being fixed. I’ve always been a clean and safe driver and had never been in an accident before this one. I also had some alignment issues underneath and a messed up tire from this accident but insurance wouldn’t pay for it bc they couldn’t link it to the accident even tho I told them it did. So I had to spend about 2 grand getting that fixed. The VERY NEXT DAY I get a call from the insurance company and the body shop that’s fixing my truck saying they don’t think it can be fixed and that I should just declare it totaled and take a check for 13 grand from them. And my truck was a 2006 Tundra with 117,000 miles on it. But I just felt so blindsided from the insurance company. So the moral of that story is Never trust the insurance company

I was glad to take the call bc i explain the pain i was in and how difficult it is for me to even speak of it plus I emphasized reasons how the at fault drive was negligent
What NOT to say?
Dont incriminate yourself. Dont admit guilt if you can avoid it. If you say it was your fault, they will put the blame on you. If you dont say it was your fault, theres a chance you wont be considered at fault.
Dont completely change the story of course. Just never outright accept the blame.

My friends cars diff has been damaged by a roadside assistance. They put on a spare that was smaller size tyre on the rear drive train.
What legal steps can be taken.
Sue the roadside assistance company. If they fucked up, they’re liable to pay for the damage they caused

I hit an animal and my insurance company said i was not at fault thats good for me but should i email them to send me a collision report which says i was at no fault just as a proof so that my premium will not go up next time
