      @@Kenziescreativecorner9 Or he opened a fire door without knowing what it is yet. I seem to remember that one day when I was growing up that my sister was very close to exiting through a fire door at a Marshall’s in Massachusetts when we were shopping there. Luckily my mother noticed what she was about to do and stopped her before she could open the door and set off the alarm. I think this was my sister’s first time seeing a fire door. She has level one/mild autism and this was back in the 1980s. She was no longer on a toddler leash at that point but she still had some tendency to wander off and open and close doors (although she was already getting better about this at that point).
      She was a bit older than Ezra at this point (possibly as old as eleven or twelve, but she might have been as young as nine). In other words this can happen to almost anyone one time (if fire doors are involved instead of a traditional fire alarm handle) but after the first (and possibly second) time(s) it is less likely to be an honest mistake. Ezra set off the alarm twice in a single day (at least one time by opening a fire door (the video is somewhat ambiguous on what happened the first time)). Therefore this behavior needs to be nipped in the bud as soon as possible to prevent it from becoming a regular pattern of behavior with the consequences that may result from a continuation of said behavior. The most mild consequence might be a ban (either temporary or permanent) from visiting a particular location imposed by the management of said location.Last night in a phone conversation I mentioned to my parents what I saw in this video yesterday (without mentioning any specific video or channel) and they were curious about whether a temporary or permanent ban from visiting the location was imposed as a result. I have occasionally heard of people receiving lifetime bans from hotels, resorts, etc. for even less than this.

    Second leash in the car. Might be helpful if you guys have a sensory bag for Ezra were you can have his leash, noise, canceling, headphones, his cables/other toys he likes, safe foods and his AAC device so he can practice. Does it help if Ezra gets out some of his energy before doing activities. It seems like his adhd wasn’t letting him find an activity for long. If you guys were aloud to go in and out of the building maybe have short sensory brakes like that would help him.

    This looks like so much fun! I would like to say first that Marie definitely touched a higher fly than the machine registered. That would have frustrated me and I just wanted to let her know. What book was Mark reading? He seems to have gotten kind of quieter lately. Ezra, Simon, and Marie looked like they had a blast! That was weird how the fire alarm went off and nobody moved… I guess if it had gone off for real the sprinklers would have gone off as well.

      Very true. We are still teaching Ezra that

  • @thomasschoeck9080

    If this was the result of opening and closing doors (a behavior commonly seen in autism (according to books I have read and some videos I have seen)) instead of actually pulling the alarm then it was probably accidental. He probably didn’t know what he was doing.
    Over the years I have also seen some people older than Ezra (including some adults) do this when they are in a hurry to leave a building and apparently didn’t take the time to read the “Alarm will sound” notice. The vast majority of these people probably knew what they were doing (or they should have). Therefore it would be a good idea for Ezra’s therapist to begin introducing him to some of the more advanced social rules (the major “dos and don’ts”) in various situations so events like this don’t continue to occur. This is important because Ezra is seven years old which is (legally speaking) considered to be the “age of reason” in many States. It is at this age that prosecutors can begin to use phrases such as “Mens Rea” in connection with actions that are considered unlawful and presumed to be deliberate. When it comes to defense there is the “diminished capacity defense” but this may or may not always apply when common sense suggests that it would.
    I should mention that I am not an attorney (and probably never will be) but I have read a few books from the legal section of Barnes and Noble over the years and I have seen both Legally Blonde movies and I watch both the “Legal Eagle” and “Law by Mike” RUclips channels (as well as Steve Lehto’s channel) so I would like to think that I know a few of the basics.
    That just about sums up my observations on the subject of this video for the time being.

    My friend’s brother, who also has level 3 Autism, pulled the fire alarm at school one year.

    • @thomasschoeck9080
      @thomasschoeck9080 10 месяцев назад

      When I was in school back in the 1980s (in Massachusetts) this was the one of the two or three main things that we were told every year of Elementary School on the first day of every year to absolutely never do. This was mentioned in an assembly in which it was stated that it violates local and state laws and that it may violate federal laws as well and that the penalties (including suspension,expulsion,fines and/or jail time (or at the very least time in a juvenile reformatory) would inevitably occur regardless of who someone’s parents were or any other circumstances) are quite severe. I have not looked up the relevant statutes but if it does violate federal law then there would likely be no minimum age or any provisions in the law addressing whether or not the person pulling the alarm has a disability. This would mean that if charges are filed that putting together a convincing and effective legal defense would be quite difficult (to say the least).
      This is why it is extremely important for Ezra’s family to make sure that he never does this again beginning with always using his toddler leash in public and then letting Ezra’s therapist know about what happened so he can immediately begin to learn about the most important dos and don’ts of behavior in a public place (beginning with avoiding the types of negative behaviors that could have major legal repercussions).
      In addition if charges are filed in connection with this or any future actions they will need to obtain competent legal counsel at once (e.g. immediately).

    • @thomasschoeck9080
      @thomasschoeck9080 10 месяцев назад +2

      @@megangreene3955 No I would not take him to court. In your comment above it was not clear how old he was at the time.
      If the laws do not take age or disability into account they should be modified in a way that avoids prosecutions in situations like this while preventing people who do know better (such as the average teenager or adult) from endangering the public by sending out emergency services on false calls. Also, the post ending with the word “Oops” did not mention that your son is autistic (it only mentioned that the event happened at a Halloween party and that it happened years ago at a local fire station). Also the usual public safety considerations don’t apply to the specific situation that you mentioned because the firefighters (or other employees) at the station no doubt simply turned off the alarm realizing there was no fire. Also if this happened in a small town with only one fire station it might not have even been necessary to call other stations to prevent other firefighters from being dispatched unnecessarily. Given his age he probably didn’t understand what a fire alarm was and as a result no crime was committed. Typically for a crime to be committed an act needs to be deliberate. As mentioned in the movie Legally Blonde if there is no Mens Rea (or no vicious will) there is typically no crime. Unfortunately statutes do not always take this into account and when they don’t they should be modified.
      If he were at least in Elementary School (first grade or above) it would likely make a difference legally speaking (due to the presumption of Mens Rea by that age). When I was in school there was a legal presumption that if you were in first grade (or above) that you knew better. I know that this was the case when I was in school because the legal consequences of pulling fire alarms were not mentioned in preschool or kindergarten but they were mentioned in first grade and every grade after that.
      Also I have never heard of anyone preschool age (in any state or country) being prosecuted for this because before the age of six or seven one is usually presumed to not know any better.

      Those are his ankle braces to help keep rotation of his feet. We made a video about it here if you’re curious. ruclips.net/video/pMxUlKdtPmg/видео.html

    Pulling the fire alarm when there’s no fire is considered to be a false alarm. Fire alarms can be used to alert people when there’s real fire or emergencies, and evacuate. 🔥🚨🧯

      …wow

      The possible false alarm charge might require intent depending on local, state or federal laws but I don’t know this for a fact because I have not read the relevant statutes.
      Other possible charges including disorderly conduct and disturbing the peace might not require intent (again depending on the details of the relevant statutes).
      If any of these statutes do not require intent then they should be modified so that a crime is only committed if there is intent.

      @7Aheadfamily  10 месяцев назад +2

      Yeah, this wasn’t actually a fire alarm, just a door that had an alarm to it if you leave, which makes it more difficult for a child like Ezra to understand why you can’t leave through that door. We’re working on that. 😊
